AN ORDINARCE Entitled an Ordinance levying and assessing as a tax upon the lots, parts of lots, blocks, or tracts of land where not divided into ,lots or blooks, fronting or abutting on Neches Street from Railroad avenue to Washington Boulevard; Broadway from Fifth.Street to tenth Street; Liberty._Avenue from First Street to tenth Street; Fifth Street from -Calder Avenue to Long Avenue, twb -thirds (Z/t) of the -cost of paving and gutter and incidental .drainage, and -all the cost of curbing said Neches Street from Railroad Avenue to Washington Boulevard; Broadway from Fifth Street to tenth Street; Liberty Avenue from First Street to Tenth Street; Fifth Street from Calder Avenue to Long. Avenue, apportionable tothehereinafter referred to property; - and declaring said tax a lien upon said property and a personal dabt upon the owner or. owners thereof and providing a time when said tax shall become due and payable, providing for the collection of same and all costs incurred in collecting same; if not paid at the time it becomes due and payable; and providing the rate of interest sai& tag shall bear from the t1me it beoomes due until paid; and declaring an emergency; WHEREAS, pursuant to the requirements of sub-seation-h of Section 68 of the Charter of the City -of Deawnont, the City Commission of the City of Beaumont caused -to be published, for the time and in the manner- required therefor by the City Charter;' a notice of a Resolution .of said Commission, passed heretofore on the 27th day of July, g.D.. 1923, ordering. a hearing_ to be given to the persons, firma oorporations or estates, their agents or attorneys owning property abutting on ,Neches Street from Railroad avenue to Washington Boulevard; Broadway from Fifth - Street to Tenth Street; Liberty Avenue from First Street to Tenth Street; Fifth Street from Calder .Avenue to Long Avenue; end_ calling upon all persons interested in said matter to appear and show cause, in conformity with the provisions -of the Charter above referred to, why the assessments in said notice should not be made against said property and the owners thereof, which hearing was to be held in the Council Chamber of the City Sall of"Beaumont,. Texas, at 10:00 A.M: on the 14th day of August, A.D4 1923: AND, WHEREAS, a full and fair hearing in conformity with the - Charter and the law in such -oases having been had in conformity with said notice, and the Commission having inquired into and determined all facts necessary to the adjudication of all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; And it appearing that the assessments as proposed in"the above mentioned Resolution passed on the 27th day of July. A.D. 19239, with the exceptions hereinafter noted, are in all respects fair and equitable, and that there will be a full and adequate and special.benefit to the abutting property and the owners thereof from and by reason of the proposed pavement and improvement in excess of the amount assessed against the abutting property and the` - respective o=ers thereof NOW; THEREFORE, BE IT ORDAINED BY THE CITY COMJISSION OF THE CITY OF BEAMIONT: SECTION 1 That there is hereby assessed against the several owners of property and against their respective property abutting upon :4Neohes Street from Railroad Avenue to Viashington Boulevard; 4.- Broadway from Fifth Street to Tenth Street; liberty avenue from First Street -to Tenth Street; Fifth Street from Calder Avenue to Long Avenue; as a tag two-thirds (2/3) of the cost of paving and gutter and incidental drainage., and all the cost of curbing on Neches Street from Railroad Avenue to Washington Boulevard; Broadway from Fifth Street to tenth Street; Liberty Avenue from First Street to Tenth Street; Fifth Street from ualder Avenue to Long .venue; The lot, lots, parts of lots, blocks or tracts of land on which saidtax is levied and assessed is hereinafter described; together with the number of feet front on each lot, parts of lots' - blocks or tua,cts of land, the name or names of the owner or owners thereof and they proportionate amount of the cost of said paving and gutter, and the cost of said curbing to be borne and paid for by such owner or owners as shown by the statement prepared by the City Engineer of the City of Beaumont, which said amount is hereby ie -vied and assessed as a tax upon such lots, parts of lot; blocks or tracts of land as shown, to wit; ( INSE_IRT ASSESSMENT LIST) Frovided; however; that Fifth 0treet from Ualder Avenue to _Dong venue; or any part thereof, shall be paved 40 feet in width instead of 27 feet where all of the property ovrners along any part of such section of said street enter into a written agreement with the Uvalde Kock Asphalt Gompany, satisfactory to such Oompany obligating themselves to pay the additional cost of such paving over the 27 feet provided for in the plans and specifications for which the above amounts have been as--essed j SECTION 2* that said tax so levied and assessed shall become due and payable upon completion of the paving upon the portions of said streets, upon which said lot; lots, parts of lots, blocks or tracts of land front and abut, and the amount of the tax hereby levied and assessed together with the cost of collecting same and seven per cemt per aamzm from the date same is collectible until paid is hereby declared a lien against the said lot, lots, part of lots, blocks or tracts'of land, superior'to all other liens claims or title except city, county and state taxes, and shall constitute a personal charge or claim against the owner or owners of the said lots, parts of lots, blocks or tracts of land: SECTION The fact that tfie foregoing portions .of 'streets are in bad condition `end badly in, need of pa .-ing in order to facilitate the heavy traffic over smme', creates an emergency and an imperative public necessity necessitating the suspension of the rule requiring ordinances to be read on three separate meetings, said rule is therefore hereby suspended and this ordinance shall take effect and be in full force and effect from and after its passage and publication; Passed this day of $- A.D.-' 1923, by the. affirmative vote of all the members of the Commission: Approved this the day of a�g, A.D. 1923:
