Entitled an-1,'rdinance levying and assessing. as a tag upon
the lots, parts of lots, blocks, or tracts of land where not
divided into lots or blocks,, fronting or abutting'on Alma Streat
from Railroad Avenue to 'Shannon Street, - two-thirds- (2/3 ) of the
cost of shelling. and incidental drainage apportionable to she
hwreinafter referred to property; and declaring' said tax a lien
upon said property and a persogal ,debt upon' the owner or owners
thereof and. providing a time when said. tax shall become. due and
payable, providing fo-r•the collection of same and'all costs
incurred in collecting same; if hot paid at the time it becomes
due and payable; -and providing the rate of interest said. -Lax shall
bear from the time it becomes due until 'paid; and declaring an
eme rg ency;
WHEREAS, pursuant -to the requirements of sub -section h of
.eetion 66 of the Oharter of the Uity of ueaumon - the Oity
Oommission' of the amity of 6eaunont caused to be published, for the
time and in the manner required therefor by the City Oharter, a
notice of a, resolution of said Commission, passed heretofore on
-the 21st day ,of ''ugust,_ A.D. 1923,. ordering a hearing- to be given
to persons, fi s corporations or estates, their agents or attorneys
opening propertYabutting on ' Alma Street from railroad Avenue . .
to Shannon Street, and calling upon 611 persons interested in said
matter to appear and show cause, in conformity with the provisions
of the Oharter above referred to; why, the assessments in said notice
should. not be -made, against., said property,•and 'the - owners -thereof,
which hearing eras to be held in the oouncil ihamber of th vitt'
Aell of .D6aumont, :.exas, at 4:00 -P.M, on -the lith. day -of aeptember,
A.D. 1923;
AND, wMiFAS., a full and fair hearing in conformity with the
.Charter and the law in sucli cases having been.had in conformity
.with said.notice, and the commission hazing inquired into and
..determined -all facts -necessary to the ad-judication of all special
benefits accruing to such owners by means of such improvements;
and said hearing having been duly, closed;
-6md it appearing that the asUessments as'proposed-in the above
mentioned resolution passed on the 21st.day of August, A.D. 19232
with the exceptions hereinafter" noted,, are in -all- respects fair and
equitable-, and that there will be a full .and adequate and special
benefit to theabutting. property. and -the owners ,thereof from and by
reason of-iheproposed shelling and improvement in excess of the
amount assessed against the abutting property,an.d the respective
owners thereof:

That there is hereby assessed against the several owners of
property and against their reppective property abutting upon LLIMa
Street from railroad :venue to Shannon Street as,a tag two-thirds
231 of the cost of shelling and incidental drainage;
'The lot," lots, parts of lots, blocks or tracts of land on
which said tax is assessed and
levied -is hereinafter described
together viith the number . of feet front .ori each lot; parts of lots;
blocks or treats of land,the -name or names of the owner or awners-
thereof and %he proportionate: amount of the cost of said sheliing..
to be borne and paid for by such owner. or owners as shown by the
:. statement prepared by _the city engineer of the Gity of 1)eaumont;
which said amount is hereby levied and assessed as a tax upon
such lots, parts -.of let, blocks or tracts of land as shown, to- wits'

said street, upon which said lot, iota, parts of lots, blocks or
tracts of land front and abut, and the amount of the tax .hereby
levied and assessed -together with the cost of collecting scene
and seven per cent per -ann.Um .from the- date. same is collectible
until paid Is- hereby declared alien against the said lot, lots,
part of lots, blocks or tracts -,of -lard,, superior to all other
liens,,''. -claims -or -,title except .city,. county and state taxes, and:
shall constitute ,a _personal charge or claim against the owner or
owners of the .said lots-, parte of lots, blocks or' tracts of land..

condition and badly in need of shelling'in order to facilitate the
traffic over -same oreates an emergency and an imperative public
necessity, necessitating the. suspension of the rule requiring
ordinances, to be -read- on three separate' meetings, said rule is
therefore hereby suspended and this ordinance shall take effect
and be in full fore 'and effect from and - after its passage and
pub li c a.t i on.
