Prohibiting the peddling, selling or offering
for sale of ice cream; sherbet,'. flavored ices, lemon-
ade- drinks sewed by the glass, hot. tamales,.encheladas,
-red hots, weiners, s-ausages, hamburger, fish, -sandwiches,
and prohibiting the 'peddling-, selling or .offering for -sale
of any fruits; vegetables, -or , other articl-es of "pr6duce of
food other than the above mentioned articles. and other than
milk or milk -'products along ,or upon any public street,
side walk, alley or public, place in, the 'City of Beaumont
without first.obtaini , prescribing ng a' permit therefor; rescribi a �-
fee of twenty-five dollars ($25:00) for each year �-

SECTION 1;
That- it. shall. hereafter be unlawful for any person
to peddle, sell or offer for sale ice cream, sherbet; flavored
ices- lemonade, drinks served by the glass, -hot- tamales,
eneheladas, red hots, weiners, sausages, ' hamburgers, fish,
sandwiches, or any similr_food products easily contaminated
by dust-,_ - dirt or flies, along or upon any public street- side -
walk, a71ey - or other public places"in the City o -f Beaumont
SECTION 2:
That it shall. hereafter be unlawful for ' any person to
sell -or offer for sale any fruits, vegetables, or ether
articles of produce or food other -than the artic7:es mentioned -
which are prohibited from being sold
in Section l hereof/and.. -other than milk or milk- products as .
regulated by ordinances now in force thereon, along or upon
any public street,- sidewalk or of her• publie 'plac e in the City -
of Beaumont. without first having obtained- a permit, upon
application duly made, as hereinafter provided. for* 2rovided;
however, that thi-s" ordinance shall not apply to- deliveries. of.
fruits, vegetables, or toher articles of produce or food made
-pursuant to a sale or order procured other than by solicit%taxon
o r offering- fo r sale along or upon any _public `street,: sidewalk
..
or alley, nov-shall.this ordinance apply to sales of fruits
or vegetables where same are sold or offered for sale by the
person actually growing -or producing, such fruits or vegetables;
SECTION_ 3.
That any person, firm or corporation, his or its officers,
agents or employes desiring a permit for the purpose or
purposes mentioned .in. Section 2 hereof shall make application
in writing therefor to the Director of ;z;ani.tation of the City
of Beaumont., setting forth ,in said application in detail the
purpose for which it. is desired to obtain such permit: upon
payment of a fee of twgfnty-five dollars .($25.00) for each year,
`,such permit shall lie, issued by the. Director of Sanitation' and
shall be valid for a period of one year from its date unless
sooner revoked, . and all amounts so collected' shall be placed in
the. general fund of the City p . &o perm it shall- be- issued -for a -
lesser period than one year.
Blank application forms and permit plates, certificates
or cards --shall be furnished by the City of Ueaamont under the
supervision and direction of the Director of sanitation who
shall be responsible for the enforcement of this Ordinance.
Each person holding a permit shall -cause the permit, plate,
certificate or card issued to him to be attached. to the...con-
veyanc e used', in the. conduce of such , business at all times while
such e onveyanc e is in use under, such permit o
SECTION 4:
All vehicles or conveyances used for distributing or
delivering ,fruit or vegetables must. -be so constructed as to
protect such fruit _ or vegetables from flies, dirt, dust Or
other filth.

of a misdemeanor,
and
uponn
conviction shall be
fined
in any
sum not exceeding

be. sufficient cause for revocation -of such p,erinit by the
Directo-r of -Sanitation- without, Furth-er notice to- th.e' - --:- _
-holder -thereof! Revocation of a permit shall forfeit
to-the City all ' fees paid thereund.e-r
SECTION 6.'
Allordinances and Parts of ordinances in conflict
her- a-re hereby expressly: repealed in . "so far .as' -such
c onflic.t exists. ;

The .fact that fruits, vegetables-:an.d' f-ood products

under'unsanitary c-ondi'tions:, danger's to-the hb4th of. the
people .:creates an imperative public . emergency necessitating
thesuspension of, the.=rule requiring ordinances to be read
on, th-r.ee .separate._'d.ays 'before final, passage; 'wherefore,. --such
rule: is hereby suspended and _ this o, d nance� sb.all take effect -
from and after. the date of it s. .passage;
