AN ORDINANCE
Amending suU'-sections 10 and -29 _ of Section 3, and:
Section 9 .of an Ordinance entitled -"An Ordinane;e entitled
an' ordinanae regulating -the production anal- sale of� milk
products, and ice cream --in and for the Citi of Beaumont;
and authorizing the Director of Sanitation of the City of
Beaumont to make regulations; relative -thereto; providing
a penalty for the violation_ the_ reof; ardi providing that.
the invalidity_ of a part shall not invalidate - the whole
of said ordinance"; and declaring an emergency;
BE IT ORDAINED BY THE CITY COMMISSION -OF -THE CITY
OF BEAUMONT t
SECTION 1:.
khat hereafter sub -sections 10 and 29 of Section 3
and Section 9 of the- Ordinance mentioned in the preamble-
here-of
reamble-here-of shall be and read as ,follows, " to' wit-, -
(`10) All wagons or -conveyances used for the.-
purpose of delivering or distributing.milk- or cream
within the -City of Beaumont shall be -covered or en-
closed: in-. uch_.a way .as_: to protect the_ - bottles' and
containers -from -flies and dust, 1.0y shall be
washed and scrubbed daily and must be free from
offensive odors and shall bear plainly -marked on
the side thereof in legible characters not less than
three-- ( 3) inches high and one - and one-half
inches -wide, the permit number und-e-r which said milk.
or cream is being sold or delivered,and the name and _
address of the dairyman or dealer and the grade of
milk or cream authorized to be. sold by such dairyman
or dealer -by the Director of Sanitation, Grade "An
or Grade "B" as the case may be. No dairyman,,
creamery, milk depot or any_ other place where milk
or cream is sold, shall -i ise . the word or words "All""
�.- Grade "A", ;Grade` "A'r Milk, or any other word pr
phrase. -to -advertise the ' sale of Grade "All' products,
or, the words_' "Btr, Grade' "B'"; Grade 'B" Milk, o -r. any
other .words to advertise the sale of Grade "B}r products,
on any, bottle,. can, or .any other receptacle used for,
milk, or upon any truck, wagon or other conveyance used
in the deliverer of milk or cream in the City of Beaumont,
__or in',any newspaper,- periodical, sign poster,. or other _
advertising medium unless he ''is _in possession of a
permit.issued by the Director of Sanitation to sell, or
distribute Grade "A" or Grade`"B" products, as the.case

(29) Such permits shall be subject to revocation
by said Director of Sanitation at his discretion, upon
sufficient cause -therefor shown, provided however, that
no such permit shall be revoked until after a hearing by
said Director of Sanitation in the matter of revocation
of suc.h'permit, after five (5) days' notice in -writing
has been served upon the holder of such permit stating
the ground for complaint and the,.time and place of hear-_
ing. Failure of the holder of such permit, after due
notice, to appear for such hearing shall .authorize the
cancellation -of -said dairy permit without further notice.

Seeti"op.' 9® Any dairyman, person, firm or corporation
who shall violate any of the terms or provisions of
this ordinance; or who shall fail, refuse or neglect
to obey'or conform to any of the directions herein
contained; or in whose possession, care, custody or
control any milk or milk products shall be found 1ruh ich
shall not comply with the terms of this ordinance,, shall
upon conviction hhereof be punished by a fine of not
less than twenty--five.doilars ($25,00) nor more than
two hundred dollars ($200.00)®
SECTION 2.
The fact that frauds are being practiced on the people
by false representation of certain dairymen selling milk in
the City of Beaumont creates an emergency necessitating the
suspension of .the rule requiring ordinances to be read on
three separate days before passage; wherefore, such rule is
hereby suspended and this ordinance shall take effect from and
after its passage and the signature of the Mayor.
