HomeMy WebLinkAboutORD 49-D611 -IA -SAN ORDINANCE j Entitled an ordinance levying and assessing as a tag upon "the lots, parts of lots' blocks, or tracts of- land where not divided into lots or blocks, fronting or abutting,on-Railroad -.Avenue from -Sabine Pass Avenue to College, Street; Mariposa Street from Crockett Street to Liberty Avenue; Pine Street from Mulberry Street to Ash Street, two—thirds (2/3)- of the cost of paving and gutter and incidental drainage; and all the cost of curbing'said Railroad Avenue from Sabine Pass Avenue.to College Street; Mariposa Street from Crockett Stre t Mbv tre - Pi e S meet from Mulberry Street to Ash Street,; au lar ng" sa a a e upon said property and a personal ebt upon the owner or owners thereof and providing a time when said tag shall become due and payable, providing for the collection of, same and all costs,in— eurred in collecting same, if not paid at the time -it becomal s due and payable; and providing the rate of interest said tag -shall bear from'the time it becomes due until -paid and declaring an emergency: WHEREAS, .pursuant .t o - the requirements of -Sub--section h ,of Section 68 of the Charter of the.City of Beaumont; the City Commission of the City of Beaumont -caused to be -published, for -.the time -and -in the -manner, required therefor by the City "Charter, a notice of a Resolution of said Commission, passed heretofore -on the 22d of May, A.D: 1923; ordering a hearing to be given to the persons,• firms, cor= porations or -estates, their agents or attorneys owning property abutting on -Railroad Avenue from Sabine Pass Avenue to College -Street; Mariposa Street- from- Grockett' Street to Liberty Avenue; Pine Street from Mulberry Street to—Ash—Street—,- and*- calling= upon all persons interested in said matter to appear and show cause, in conformity with the provisions of the Charter above -referred to, why the assess-- ments in said notic-e should not be made against said .property and the owners thereof'; which hearing was to be held in the Council Chamber of the City Hall, of .Beaumont , Texas; at 2:00 O clock -P,Mon June 2d Q .1923; AND*, WHEREAS, a full and fair hearing in conformity with the Charter and the law in such cases having been had in conformity with said notice-, and the Commission having inquired into acid . 'determined all facts necessary to -the adjudication bf .all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; = And, it appearing that the assessments as.proposed in the above mentioned Resolution -passed on the 22d dap of May; A.D. 1923-, with the exceptions hereinafter noted; are in all respects fair and _ equitable, and that there will be a full and adequate and special benefit to the abutting property and the owners thereof from and by reason of the proposed pavement and improvement in excess of the. amount assessed against the abutting_ propefty=-sand the respective owners "-thereof: NOW,THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION " OF THE CITY OF BEAUMONT': SECTION 1• • c Thatthere is herebyassessed against the several owners of property -dna against their ,respective property abutting upon Rail- road Avenue from Sabine Pass Avenue to College S�treet;.Mariposa Street, -from` Crockett Street to Liberty Avenue; Pine Street from SECTION 3, That all the costs of grading and paving that portion of Railroad }venue between College Street and Sabine bass Avenue, lariposa Street between Liberty Avenue and Crockett Street, and .Pine Stre t between Mulberry Street and Ash Street, 44 between the rails -of the Texarkana and Fort Smith Railway Company, Beaumont Wharf and `erminal Company, Eastern Texas Electric Company, Texas and New Orleans Railroad Company, Gulf and Interstate Railway Company of Texas; and the Gulf Beaumont and Kansas City Railway Company; and a space twenty-four inches beyond the outer edge of the rails of said Companies located on said streets shall be borne by the said Texarkan4i and Fort Smith Railway Company; Beaumont Wharf and Terminal Company, Eastern Texas Electric Company, Texas and New Orleans Railroad Company, Gulf and Inter - State Railway Company of Texas; and the Gulf Beaumont and Kansas City Railway -Company, respectively, and such costs of said improve - meats are hereby assessed against the said Texarkana)and Fort Smith ?' Railway Company, Beaumont Wharf and Terminal Company, Eastern Texas Electric Company, Texas and New Orleans Railroad Company, Gulf and Interstate Railroad Company of Texas, and the Gulf Beaumont and Kansas City Railway Company, reppectively, and shall be collected as other assessments levied under this ordinance, provided such work shall be -done in accordance with the City ordinances regulating the construction of the railroads in the streets of the City oft Beaumont, and the paving of such streets traversed by the same* SECTION 4. .The fact that the foregoing portions of streets are in bad condition and badly in need of paving in order to facilitate the heavy traffic over -same creates an emergency and an imperative public necessity necessitating the suspension of the rule requiring ordinances to be read on three separate meetings, said.rule is therefore hereby suspended and this Ordinance shall take effect'.axx be in fall force and effect from and after its passage and publica- tidn.
