1�ntitlecl An ordinance granting to the Texarkana & Fort
Smith Railway Company, its successors or assigns, the
right and privilege to construct, lay and maintain a
standard gauge railroad track, over and upon Railroad
Avenue across Forsythe Street, in the City of Beaumont,
Jefferson County, Texas, and to operate its trains and
cars for a period of ., �) years, said standard
gauge railroad track to be laid over and upon Railroad
Avenue, and across said Forsythe Street,. more particularly
described as follows:
A track breaking out of the northerly side of
the carrier's industrial spin in Railroad Avenue
at approximately the west line of the alley east of
Forsythe Street; Thence westerly crossing Forsythe
Street_ at approximately the northerly line of Rail-
road Avenue to a point near the northwest corner of
Railroad Avenin and Forsythe Street.
The same is shown in yellow on attached blue
print, which is hereto attached and made a part hereof,
and prescribing the conditions to be fulfilled before said
ordinance shall go into effect, and the time limit 'for the
construction of said track.
BE IT ORDAINED BY THE CITY COMAISSION
OF THE CITY OF BEAUMONT.

The Texarkana & Fort Smith Railway Company, its

successors and assigns, is hereby granted the right and
privilege to construct, lay and maintain, at its own ex-
pense,' a standard gauge railroad track over and upon Rail-
road Avenue and across Forsythe Street in the City of

Beaumont, Jefferson County,' Texas, and to -operate its tracks
and cars thereon for a period of e ( } years, said

standard gauge railroad track to be laid over and upon said
Railroad Avenue, the same breaking out on the northerly
side of the carrier's industrial spur in Railroad Avenue
at approximately the west line of the alley east of Forsythe
Street; Thence northwesterly crossing Forsythe Street at
approximately the northerly line of Railroad_ Avenue to a
point near the northwest corner of Railroad Avenue and For-
sythe Street as shown in yellow on attached blue print, which
is hereto attached and rnada a part hereof.
SECTION 11.
The standard gauge railroad track to be constructed,
laid and maintained under the terms and conditions of this
ordinance, shall be used only as an industrial track, it
being understood that the construction of said track is only
for the purpose of reaching commercial and industrial enter-
prises located on Lot Six (6), corner of Railroad Avenue
and Forsythe Street,
SECTION 111.
The foregoing rights and privileges are granted
upon the express condition that said grantee shall within
thirty (30) days after the final passage of this . ordinance,
file w* ith the Cit y AAOL:-of the City of Beaumont its
written acceptance of this ordinance.
SECTION 1V.
Unless the grantee, its successors or assigns,
shall construct, lay and have completed the track herein
contemplated within twelve (12) months after the final
passage, acceptance and publication of this ordinance, the
same shall be null and void and of no force and effect.
SECTION V.
This ordinance is passed subj pct to all the terms
and provisions of the Charter of the City of Beaumont. ''

SECTION VIS
This ordinance shall go into effect sixty (60
days after its adoption on its third and final reading
and filing of acceptance and publication, and shall con-
tinue in :full force and dffect for a period of 44F�-��
~years thereafter .
