HomeMy WebLinkAboutORD 17-Dbv'Ll 1, a �s i AN ORDINANCE 0,1uli./ Entitled an ordinance amending Sections 2 and 10 of an ordinance, "Entitled an ordinance to better protect the public health, -and particularly to prevent the introduction and'the- spread of bubonic. plague, by -providing for the tat -proofing of all buildings, outhouses and other super -structures, stables, and lots, open areas and other premises, side -walks, streets and alleys in the City of Beaumont, providing for penalties for the violation thereof; providing that the invalidity of a part shall �of i lid t�,va1�1 of- said ordinance; arid- declaring- an emergency;-" n-r-p iaVht�49me°shall take effect from and after its passage and signature of .the -Mayor. < BE IT ORDAINED BY TAE CITY COMMISSION OF THE .CITY OF BEAUMONT: That sections 2 and -10 of the ordinance mentioned in the preamble hereof be amended so that hereafter said sections 2 and 10 of said ordinance shall be and read as follows: Section 2. - That it shall be unlawful. for any person, firm or corporation to have or maintain or Hereafter construct, and or for any person, firm or corporation to occupy or use as owner; agent, -tenant, - lessee, - or otherwise, " any building,. outhouse, or other super -structure, stable, lot, open area or other premise, side -walk, street or alley, within the City of Beaumont unless the same shall be ratproofed in the manner "hereinafter provided. Section 10. That it is hereby made the duty of the Depart- ment of public �, and particularly through the division of Public Health thereof, under the supervision and direction of'the City Manager, to enforce the provisions of "this ordinance; pro- vided that no affidavit shall be filed against any owner, agent, occupant -or other person charged with the duty .of complying with or who shall violate the provisions of this ordinance, until thirty (30) days shall have elapsed after communication shall have been deposited in the.United States mail, in an envelope addressed and stamped by the City Clerk or some one under his di- rection, to such owner, agent,.occupant or person, to his residence,. if known, or place of business, if known, or to the premises upon Which said violation shall be alleged to lie, which communication shall designate the character of violation with which such person shall be charged and the location of the premises upon which the offense is alleged to lie; and the.person serving such notice shall make his return upon a copy of such notice, showing how and when he served the same, which -return he shall certify officially, and said copy and return zhall be kept on file in the office of the City Olerk,�and shall be admitted in evidence as prima facie proof of se'rviee of such notice as herein provided for; provided, further, however, that if any person; firm or corporation, who; with actual knowledge or notice that any building, structure, etc., is not rat-proofed:in accordance with this ordinance, and notwith- standing -such knowledge or notice, moves into, occupies, or uses.the same, he shall be -guilty of violation of this ordinance and the no - case tice above provided far shall not in suchAe required.
