Entitled. an ordinance granting The Gulf Colorado & Sante, re Railway Company, lessee of the Gulf & Interstate Railway Company of Texas, the"right to build, construct and operate an industry track from a point on its main line track at Chaining Station 3696 plus 62 in Block No. .44 of the Van Wormer Addition to the City 6f Beaumont, running eastward across Victoria Street down what is� y7-, known and designated as pJeffersonAlley", entering the alley between Bonham and Crockett Streets and continuing down Jefferson Alley 945 feet across Railroad Avenue and Holmes Avenue to the west line of Archie Street, a distance of 1282 feet in all, as is shown by the blue print attached to this ordinance, providing also that said track is and shall be used only as an industry track, and providing further that the rights and privileges herein granted shall be accepted -in writing by the Gulf, Colorado and Santa Be Railway Company, lessee of the Gulf & Interstate Railway Company of Texas, within thirty days after the passage and approval of this ordinance, and that said industry track shall be completed within twelve months after the final passage and publication of, this ordinance, also providing that the Gulf, Colorado and Santa Be -Railway Company, lessee of the Gulf & Interstate Railway Company of Texas, shall pay to the . City of Beaumont annually on the first day of July of each year. the sum of $10.00 as reasonable compensation for the privilege and franchise hereby granted; and providing further that the franchise shall be subject to the terms and conditions of the City Charter of the City..of Beaumont and shall exist for a period of thtrty years. i BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT. SECTION 1. The Gulf, Colorado 8c Santa Fe Railway Company, lessee of the Gulf.& Interstate Railway Company of Texas, its successors and assigns are _hereby granted the right and 'franchise to lay, build, construct, maintain and operate at its own expense a standard gauge railroad track across Victoria Street and over, along abM upon Jefferson Alley in said City of Beaumont beginning at a point on the main track of the Gulf and, Interstate Railway of Texas at track Chaining Station 3696+-62 in Block 44, Van Wormer Addition to the City of Beaumont, Texas, and running. eastward tangent 162 feet, thence on a 15 degree curvo to the left 175 feet crossing Victoria, Street and entering alley between Bonham and Crockett Streets, continuing tangent down the center- line of the said alley 945 feet aeroos Railroad Avenue and Holmes -Avenue to the West line of Archie Street, 1282 feet in all, as shown on blue print attached. hereto, marked PExhibit A" and made a part hereof. the line .of said, proposed railroad track being indicated by the red line drawn on said blue print, SECTION 2. The track to be laid, built,. constructed, maintained-. and ope ratdd under the terms and conditions of this ordinance shall be used only as an industrial track, that is for the puppese of affording loading, unloading and switching facilities to commercial and industrial enterprises now located or hereafter to be located in the vicinity of said track. SECTION 3. The foregoing rights and privileges are. granted upon the expressed condition that the said grantee shall, within thirty days after the passage and approval of this ordinance, do ..r file with the City 'wry of the City of Beaumont its written acceptance of this ordinance. SECTION 4. Unless the Gulf, Colorado and Santa Fe Railway Company, lessee of the Gulf & Interstate Railway Company, its successors and assigns shall construct, build, lay and complete for the purpose of operation the track herein contemplated within twelve months after the final passage, acceptance and publication of this ordinance, then to the extent of the track not so completed this ordinance shall become null and void and of no -force and effect, SECTION 5* This ordinance and the rights and privileges therein granted are subject to all of the terms and -provisions of the Charter of the City of Beaumont, and said privileges and franchise hereby granted shall continue in force :[Qt a period of '*++,rt7- years from and after the date of said Railway Company's acceptance of the terms hereof. SECTION 6, As reasonable compensation for the rights and provileges granted by this ordinance, the Gulf, Colorado. and Santa Fe Railway Company, lessee of the Gulf and Interstate Railway Company of Texas agrees and obligates itself to pay to the City of Beaumont on or before the first day of July of each year after the taking effect of thi s ordinance the sum of O a �.
