AN ORDINANCE.
Entitled an ordinance granting to the Beaumont
Wharf & Terminal Company, a corporation, its successors
and assigns, the right and privilege to lay, build, con-
struct, maintain and operate a standard guage railroad
track in the City of Beaumont, Jefferson County, Texas,
from a point, in .Austin Street south of Block 69, of the
old town of Beaumont, connecting with and parallel to
the main track of the Beaumont Wharf & Terminal Company,
now constructed in said Street and running down said
Austin Street to a point just beyond lot No. 357 in said
Block, as shown by blue print attached to said ordinance;
providing that said track shall be used only as an industry
track and'for no other purpose; providing further that the
rights and privileges therein granted shall be accepted in
writing by said corporation within thirty days after the
passage thereof and the signature of the Mayor; providing
further that said industry track shall be completed within
twelve months after the final passage and publication of
said ordinance and that said Beaumont Wharf & Terminal
Company, or its successors and assigns shall pay to the
City of,Beaumont annually on the first day
of each year the sura of $5.00 as reasonable compensation for
.the privilege and franchise thereby'�granted; and providing
further that said franchise shall be subject to the terms
and conditions of the City Charter of the City of Beaumont
and shall exist for a period of years.
BE IT ORDAI14ED BY THE CITY COTEAISSION OF
THE CITY OF BEAUMONT :
S { CTIOE- 1.
The Beaumont Wharf and 'Terminal Company, its; success-
ors and assigns are hereby granted the right and franchise to lay
build,.c one truc.t,. maintain and, operate, at its.. own expense;
a standard guage railroad track along, over: -and :upon Austin
Street,, from a point opposite Lot No...360,' in Block No. 6.9
to .a point. just ,beyond Lot ;No.' 357,, in Blook .No:: -.69,, a
distance of approximately 300='feet, -said track connecting'
with the spur or -industry track which connects' with the,main
line .of the Beaumont Wharf. & Terminal Company in Austin Street,
as more accurately shogun by the blue print hereto attached
and made. a part of this ordinance. The line of said proposed
railway.b.ein'g indicated by the red .lines drawn on said blue
print:.
SECTION 2.
The track to be laid-V built, constructed, .maintained
and operated under the terms and conditions of .this ordinance.
shall .be used only as, an industrial track, .that is for the
purpose of affording loading, ,unloading and switching'.
facilities' to commercial. and indust°Tial enterprises now located .
or hereafter to be located in the vicinity of said.track.
SECTION 3.
The' foregoing :rights- and privileges-'are granted,
upon the expressed condition that the said grantee shall,
within .thirty days after the, passage and: approval of this
ordinance, file-with the City+ of the.,'City of
.Beaumont its written acceptance of this ordinance.
SECTION 4.
Unless-the Beaumont Wharf &Terminal Company, i'ts
successors or assigns shall'' construct, build, ::lay and complete
for the purpose of operating the track : herein contemplated within
twelve.. months .after the final passage;- acceptance and publica-
tion of this ordinance, then to the extent of the track 'not so
completed this, ordinance. shall become null and'. void and of no
force and effect.
SECTION 5.
This ordinance and the,rights and privileges
therein granted are subject to all'of the terms and pro
visions of the Charter,of the City - of Beaumont,'and said
--privileges and frgnehise hereby'granted shall continue
in force for a period of arty years from and after the
date of -said Railway Company's acceptance:of the terms
hereof.
SECTION 6.
As -reasonable compensation for the rights end
privileges granted by, this ordinance, the Beaumont Wharf .
& Terminal Company agrees and obligates itself .and its
-successors and -assigns to pay to.the City of Beaumont on
or before the first day o of each year after the
taking. effect of this ox inance the. sum of $5.00.
