HomeMy WebLinkAboutORD 6-D-474,-' AN ORDINANCE ENTITLED an ordinance creating a board for the examina- tion of Electricians; designating the number of persons to con- stitute such board and the qualifications of the persons who shall be members thereof, and- the manner of their appointment and the filling of vacancies and the tenure of service; providing the duties to be performed; . providing for examination of all electricians and the licensing thereof and the fees to be paid; and providing pbL ns and penalties for the violation thereof. BE IT ORDAINED BY THE CITY COMMIISSION OF THE CITY OF BEAUMONT: - Section 1 That there shall be and is hereby created a board for the examination -of all electricians, and all persons engaged in the electrical business or doing electrical work -as an occupation in the City of Beaumont, which board shall be known as the EXAMINING AND SUPERVISING BOARD OF ELECTRICIANS, and shall consist of the City Engineer, the City Electrical Inspector, the General Building Inspector, one contracting electrician and one journeyman electrician, the last two named to have had not less than five years practical experience. The first three above menti oned, are to have terms of service upon said Board during their respective office and the last two shall be appointed by the City Manager within five days after this ordinance takes effect, their respective terms to last until the next election for City Officers, if any vacancies shall occur in said Board, they shall be filled by the City Manager for the unexpired term. Section 2 Members of the Examining and Supervising Board of Elec- tricians. shall receive no compensation for their services on said Board. Section 3 a- Said Board shall examine and pass upon all persons engaged in the electrical business in the City of Beaumont, and all persons who may hereafter wish toengage in the electrical business within the City of Beaumont, Texas. b- No license shall be issued to any person to do elec- trical construction work until he shall have first appeared before the examining and Supervising Board of Electricians for examination and registration and shall have -successfully passed the required examination. c --No license shall ever be issued for more than one year, but may be renewed from year to year upon proper application in . writing, and filed with said Board and upon payment of one dollar, if said Board is satisfied that such applicant is entitled thereto. d- All licenses shall be non -transferable. e- Proper record shall be kept by said Board of all licenses issued, their dates and the names and Post Office Addresses of those to whom issued. f- Upon the written request of any person who desires to stand the -electricians s examination hereinbefore provided for, said Board shall provide such examination as in its judgment will best test the applicants fitness to follow said trade and business. #2 All persons now engaged in electrical .construction work in the City, shall, within ten (10) -days after this ordinance. takes effect, - submit .themselves to said Board for examination, and -in .default -of so doing it shall be. uhlawful. for them toengage ,in the electrical - business unless and until examined and licensed. Section 4 Each master electrician -shall execute.a bond, payable -to the City of Beaumont, Texas, - in the sum of One Thousand ($1000.00) Dollars with not -less than two' -good -'and sufficient sureties or with a responsible Surety Company, - authorized to do business in -Texas as surety, conditioned to protect said City against' all- loss or damage occasioned by,-th-e negligence of 'the principal' therein,_ in -failing to properly execute and protect all work done -by him or his employees, or under -his direction, or --supervision, and from all loss or damage' occasioned by or- arising .i.n any manner from any work. done, by said principal or 'his employees, or under his direction or supervision, which is not caused by thenegligence- of said 'City or its agents or .employees; conditioned,- further, that .the .principal therein will keep and. observe all -ordinances -at any time enacted by- said . city, . relating in any way to electrical work,. said bond to be.approved by either the City Manager -or the --Mayor before it becomes effective, and may -be sued on. -by said City in any court, of competent jurisdiction. All such bonds shall run for a_ per-iod o.f one- year and be renewed at their, expiration, and no ---electrical .workshall 'be done by him and no permits shall be issued to any -Master Electrician' when he has no such a bond in: fullforce and effect. No :inspections shall be made or permits issued for electrical work until all such inspection fees and --permit fees have been paid. Section 5 Each , appli cation for examina tion - for an , el ectr.i ci an f s license shall -pay the sum of Two ($2.00) Dollars for each Journey- men electrician examined; which fund- shall bep.aid to the- City -clerk and used to defray ' all its legitimate -expenses., and the residue,, - if any, shall .be paid over - to the -.City_ Collector, and credited- to the Inspection. Department. The City .Clerk _shall issue all licenses upon certification of "the Board that :the applicant has passed the examination as required'. = - Section 6 Said City Clerk shall for the Board, register- in .a book to .be kept fora that purpose the :name and place of .business of all. persons; firm -s or corporations, -to whom, a license is mssued, together wi-th the date of the issuance of such license. Section 7 Upon the written request of any person; firm or corporation -who desires to stand the electrical examination hereinbefore- provided for. said Board shall provide such examination for the applicant of electrical' li oense as in its judgment will best, test their fitness to follow saidtrade and business. All such persons now engaged as electrical .workers in the' City of-- Beaumont, Texas;- shall, within ten (10) days :after this ordinance. takes effect, submit themselves to the said Board for exaination, '-and in default of so doing it .shall be unlawful. for them -to -engage as electrical mechanics unless and until examined -and licensed. C� Z c� k ►� a< 'i Section 8 Any person, whether as Master Electrician or Journeyman Electrician, engaged in working at or conducting the electrical business Without license, as provided in this ordinance shall be deemed guilty of a misdemeanor and on conviction thereof shall be subject to a fine of not less than Ten ($10.00) Dollars and not more than one hundred (°J100.00) Dollars, and each days violation of any provision hereof shall constitute a separate offense. SECTION 4. Each master electrician shall execute a bond, payable to the City of Beaumont, Texas, in the -sum of One Thousand ($1000.00) Dollars with not less than two,good and sufficient sureties or with a responsible Surety Company, authorized to do business in Texas'as surety, conditioned -to protect said City against all loss or damage occasioned by the negligence of the principal therein, in failing to properly execute and protect all work done by him or his employees, or under his direction or supervision, and from all loss or damage occas-ioned by or arising ii any manner from any work done by said principal or his employees, or under his direle- tion or supervision, which is not caused by the negligence of said City or its agents or -employees; -conditioned, further, that the prin6ipal therein will keep and observe all ordinances at any time enacted by said city, relating in any way to electrical work, said _bond .to_ be app_r_oved_ b_y.e_ither the__City__Manager or_ the _Mayor -before---"- it becomes effective, and may be sued on by said.City in any court of competent -jurisdiction. All such bonds shall run for a period of one year and be renewed at -their expiration, , and no electrical work shall be done by him and noopermits shall b_e issued to any Master Electrician when he has no such a_bond in full force and, effect. No inspections shall be made or permits issued for electrical work until all such inspection -fees and permit fees. have been paid. SECTION 5. Each application for examination for an electrician' s li- cense shall pay the sum of Two ($2.00) Dollars for each Journey- men electrician examined, which fund shall be paid to the City Clerk -and used to defray all its legitimate expenses, and the residue, if any, shall.be paid over to the City.Collector, and credited to the Inspection Department-. The City Clerk shall issue all licenses -upon certification of the Board that the applieant;`ha.s passed the. examination as- required. SECTION 6. Said City Clerk shall for the Board, register'in a book to be kept for that purpose the name and place of business of all persons, firms or corporations to whom a license is issued, to- gether with the date of the issuance of such license. All such bonds shall run for a period of one year and be renewed at their expiration, and no e lectrical work shall be done by him and no permits shall be issued to any master electrician when he has no such bond in full force and effect.
