Entitled an ordinance regulating ice privies in the City of Beaumont; providing for the.licensing there- of; providing for fines and penalties for the violation of - such ordinance; repealing all ordinances and parts of or- dinances in conflict therewith. PREAMBLE. WHEREAS, there are approximately - tial Z-) a— +� dred privies�be.ing now maintained and used in the city of Beaumont, which.constitute a constant and continuing threatening menace to the public jaea.lth,. and- source of har- ras-sment to public authorities; and WHEREAS, the present system of collecting and d is- posing.of the night -soil accumulating in said privies is,in- effective and the system- of' collecti'ng charges for the dis- -posal thereof is ineffective and casts undue and unnecessary burden upon the City Government,jand discriminates between the owners and users of said privies; and WHEREAS, the public interest, arid, especially the public health, requires that a system of licensing said Z=- fzse privies, and the collection of a uniform', charge for the collection.of night -soil accumulating, be forthwith installed and put in operation. NOW THEREFORE, BE IT RESOLVED BY THE CITY COIrUISSIOD OF THE CITY OF BEAUMONT: Section 1. That from and after the f day of September, 1921, it shall be unlawful for any"person or persons, association of persons, firm or corporation, oti,ning any property in the city of Beaumont, business or residential, or his or its responsible agent, to operate, maintain or use, or cause .or permit the operation, maintenance -or use.on or about any such premises, owned -.or controlled by him, them or it, business or residen- tial, anywhere in the city of Beaumont, surface privy Or privies, without first obtaining a license from the city of Beaumont permitting the operation, maintenance and use of such privy or privies. Application for such license shall 0,.M e . to, and such license issued by, -the City j with the approval in each case of either the Mayor or the City Manager; such approval to be,evidenced by the counter.'signa- tore of either ,on the face of said, license. Section 2. That a fee shall be charged and collected from every such person or persons, association of persons, firm or cor- poration owning any premises in or upon which such privy or 71ir�Cuw.wr/u /re .4GMffq. . privies/are._m�.intained or .used, ,_or. from Lhe� agent _ such oErrner, r- - - - are"-Mal, every license issued, according to the following schedule, to -wit: Residence -s, for each privy maintained thereat, $5.00 per annum, payable quarterly in advance; Boarding Houses, for each privy maintained thereat, $8.00 per annum for each privy maintained thereat, payable quarterly in advance; lvlanufacturing and other industrial establishments employing fifty.persons or more, for each privy maintained thereat, $100.00 per annum, payable quarterly in advance; Manufacturing and other indus- trial establishments employing between ti-rrenty five and fifty persons', for each privy,.maintained, $&0.00 per annum, payable quarterly in advance.; Idanufacturing and other industrial-es- tablishnents employing between ten and twenty.five persons, for each privy ,maintained, ;`25..00 per annum, paydbIQ.--quarterly. in advance; 11anufacturing`and other industrial establishments em- ploying ten persons or less_, for each -privy maintained, 45.00 per annum, .payable auarterl.y in advance; All privies open, to the use of the public,, for-eachprivy rgaintained,-$15.00 per annum, payable quarterly in advance; all Idercantile establish- ments, for each privy maintained, 010.00'per annum, payable quarterly in advance.. Section Z. That every such owner or agent applying for and ob- taining such license shall be -entitled to and receive free ser- vice by the City -in the collection and removal of .'the•.night-soil accumulating in and about said surface privies,, without any charge whatever; provided, however, that the license applied for and granted shall in each case be at all times displayed in a conspicuous place. on the surface.privy to which it relates, so. that the employees- of the city collecting and removing the .night - soil therefrok, can easily see it; and if said license be not so -displayed as herein provided, free service will not be given. Section 4.. That every person; firm, association of .persons or corporation, owning any premises anywhere in'the city. of Beau- mont, business or residen tial, or any agent of any such person, firm, association of persons or corporation,having charge of any such premises, in or upon which any surface privy/is• operat- ed,.maintained or used, who operates, maintains.or uses, or causes or -permits the 'operation, maintenance or use of any such privies in or upon the premises so 'owned or controlled, from and after the said September 1921, without the license T y herein provided- for;- permitting'the -operation;-z-maintenance and` use of such privy, shall be deemed guilty of a misdbineanor, and upon conviction thereof, shall, be fined in any sum not exceed- ing One Hundred Dollars; and every day.any one of any such privies 'is operated, maintained'or used without such•li.cense, shall be and is hereby made a separate finable. offense.
