HomeMy WebLinkAboutORD 84-C�t i Ali ORD IITAH CE Entitled an ordinance defining residential districts in the City of Beaumont; providing that a permit shall first be obtained from the City, as provided for therein, before any house, building or improvement of any kind may be built or constructed or used, or any vacant property may be used for any business purpose therein named or therein contemplated, in any residential district, as defined; providing for appli- cation for such permit to 'be made to the City Commission, in accordance with- certain -reouirements therein provided, -and pre- scribing duties and powers of the commission as to and when acting upon such applications; prescribing pains and penalties for the violation of said ordinance; providin tat the inval- idity of part shall not invalidate allsaic�ordi-n�nc`ean� declaring an emergency. BE IM ORDAINED BY THE CITY COMIJISSION OF T71-01 CI TY OF BL+'AUiriONT section 1. That no part of the City of Beaumont within the present fire limits shall be deemed residential districts within the meaning of this ordinance, and this ordinance shall apply outside -of_ the present fire lir: i-ts only. -Residential district within the meaning of this ordinance shall be that space along both sides of any street lying between intersections of streets- ( that is to say, the space between street crossings) I whether such space constitutes one regular size city block or fractional part thereof, or more than one.rggular size cit y block, in length, and wherein two-thirds or more of such space, including the frontage on both sides of the street, is either vacant property or ,devoted to residential purposes, or both. Section 2. That -no house, building, structure or" iff1proveinatt of any kind or description shall ever be built or constructed or used, nor shall any vacant space be used for conducting or operating a grocery store, drug store, meat market, fruit or cold - drink stand, factory; manufacture, laundry, or any other like business purpose, or for a livery stable, garage, blacksmith, repair shop, barber ,shop, or any other like business purpose, or� any other commercial, merc@tn tile, or industrial business or 4 i 2. enterprise whatsoev� r, in any residential district in the City of Beaumont, as such district is defined in Section One (1) hereof, without a w I itten permit from the City, issued before hand, --by or on the order or by the direction of the City Commission. i Section 3. Whenever a permit for any such purpose as set forth or contemplated . in Se clti on Two (2) :hereof is applied -for, upon the conditions and req irements hereinafter set forth, the City Com- mission shall give full consideration to all. the facts, cirfum- stances and conditions involved in the case; and if, after such f consideration, the ,'commission shall determine that the issuance of a permit for the construction or/and use of any such house, building or improvement, or the conduct or operation of any such business, at such location, would be against the public welfare and the general public interest, or injurious to the health or morals or disturb the peace or comfort, happiness -or general well-beingi of the inhabitants of ' the residential district or districts involved, uous to or in or of the inhabitants of the residential district or distrilcts contig � g the neighborhood thereof, then the commission may deny such application and refuse to issue the permit; but .if -it shall appear to the commission, and I. the commission shall determine that no such results or conse- quences would ensue by reason of the issuance of such permit or the conduct or operation of such business at the location proposed -thereunder-, an -d --there =is no--o-ther reason from 'con"sidei'ations of �-. public policy or the public , in the judgment of the commission, why such permit should not be issued, then the commission shall issue or order or; direct the issuance of such permit. Section 4. All applications for such pp' peiniits shall be made upon the following conditions and in accord'anee with the following requirements, an'l the commission may, at its discretion, decline 4 a G 3 • to consider any application which does not conform to such I . conditions and requirements, towit: Such applications shall be made in writing to the commission and shall be accompanied (a) --With EL -fee of Ten (_ 10.00)._Dollars,* which,. when deposited, shall become the property of the City. (b) Byla sketch, map or blue print of the residential district or districts to be immediately affected by the proposed business or improvement, under the provisions hereof, showing, lst., the locati In of the proposed business, structure or improvement; 2nd 1, the record ownership of all the property within such district or idistricts immediately affected. (c) If the proposed house, building, structure or improvement is located, or 'proposed to be located, ,or the space proposed to be so, used is located on an inside lot, then the ----application-shal-1' be- accompanied - with --the- -written _appro-val or disapproval thereof, as the case may be, of the record owners, or their duly authorized agents, of all the property in the immediate residential district affected. Section That every person, firm or corporation who shall build, construct or use any house, building, structure or improvement,- of mprovement of any character, or use any vacant space in any residential district in the City of Beaumont, as herein defined, in'violation I of the provisions hereof, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum of money not less than Five�($5.00) Dollars, nor more than ~ Hundred ($''100.00) Dollars ; ' and .eve ry day any such house, building, structure or improvement stands after construction, in violation of this ordinance,jor is used, or any bacant space is used, in violation hereof, shall constitute a separate and distinct offense. ' Section A. - - That if €zny part of this ordinance is, or should be held to be invalid for any reason, then that -'fact shall not invalidate the entire ordinance, but the balance thereof shall remain in full force and effect.. Section S. The fact that there is no ordinance prohibiting, or regulating the consitruction or use of houses, buildings, structures or improvements, or; the use of vacant spaces, for commercial, mercantile, industrial or other business purposes, in the residen- tial sections or districts in the City of Beaumont, causing great- and—continuo us--con-f-as-ion--and—contention ana�st`rife, and ---- threatening the publia peace and general well-being, and the public health and morals, creates an imperative public emergency for the preservation of the; public peace and general welfare, necessitating the suspension of the rule requiring ordinances to be read on three ;separate daysi before their passage, wherefore s;Ud rule i is hereby suspended; and this ordinance shall take effect and be in force from and after its passage sig t re of the Mayor.
