HomeMy WebLinkAboutORD 77-CAN ORDINANCE Entitled an Ordinance requiring the trimming or pruning of trees, shrubs, vines, palms and like plants of every descrip- tion and kind whose branches may or are calculated to impede, interfere with or inconvenience persons in the use of or their passage upon or along any side -walk or public way in the City of Beaumont, providing for penalties for the violation thereof, and providing,further,that the invalidity of a part shall not invalidate the whole of said ordinance. BE IT ORDAINED BY THE CITY COMJISSION OF THE CITY OF BEAUJONT: Section 1. -That it shall hereafter be unlawful for any tree, shrub, vine, palm, or any like plant of any description or kind to be permitted to overhang or' obtrude upon -or, over any side -walk - or public way in the City of Beaumont, in such way and to such extent as may, or as may be calculated to impede, interfere with, obstruct or inconvenience persons in the use of or passage in, over and along any side -walk or public way; and every tree, shrub.,, vine, palm or like plant of every description and kind situated along, in or nearby any side -walk or public way, whose branches overhang or obtrude upon and over, or in any way obstruct, or which could overhang or obtrude upon .or over, or obstruct in any way any such side -walk or public way, if not prevented by pruning or otherwise, shall be trimmed or pruned, and kept trimmed or pruned so as not to impede, interfere with, obstruct or inconven- ience persons in the free use of and passage in, along and over any side -walk or other public way in the City of Beaumont; provided, that in no case shall tae branches of any such tree or plant be permitted to grow to or remain within 3 inches along the side or <o-dte%rllhe,c of any side -walk or other public way, and not less r� Aan S feet above or overhead along or over any side -walk, and riot less than 10 feet above or overhanging c,�, any street or other ' i public way used for -vehicular or equestrian travel thereover; and every person, associations of persons; or corporation, whether the owner, lessee or agent of any property -upon which any tree or plant is situated or towhic] it may belong, who shall; for any reason fail or refuse to trim or prune,' or cause to be trimmed or pruned, and to keep or cause to be kept trimmed or pruned any such tree or plant, so as to comply with the provisions hereof, shall be deemed guilty of a'misdemeanor and upon conviction thereof shall be punished for each offense, by fine in any sum of money not less than live nor more than One Hundred Dollars, .and each day any such tree or plant ;remains untrimmed or unpruned.,. in violation of the provisions hereof, shall be deemed and treated as a separate and distinct offense, and upon the continued violation or refusal of any person, association of persons or corporation to comply with the provisions of this ordiance, or in any 'case where .any such tree or plant shall remain untrimmed or unpruned in violation hereof, the City Commission shall, have the power to &W, Z;, .ft -r '` entirely remove or, cause to be removed \any such tree or plant, (�- . if such removal is deemed by the Commission necessary or expedient for the- public good or convenience. Section 2. If any part of or provision in this ordinance shall be held to be invalid, the remainder of the ordinance for that reason shall not be held invalid ,but remain in full force and effect, and - only ' "the invalid portion be come inoperative. Dear Sir: I write to remind you, at your request, to look into the matter of regulating the pruning of trees whose branches overhang public walks. 1, myself, am reminded every few days that the light, petitioned for at the corner of Arabella and Sallie Streets,/has. so far not been installed. It is also reported that bridges at the inter- section of Arabella and Sallie Streets,, also -Arabella and Jerome-_ Streets, -are in a condition uns6fe for those v�ho'paao over them. Such information, relative to intentions regard - in the above,.as you may have at"hand will enable me to properly answer questions that have been asked me from time to time.
