HomeMy WebLinkAboutORD 64-CAN ORDINANCE Entitled an Ordinance authorizing and directing the issuance of Funding Bonds by the.City of Beaumont, Texas, for the purpose ;.; of funding a part of the outstanding indebtedness of said city, in arrears for past operating expenses of the government-, providing for an interest and.sinking fund for their retirement, levying a tax for the purpose, and declaring as emergency. BE IT ORDAINED BY THE CITY COMKISSION OF THE CITY OF BEAMONT: Section 1. That there -shall -be issued by the City of Beaumont, Texas, funding bonds, as hereinafter. -de -scribed, for and in behalf of the City of Beaumont, to the,extent of,the sum of Two Hundred Thousand ($200,000.00) Dollars, payable to "bearers', which bonds' shall -be delivered .t.o the holder _ or holders of the outstanding indebtedness of the City of Beaumont in arrears for past operating expenses of the -government, as hereinafter listed and described, in lieu and in payment thereof and in cancellation of the evidence of so much .of said. outstanding indebtedness as said bonds will, discharge, or, in the event that said holders of said indebtedness. decline. t.o accept said bonds in lieu and, discharge of said indebtedness. in its present form, or prefer and demand its payment in. money, . then, in such event, _by means, of such bonds to borrow money on the faith and credit of the City of Beaumont to the extent of the sum of Two Hundred Thousand - ($200,000.00) Dollars, to be used for the purpose of paying off f a part of its said outstanding .indebtedness, and cancelling the evidence thereof,. said.indebtedness being evidenced by the warrants or vouchers of the City'of Beaumont, issued and dated prior to the first dad of July, A. All of said bonds shall bear interest at the rate of five (50) percent per annum, payable semi-annually, on June 30th. and December 31st. of each year, according to the face and tenor of the interest coupons to be attached to the said bonds. .The Pdiayor shall sign the said bonds and they shall be counter -signed by the City Clerk and registered by the Director of the Department of Finance, and the seal of the city shall be impressed on each one of them. The interest coupons shall.be executed with the lithographed^signature of the. Mayor and City Clerk. The said bonds and coupons shall be payable upon presentation and surrender at the office of the Director of the Department of Finance of the City of Beaumont. Section 3. The said bonds, and the interest coupons above provided for shall be substantially, in words and figures, as follows:. (FORM OF BOND) XNOW ALL MEN BY THE SE PRESENTS That the City of Beaumont, in the County of Jefferson, State of Texas, hereby acknowledges itself to owe, and for value received hereby promises to pay to bearer the sum Of ONE TEGUSAUI➢ (1000.00) DOLLARS, in gold coin of the present standard of weight and fineness, or other lawful money, of the United States of America, on the 31st. day of December, A. D. 19' with interest on the said sum from the date hereof, at the radse. of five (6%) percentum per annum, payable semi-annually, on the 30th. day of June and the 31st. day of December of each year, in like gold coin, or other lawful money, of the United States of America, as evidenced and upon presentation of the annexed interest coupons as they severally mature and become due; both principal and interest of this bond being hereby made payable at the office of the Director of the Department of Finance of the City of Beaumont. That it is further ordered that the Hayor be, and he is hereby authorized and directed to take and have charge of the above described bonds, and when registered by the Director of the Department of Finance, as herein provided for, he shall proceed to deliver said bonds to the holders of the aforesaid indebtedness of the city in lieu and in payment thereof and in cancellation of the evidence thereof; but in the event said holders of said indebt. edness decline to accept said bonds in lieu and in payment of said indebtedness and in cancellation of the evidence thereof, or prefer and demand the same paid off in money, then, in that event, the Mayor shall forthwith proceed to sell the same, either at public or private sale, at not less than their face value and accrued interest, and the proceeds of such sale shall be delivered to and deposited with the said Director of the Department of Finance of the City of Beaumont; and the said Director of the Department of Finance shall forthwith deposit.said funds with the city depository of the City of Beaumont; and,.in case of sale thereof as provided, it is hereby made the dutN7 of the Mayor to deliver said bonds to the purchasers thereof in the City of Beaumont, and the payment of said bonds atd the interest thereon - shall be made in the City of Beaumont. 7• ; Section 5. That the proceeds derived from the sale of said bonds, in case of sale thereof as provided, shall be used for the payment and discharge of that part of the outstanding indebtedness of the City of Beaumont, in arrears for past operating expenses of the government, evidenced by the warrants or vouchers of the City of Beaumont described and Listed in detail in this ordinance; and when said moneys shall have been received and deposited the proper officers of the City shall forthwith pay off and discharge said indebtedness and cancel the evidence thereof. Section 6. That for the purpose of paying interest on said bonds, as provided for herein, and creating a sinking fund for their retire- ment, as the same shall severally and respectively mature, there is hereby levied for the year 1920, on each1.00.00 valuation of property in the City of Beaumont liable to taxation, an ad valorem tax of five W) cents, and said tax, or as much thereof as may be necessary, shall, and it is hereby so covenanted by the City of Beaumont, be levied for each succeeding year, so long as may be necessary to provide for the payment of interest and a sinking fund for the retirement of said bonds as they sever- ally and respectively mature; and if at any time the amount of said assessment shall be more than sufficient, or, on the other hand, not sufficient, to provide for the payment of said interest and said sinking fund, then said rate shall be accordingly lowered or raised to meet the requirements. Provided, however, that the aforesaid ad valorem tax here levied, and to be hereafter levied for the creation of said interest and sinking fund shall be a part of and come within the tax rate authorized by the Charter of the City of Beaumont for current expenses of the governiiie' a and the several departments of the city government shall be charged with that portion of said tax here levied, and which may hereafter be levied, as shall be represented by the expenses evidenced by the city warrants or vouchers hereinabove listed, properly chargeable to said departments respectively; and for the first year, to -wit, 1920, said apportionment shall be as follows, to -wit: oRt of the Department of Law, ------ -- .005 Out of the Department of Public Service, .03 Out of the Department of Public Welfare, Out of the Department of Public Safety, .001 Out of the Department. of Finance, ------- .005 Out of the General Fund, ----------------- -- Total,------------------.05 The above percentage of apportionment shall be maintained each year, from year to year,, until the aforesaid bonds, with interest, have been and are finally retired.
