Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on January 15, 2019, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1 & 2/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Greg Mouton with The Gospel of Jesus Christ gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Mouton, Councilmembers Jordan, Getz, Sam, Pate and Samuel. Lynwood Dr. Beaumont TX Spoke regarding Item A on the Consent Agenda; Authorize the City Manager, City Attorney and the City's Chief Financial Officer to register and participate in an on-line auction for the purchase of the former AT&T Call Center Building and property located at 555 Main Street, Beaumont, Texas, stated previously that Council doesn't need to spend any money on the AT&T building, there are issues of raw sewage coming out of a school near her home, there are homes that have issue with raw sewage backing up into their homes, stated that she loves the parks and rivers, but the money can be spent on more important issues, doesn't think that the City should take this gamble, asked that Council keep this in mind when they vote Mary Nixon 3850 Roland Rd. S. Department of Homeland Security, 2019 Emergency Management Performance Grant Program — Resolution 19-014 D) Authorize the City Manager to execute Change Order No. 1, accept maintenance and authorize final payment for the Keith Road 16" Water Line (From Phelan Boulevard to Dishman Road) Project —.Resolution 19-015 E) Approve amendments to the Industrial District Agreements with Air Liquide Large Industries U.S. and Natgasoline, LLC in relation to language regarding abated property under construction — Resolution 19-016 F) Authorize the execution of four Utility Crossing Agreements with Exxon Mobil Oil Corporation — Resolution 19-017 G) Authorize the Mayor, City Manager, City Attorney, Emergency Management Coordinator and other designees to execute a Mutual Aid Agreement, and four adderidums, with the Beaumont Independent School District - Resolution 19-018 Councilmember Jordan moved to approve the Consent Agenda excluding Item A. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED A) Authorize the City Manager, City Attorney and the City's Chief Financial Officer to register and participate in an on-line auction for the purchase of the former AT&T Call Center Building and property located at 555 Main Street, Beaumont, Texas — Resolution 19-012 Councilmember Samuel moved to approve Item A on the Consent Agenda. Councilmember Jordan seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, SAM, PATE AND SAMUEL I NAYS: COUNCILMEMBER GETZ MOTION PASSED Mayor Ames read the announcement regarding Executive Session being held at the conclusion ofrthe General Business portion of the meeting. Councilmember Pate left the meeting at 2:38 p.m. GENERAL BUSINESS Minutes — January 14, 2019 Consider a resolution authorizing the City Manager to award a contract to Chief Solutions, Inc., of Houston for the Sewer Evaluation Work Order Contract — Phase II Project. The Sewer Evaluation Work Order Contract — Phase II will be used to clean, televise, and evaluate the City's sewer collection system to identify cost effective methods to rehabilitate defective manholes and. mainlines. On December 20, 2018, two (2) bids were received for furnishing all labor, materials, equipment, and supplies for the project. The bids are indicated in the table below: Contractor Contractor Location Total Bid Amount Chief Solutions, Inc. Houston, TX $499,926.95 CSI Consolidated LLC DBA Aims Companies Pearland, TX $572,575.00 Engineer's Estimate $458,060.00 Based on a review of the bids and required documents received, the Water Utilities Engineer recommends awarding the project to Chief Solutions, Inc., the low bidder, in the amount of $499,926.95. Chief Solution, Inc., is a certified MBE with the City of Beaumont. A total of 730 calendar days are allocated for completion of the project. Funds will come from the Capital Program. Approval of the resolution Councilmember Jordan moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO CHIEF SOLUTIONS, INC., OF HOUSTON, TEXAS, IN THE AMOUNT OF $499,926.95, FOR THE SEWER EVALUATION WORK ORDER CONTRACT -PHASE If PROJECT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH CHIEF SOLUTIONS, INC. OF HOUSTON, TEXAS. Mayor Pro Tem Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, AND SAMUEL NAYS: NONE MOTION PASSED Resolution 19-019 2. Consider a resolution approving the purchase and installation of bleacher covers at the Beaumont Athletic Complex. , On December 11, 2018, a work session was held to discuss the need for bleacher covers at Complex 2. The covers are a shade structure that will be installed to cover the softball field bleachers at fields D, E and F. Minutes —January 14, 2019 Kraftsman Commercial Playgrounds and Water Parks of Spring, Texas will provide and install the bleacher covers for $124,069.28. Pricing was obtained from Buyboard, a cooperative purchasing association providing cities and political subdivisions with the means to purchase specialized equipment at volume pricing. Buyboard complies with the State of Texas procurement statutes. Funds will come from the Capital Reserve Fund. Approval of the resolution. Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE PURCHASE AND INSTALLATION OF BLEACHER COVERS FOR USE BY THE PARKS AND RECREATION DIVISION AT_ THE BEAUMONT ATHLETIC COMPLEX FORM KRAFTSMAN COMMERCIAL PLAYGROUNDS AND WATER PARKS, OF SPRING, TEXAS, IN THE AMOUNT OF $124,069.28 THROUGH THE BUYBOARD COOPERATIVE PURCHASING PROGRAM. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, AND SAMUEL NAYS: NONE MOTION PASSED Resolution 19-020 Councilmember Pate returned to the meeting at 2:42 p.m. WORK SESSION Review and discuss authorizing the sale of Temporary Housing Units following Hurricane Harvey Chris Boone, Planning and Following the flooding caused by Hurricane Harvey, The Texas General Land Office (GLO) and The Federal Emergency Management Agency (FEMA) worked to provide temporary housing in the form of Temporary Housing Units (THUS) or portable, manufactured home vehicles. City Council allowed the placement of these temporary units by authorizing a temporary suspension. of the zoning rules that normally prohibit such units (currently extended until March, 2019). Under this temporary exemption, the City has permitted approximately 100 THUs within the city. In June, 2018, the GLO and FEMA asked for each jurisdiction's policies on extensions and/or the possibility of selling THUs to individual residents. At that time, a Council Work Session was conducted and as a result, the City's response was that there was support for an extension of the use of THUs but an objection to the sale of THUs, given problems in the past. In November, 2018, the GLO opened their local offices to begin processing applications for the Homeowner's Assistance Program (HAP), the primary program for the repair and replacement of flooded homes. Also, in November, 2018, FEMA and the GLO announced that the "period of assistance" for use of the THUs would be extended until August 25, 2019. However, FEMA also indicated that following the end of the original eighteen (18) month Minutes — January 14, 2019 "period of assistance" (February 25, 2019), FEMA will begin charging monthly rent for the units and/or offering to sell the units to individuals, assuming local jurisdictions approve of the sale. Given the recent series, of events, the Administration believes that there should be further discussion as to whether or not to allow the sale of THUs. If the City were to allow the sale of the THUs, staff could pursue their removal through enforcement of the zoning ordinance at a certain time in the future. Lynwood Dr. I- Beaumont TX Made comments about a crew that came out about a month ago on 10th St., between the Interstate and Delaware, and cleaned the area and cut some trees, they left the trees and as of today they are still there, this is something that happens over and over again, where is the accountability for all of this, why are raises being given, cost of living or other wise to people that aren't doing a complete job, also commented regarding the cleanup along the highway near Luby's, gave' statistics regarding deaths on Texas roads, also made comments regarding a crossing on Treadway where people are running the stop sign, thinks that there is more that can be done to make this city safer for people that don't want to be in car Kimberly Breaux 7965 Halliday Beaumont TX Asked, when the City participates in the auction if the amount goes above the million dollars will the City stop the'bidding process Cindy Lindsay 4375 Thomas Glen Beaumont TX Stated that she was overwhelmed regarding everything that she heard at the meeting, no one ever asked who was in favor or undecided, it was only asked for those that opposed the project to raise their hands George Kemp, Jr. 4850 Ada Ave. Beaumont TX Still has a concern regarding the intersection on Concord and Dowlen, citizens are still running the stop sign, would like to see a red light at that intersection before a bad accident happens, also spoke regarding a sewer issue on the corner of Garner and Concord, stated that every time bad rain occurs the manhole pops up, a person that lives on that street has to put a barrier over it so that citizens won't run over it Mary Nixon 3850 Roland Rd. Beaumont TX Spoke regarding the issue that Mr. Kemp has on the corner of Concord and Dowlen where he is requesting a red light, stated that she's against putting a light there, if a light is putthere it will only cause congestion, right now the traffic is flowing very well and putting a light will stop the flow Minutes — January 14, 2019 Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS f- COUNCILMEMBER JORDAN - STATED THAT IT WAS IMPERATIVE FOR HER TO EXPLAIN HER POSITION TO A CERTAIN DEGREE IN REGARDS TO THE VOTE ON ITEM A ON THE CONSENT AGENDA, STATED THAT IN HER MIND TO REDUCE THE ISSUE DOWN TO THE MERE PROPERTY VALUE OF ABOUT $400,000 IS EXTREMELY SHORT SIDED, IT DOESN'T TELL THE ENTIRE STORY, IN HER MIND IT'S AN OPPORTUNITY FOR THE CITY TO FINALLY GET TO THE RIVER, CAN'T BELIEVE THAT A CITY OF THIS SIZE HAS NOT BEEN ABLE TO DO THIS IN ITS 180 YEAR HISTORY, THIS IS AN EXTREMELY IMPORTANT OPPORTUNITY, COUNCIL IS ASKING FOR IS AN OPPORTUNITY TO DO SOMETHING THAT WILL BENEFIT THE CITIZENS, THE CURRENT TOURISM SADLY IN HER MIND FOCUSES ON FAMILY REUNIONS AND BASEBALL GAMES FOR THE MOST PART, STATED THAT THE CONVENTION AND VISITORS BUREAU DOES A GOOD JOB PROMOTING THOSE THINGS, FEELS THAT THE CITY NEEDS MORE, THE CITY DESERVES TO HAVE FOLKS COME IN AND ENJOY THE CITY AND WHAT THEY HAVE DONE WITH DOWNTOWN AND THE RIVER, STATED THAT SHE'S DEEPLY COMMITTED TO MAKE THIS CITY BETTER WHICH IS WHAT SHE RAN ON, STATED THAT THE CITY HASN'T HAD A POPULATION GROWTH IN 60 YEARS AND FEELS THAT SOMETHING BOLD NEEDS TO BE DONE, STATED THAT SHE SUPPORTS HER FELLOW COUNCILMEMBERS AND THINKS THAT THIS IS SOMETHING THAT IS RIGHT, READ A SHORT EXCERPT FROM AN ARTICLE THAT SHE CAME ACROSS COUNCILMEMBER GETZ - TO THE CITIZENS THAT CAME OUT TO SPEAK TODAY HE THANKED THEM FOR COMING, HE HEARD WHAT THEY HAD TO SAY, STATED THAT HE DOESN'T CONSIDER THEM TO BE NAY SAYERS, BUT CITIZENS EXPRESSING THEIR CONCERNS AS TO HOW THEIR TAX DOLLARS ARE BEING SPENT, STATED THAT HE HEARD BOTH CITIZENS THAT SPOKE REGARDING THE ISSUE AT THE INTERSECTION OF DOWLEN AND CONCORD, THERE MAY BE A SOLUTION THAT CAN. SOLVE THAT ISSUE AND THAT IS TO SIMPLY PUT UP A FLASHING LIGHT AS THERE ARE OTHERS THROUGHOUT THE CITY, IT'S A LESS EXPENSIVE WAY INSTEAD OF PUTTING A STOP LIGHT THERE, ANOTHER SOLUTION COULD BE TO PUT THE LED STOP SIGN, ASKED THAT DR. MAJDALANI LOOK INTO THE LED STOP SIGNS AND GET COUNCIL A COST, GREAT, ANNOUNCED THE DOWLEN/WEST NEIGHBORHOOD ASSOCIATION MEETING ON TUESDAY, JANUARY 14, 2019, AT ROGERS PARK COMMUNITY CENTER, SOCIAL HOUR STARTS AT 6:30 P.M., THE MEETING WILL START AT 7:00 P.M., GUEST SPEAKER WILL BE RETIRED POLICE OFFICER AL JOHNSON, HE WILL DISCUSS WAYS THAT CITIZENS CAN BE STAY SAFE, EVERYONE IS INVITED TO ATTEND Minutes —January 14, 2019 COUNCILMEMBER SAM - CONGRATULATED ATTORNEY CLAYTON MAYFIELD ON HIS RETIREMENT, STATED THAT HE AND THE MAYOR ATTENDED AN EVENT ON YESTERDAY WITH A COMPANY THAT WILL BE MOVING INTO BEAUMONT, THIS COMPANY WILL BE BRINGING 5,000 CONSTRUCTION JOBS AND 1,000 FULLTIME JOBS, COMMENTED ON THE VOTE FOR THE AT&T BUILDING, THERE ARE ISSUES THAT HAVE BEEN IN EXISTENCE FOR LONG TIME AND THE COUNCIL IS WORKING TO IMPROVE THOSE ISSUES, STATED THAT HE'S ALSO LOOKING FOR WAYS TO IMPROVE THE CITY, MENTIONED THAT HE WAS TOTALLY AGAINST THE EVENT CENTRE AND THE BEST YEARS CENTER BUT THE MANAGER HAS PROVED HIM WRONG, IT WAS THE BEST THING THAT COULD HAVE HAPPENED, BOTH PROJECTS TURNED OUT TO BE BEAUTIFUL PROJECTS, IT'S TIME FOR BEAUMONT TO TAKE THE LEAD AND DO SOMETHING POSITIVE AND MOVE FORWARD COUNCILMEMBER PATE - NONE COUNCILMEMBER SAMUEL - IN REGARDS TO THE AT&T BUILDING, HE HEARD MANY SAY THAT THE COUNCIL HAS NO PLAN, STATED THAT THIS IS SOMETHING THAT HAS BEEN DISCUSSED SINCE THE 80'S, WHAT TO DO WITH THE RIVER, STATED THAT THEY HAVE FOUGHT FOR OVER TWENTY YEARS TO MOVE THE RAILROAD TRACKS TO GET ACCESS TO THE RIVER, ALL BUT ONE RAILROAD WAS REMOVED, HAS JUST GOTTEN TO A POINT WHERE THE CITY MAY BE ABLE TO GET THE LAST RAILROAD TRACK REMOVED, THIS IS NOT THE FIRST TIME THAT COUNCIL HAS DEALT WITH THIS, STATED THAT HE WHO HAS CONTROL OF THE PROPERTY HAS CONTROL OF THE DIRECTION THAT IT'S GOING TO GO, THE CITY HAS AN OPPORTUNITY TO PARTICIPATE IN A BID, THERE ARE A NUMBER OF THINGS THAT THE CITY WOULD BE ABLE TO DO IF THEY HAVE CONTROL OF THE PROCESS, STATED THAT HE'S HAPPY TO HAVE MADE THE DECISION, IF THE CITY IS SUCCESSFUL WITH THE PURCHASE THEY WILL HAVE CONTROL OF THE PROPERTY, THE CITY WILL HAVE A VOICE REGARDING WHAT WILL HAPPEN TO THE PROPERTY, ALSO STATED THAT THERE WAS NO COMPANY THAT HE WAS AWARE OF THAT WAS WILLING TO PURCHASE THE BUILDING AND BRING 100 JOBS, ALSO MADE MENTION OF EXECUTIVE SESSION AND HOW HE DOESN'T FEEL COMFORTABLE DISCUSSING OPENLY HOW HE FEELS, IT'S UNETHICAL FOR THE INFORMATION THAT IS DISCUSSED TO BE UNDERMINED, HOPES THAT COUNCIL WILL LOOK AT WAYS TO DEAL WITH THE UNETHICAL ACTIONS OF INDIVIDUALS THAT BREACH THE TRUST INTENTIONALLY, JUST WANTS TO MAKE BEAUMONT IS A BETTER PLACE TO LIVE WORK AND PLAY Minutes — January 14, 2019 MAYOR PRO TEM MOUTON - WISHED EVERYONE A HAPPY NEW YEAR'S, STATED THAT SHE WAS GLAD TO BE BACK AFTER HAVING SURGERY FEW WEEKS AGO, SPOKE REGARDING CONSENT AGENDA ITEM A, STATED THAT SHE SPENT 32 YEARS WORKING IN THE AT&T BUILDING, THERE'S NOT ONE PART OF THAT BUILDING THAT SHE'S NOT FAMILIAR WITH, ENJOYED THE COMMENTS FROM MR.
