AN ORDINANCE
AN ORDINANCE PROVIDING FOR THE ADJUSTMENT OF CERTAIN
UTILITY FACILITIES LOCATED ON HIGHWAY LOOP 251, LO-
CATED.BETWEEN STATE HIGHWAY 124.AND U. S. HIGHWAY 69
IN. THE CITY OF BEA.UMONT, AND AUTHORIZING THE MAYOR
OF THE CITY TO EXECUTE,AND THE CITY CLERK.TO AFFIX
THE.CORPORA,TE SEAL AND ATTEST THE -SAME, A CERTAIN
AGREEMENT BETWEEN THE.CITY AND,THE STATE OF TEXAS PRO-
VIDING FOR THE DIVISION -OF COSTS OF SUCH ADJUSTMENT.
WHEREAS, the Highway Commission by Minute Order 43312,
dated January 23, 1958, authorized the State Highway Engineer to
enter into contractual agreement with`,the City providing for
clearance of right of way involving the adjustment of certain
utility facilities located on Highway Loop 251 between State High-
way 124 and U. S. Highway 69; and,
WHEREAS, the adjustment of such utility facilities shall
be in accordance with Highway Commission Minute Order No. 43312
and Minute Order No. 40218, dated June 20, 1956, and the State of
Texas has requested the City of Beaumont to proceed with the ad-
justment of utility facilities involved, and the State agrees to
reimburse the City for its share of the costs of such adjustment
and a contractual agreement has been prepared between the parties
setting out the terms of the division of costs of said adjustment
of utilities;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
BEAUMONT, TEXAS:
That Jimmie P. Cokinos, Mayor of The City of Beaumont, be, and he
is hereby, authorized to execute for and on behalf of The City of
Beaumont the contractual agreement between the State of Texas,
acting by and through the Texas Highway Department, and The City
of Beaumont, Texas, for the adjustment of certain utility facil-
ities located on Highway Loop 251, between State Highway 124 and
U. S. Highway 69, including the division of costs of such adjust-
ment. The City Clerk is hereby directed to attest the contractual

agreement and to affix the seal of The City of Beaumont thereto.
PASSED by the City Council this 18th day of February,
A. D. 1958.
