AN ORDINANCE
AN ORDINANCE PROVIDING FOR THE ADJUSTMENT OF THE
POLE LINE OF THE TIESTERN UNION TELEGRAPH COMPANY
ON THE TEXAS AND NEW ORLEANS RAILROAD COMPANY'S
RIGHT OF WAY BETWEEN THE POLES LOCATED NEAR RAIL-
ROAD MILE POST NO. 280 AND RAILROAD BRIDGE NO.
283.3 IN THE CITY OF BEAUMONT, JEFFERSON COUNTY,
TEXAS; PROVIDING FOR THE FANNER IN WHICH THE WORK
IS TO BE DONE, AND PROVIDING FOR THE COST OF SAME.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEYAS:
Section 1.
That under date of December 17, 1957, the City Council
adopted an ordinance providing for the relocation of the main line
of the Niissouri Pacific Railroad Company from a point just east of
Elizabeth, Jefferson County, Texas, to a point just east of
Eleventh Street in The City of Beaumont, Texas, and authorized the
execution of a contract between the State of Texas, the Missouri
Pacific Railroad Company, the Texas and New Orleans Railroad Com-
pany, and the City, which provided for the relocation and construc-
tion of a railroad and the payment by the State of Texas of the
construction costs of said project, in an amount not to exceed
.1y550,1000.00, and provided for the payment by The City of Beaumont
of all construction costs of said project exceeding $550,000.00.
Section 2.
That at the time the said contract and agreement was exe-
cuted, it was understood by the parties thereto that the necessary
adjustment of the wire line and poles of the Western Union Tele-
graph Company -upon the Texas and New Orleans Railroad Company's
existing right of way would have to be made to accommodate the
Texas and New Orleans' signal line, and that the cost of the ad-
justment of the Western Union's wire line and poles would be a part
of the construction costs.
Section 3.
That .'a contract.- and agreeme.rit has been,prepared between
the 'State Highway Commissionf,the Western Union Telegraph Company,
the Texas and New Orleans Railroad Company, and The City of Beau-.
mont.. setting : out the manner in which _the ..adjustmen.t , of ,the Western
Union's pole line is to .be made, and providing.'tha-t the City will -
assume. the costs of, construction of the.' -entire. project over and
above the .amount of $;550' 000.00, which.,a,mount; sha31 be borne by the
State, said contract and agreement bei;ng',dated ,January 7, .1958.
'Section 4.
That .the .Mayor be, and he is,'hereby,, author zed::.to execute
for, -and 'on behalf of the City -the aforesaid contract, dated January
71 1.9581 'which contract; fully sets out; ,.'the, terms and conditions of
the project, and. in accordance'.with.the plans, specifications and
estimates of costs attached thereto aAd-made a part thereof.
Section 5.11
That the City. Clerk be,: and he Is hereby, authorized to
attest the. contract and:to affix the seal of The City of Beaumont.
thereto.
