MAIN LINE OF THE MISSOURI PACIFIC RAILROAD FROM .A
POINT'JUST EAST OF,ELIZABETH IN JEFFERSON COUNTY,
TEXAS,.TO.A POINT JUST EAST OF'ELEVENTH.STREET.IN
- THE -.CITY OF BEAUMONT, -TEXAS; AND-`AUTHORIZI-NG THE
MAYOR OF THE CITY TO EXECUTE, AND THE CITY CLERK TO
AFFIX THE.CORPORATE SEAL AND TO ATTEST,THE SAME, A
CERTAIN.CONTRACT BETThTEEN THE CITY, . THE STATE OF
TEXAS, THE MI8SOURI-PACIFIC RAILROAD -`:COMPANY, AND
THE TEXAS AND NEW ORLEANS RAILROAD,COMPANY, PROVID-
ING FOR THE RELOCATION AND CONSTRUCTION OF THE
RAILROAD; FOR THE PAYMENT BY THE STATE OF TEXAS OF .
THE -CONSTRUCTION COSTS-OF-SAID.PROJECT IN AN AMOUNT
NOT TO EXCEED . $550,000.00;. FOR THE PAYME NT ' BY THE
CITY.OF BEAUMONT OF ALL.CONSTRUCTION COSTS OF.SAID
PROJECT EXCEEDING $550,,000.00;,FOR THE ASSUMPTION
BY THE.CITY.OF DAMAGES TO ADJOINING, ABUTTING AND -
OTHER PROPERTY BY REASON OF -SAID CONSTRUCTION.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS;
Section 1.
That since the,public'convenience, safety and necessity.
- -of the -City requires the, relocation of the -main •line of- the Mis
souri.Pacific Railroad Company between a point east of Elizabeth
in Jefferson County, Texas, and a point east of Eleventh Street
in The City of Beaumont.
Section 2.
That the -State of Texas be, and -it is hereby authorized to
construct said Railroad Relocation Project at the approximate loca-
tion and in the general manner shown on. the plans and specifications
attached to the. Const -ruction Contract. ;
Section 3. -
That nothing in this ordinance shall be construed as to
require_ either the Missouri Pacific Railroad Company, or, the Texas.
and New.Orleans Railroad Company, or the State. of Texas to --assume
or pay any direct or consequential damages to adjoining or abutting
property growing out of the construction of said project.:
Section 4.
That the City agrees tQ pay to the State all construction
costs exceeding $550,000.00, and will place said sum of money in
