HomeMy WebLinkAboutORD 19-BBO' AN ORDINANCE ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 17th DAY OF AUGUST, 1957, TO DETERMINE, WHETHER OR NOT THE CITY COUNCIL OF THE CITY OF BEAUMONT SHALL BE AUTHORIZED TO ISSUE SERIAL BONDS OF SAID CITY IN THE AMOUNT OF $2,500, 000 TO PROVIDE FUNDS FOR THE PUR- POSE OF CONSTRUCTING A PUBLIC COLISEUM IN THE CITY OF BEAUMONT AND THE PURCHASE OF NECESSARY EQUIP- MENT THEREFOR,, AND THE LEVYING OF A TAX IN PAYMENT THEREOF; MAKING CERTAIN FINDINGS AS TO THE ADVISABIL- ITY AND NECESSITY OF ISSUING SAID BONDS; NAMING THE TIME AND PLACES OF HOLDING SAID ELECTION AND APPOINT- ING OFFICERS THEREOF; PROVIDING THE MANNER OF HOLD- ING SAID ELECTION AND GIVING NOTICE THEREOF. WHEREAS, the City Council of the City of Beaumont has found and determined, and hereby finds and determines, that in the public interest it is necessary, expedient and advisable to issue serial bonds of said city to provide funds to construct a public coliseum and purchase the necessary equipment therefor, in which can be held musical and cultural entertainments, radio and television shows, ice shows, vaudeville and minstrel shows, flower shows, manufacturers) shows, oil and other industrial :shows and exhibitions, high school and college basketball and other athletic exhibitions, rodeos and stock shows, conventions, and other public entertainments for which no adequate facilities are now available, and which are essential to the future growth, development and welfare of the City of Beaumont; therefore BE IT ORDAINED BY THE CITY OF BEAUMONT SECTION 1 That an election be held in the City of Beaumont, Texas, on the 17th day of August, 1957, which is not less than fifteen (15), nor more than thirty (30) days from the date of the passage of this ordinance, at which election the follow- ing proposition shall be submitted to the resident, qualified electors of said city 11 �.-3b-19 who own taxable property within said city and who have duly rendered the same for taxation, for their action thereupon, to wit: PROPOSITION SHALL the City Council of the City, of Beaumont, Texas, be authorized to issue serial bonds of"said city, in the amount of $2, 500, 000, to provide funds for the construction and equipment of a public coliseum, said bonds to mature serially in such installments as may be fixed by the City Council, over a period of years not to exceed twenty-five (25) years from their date, bearing interest at a rate not to exceed 510 per annum; and shall there be annually levied, assessed and collected, while said bonds or any of them are ottstanding, an ad valorem tax on all taxable property in the City of Beaumont sufficient to pay the interest on all of said bonds and to create a sinking fund sufficient to retire the same at maturity? The probable period of usefulness. of the improvements for which the bond funds are to be expended is more than twenty-five (25) years. SECTION 2 That said election shall be held in the following voting precincts of the City of Beaumont, and the following -named persons are hereby appointed judges of said election, with authority to select their clerks and assistants: Precinct No. 1 At the Edwards School Building; and said election shall be conducted at said voting box by Mrs. C. C. Moore, Judge. Precinct No. 2 At the French High School Building, and said election shall be conducted at said voting box by Jack Folmar, Judge. Precinct No. 3 At the French Elementa r School Building, and said election shall be conducted at said voting box by�T. B. Hensley, Judge. Precinct No. 4 At the Longfellow School Building, and said election shall be conducted at said voting box by Albert Henry, Judge. Precinct No. 5 At St. Anne's School Building, and said election shall be conducted at said voting box by Mrs. W. T. McNeill, Judge. Precinct No. 6 At the -Beaumont High School Building, and said election shall be conducted at said voting box by Spencer Blain, Judge. 6 Precinct No. 7 At the Averill School Building, and said election shall be .conducted at said voting box by C. L. Rutt, Judge. Precinct No. 8 At the Junker School Building, and said election shall be conducted at said voting box by Mrs. James E. Ray, Judge. Precinct No. 9 At the Millard School Building, and said election shall be conducted at said voting box by Judge. Precinct No. 11 At the Jefferson County Courthouse, and said election shall be conducted at said voting box by Tobe Hahn, Judge. Precinct No. 12 At the George Washington Carver School Building, and said election shall be conducted at said voting box by W. W. Como, Judge. Precinct No. 13 At the Magnolia School Building, and said election shall be conducted at said voting box by E. A. Godwin, Judge. Precinct No. 14 At the Ogden School Building, and said election shall be conducted at said voting box by O. A. Ernest, Judge. Precinct No. 15 At the David Crockett Junior High School Building, and said election shall be conducted at said voting box by H. A. McDonald, Judge. Precinct No. 16 At the Fletcher School Building, and said election shall be conducted at said voting box by Charles H. McDonough, Judge. Precinct No. 17 At the Farm Machinery Co., Inc. , 4530 College Street, and said election shall be conducted at said voting box by Mrs. D. B. Eberhard, Judge. Precinct No. 18 At the Hebert School Building, and said election shall be conducted at said voting box by A. L. Price, Judge. Precinct No. 19 At the Giles School Building, and said election shall be conducted at said voting box by Ray V. Watson, Judge. Precinct No. 20 At the L. R. Pietzsch School Building, and said election shall be conducted at said voting box by Mrs. J. _ C. Burkhart, Judge. Precinct No. 21 At the South Park High School Building, and said election shall be conducted at said voting box by G. W. Glezen, Judge. SECTION 3 That said election shall be held in accordance with the constitution and general laws of the State of Texas, and only qualified, resident electors of said city who own taxable property within said city and who have duly rendered the same for taxation shall be qualified to vote. SECTION 4 The ballots of said election shall conform to the requirements of Chapter 6 of the Election Code of the State of Texas, Chapter 492, Acts of the 52nd '2 --3 0-1.9,0 Legislature of Texas, 1951, and shall have printed thereon the following: OFFICIAL BALLOT FOR THE ISSUANCE OF SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE CONSTRUCTION AND EQUIPMENT OF A PUBLIC COLISEUM, AND THE LEVYING OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF SERIAL BONDS OF THE CITY OF BEAUMONT FOR THE CONSTRUCTION AND EQUIPMENT OF A PUBLIC COLISEUM, AND THE LEVYING OF A TAX IN PAYMENT THEREOF Voting.on said proposition shall be by voting machines, and each voter desiring to vote in favor of the proposition shall pull the voting pointer down indicating "For" such proposition, and each voter desiring to vote against such proposition shall pull the voting pointer down indicating "Against" such proposition. Absentee votes shall also be cast by voting machine at the office of the City Clerk in the City Hall in the City of Beaumont, Texas, and shall be accomplished as above provided. SECTION 5 That a copy of this ordinance, signed by the Mayor of the City of Beaumont and attested by the City Clerk shall serve as proper and sufficient notice of said election, and the Mayor is hereby directed to cause one of each of said notices to be posted at a public place within each of the election precincts in said city, and at the City Hall, such posting to be not less than fifteen (15) full days prior to the date set for said election. And he shall further cause said notice to be published on the same day in each of two (2) successive weeks in a newspaper of general circulation published within said .city, the date of the first publication to be not. less than fourteen (14) full days prior to the date set for said election; and the person posting said notice shall make a return on the copy thereof showing the times and places of posting, and the return shall be filed in the office of the City Clerk and shall be conclusive evidence of the posting of said notice; and the affidavit of the publisher of the newspaper, stating the days on which the same was published, shall be filed in the office of the City Clerk and shall be conclusive evidence of the publication of said notice. SECTION 6 That this ordinance shall take effect from and after the date of its passage. PASSED this 30th day of July, 1957, by a. majority vote of the City Council of the City of Beaumont, Texas.
