AN .ORDINANCE
ENTITLED AN ORDINANCE AUTHORIZING THE VACATING AND
CLOSING OF EVALON STREET FRO14 TENTH STREET WESTWARD
TO.ELEVENTH STREET, THROUGH BLOCKS 57.AND 5.8.OF THE
AVERILL ADDITION.
WHEREAS, a petition-signed,by all of the property owners
of Evalon Street from Tenth:Street,westward to.Eleventh Street,
through Blocks_ 57 and :'S8.of-the-Averill Addition, ha.s been•pre-
sented to the.City Council.of-The City of Beaumont, requesting
that that portion of..Evalon Street.be-:',vacated and abandoned; and, -
WHEREAS, said~ petition has been referred -to °the City
Planning Commission for examination and -approval- and.the same has
been approved by said Commission':and,
WHEREAS;:p,said petition has been duly, *canvassed and exam-
ined,.by the, City Council and has.been found to have been signed
by all of the property owners in said Blocks 57 and 58`:of Evalon
Street -from Tenth Street westward to Eleventh -Street, in the
Averill.Addition, and.it appearing to, the City Council that the
request of -said property,owner.s should be granted and that an,
ordinance should be .enacted vacating and abandoning the above-de-
scribed portion of Evalon Street;
NOW, THEREFORE, BE IT ORDAINED.BY THE CITY OF BEAU-
MONT, TEXAS. -
That that portion of Evalon Street from Tenth Street westward to
Eleventh Street, through.Blocks 57 and.58-of the Averill Addition,
in the City of Beaumont, be, and the same is hereby, authorized
to be vacated and abandoned, and that the title to such vacated'
and abandoned portion of said street should revert to and become
the.property'of the persons entitled thereto, as provided by law.

COMMENT:
There is attached the application for the closing
of Evalon Street from Tenth Street Westward to Eleventh Street
filed by Mr. Paggi, Bertha D. Paggi and H. S. Hamilton. The
Planning Commission, as you will recall, voted to favor the
abandonment of Evalon Street to allow for orderly development
of the area.
I am transmittirg this information to you with the
application for further handling. It was my understanding that
you intended to refer this to the Legal Department for proper
consideration and the drawing of the proper instrument cover.
