HomeMy WebLinkAboutORD 31-OAN ORDINANCE ENTITLED AN ORDINANCE ORDERING A SPECIAL MUNICIPAL ELECTION FOR THE CITY OF BEAUMONT TO BE HELD ON THE 14TH DAY OF AUGUST, 1943, FOR THE PURPOSE OF ELECTING CITY COUNCIDIEN TO FILL THE VACANCIES CREATED IN THE CITY COUNCIL BY THE RE- M!OVAL OF W. C. BALSTON, WOODROW DOIRON, B. R. KIRBY, GEORGE GARY, GORDON KELLY AND W. N. SCAR- BOROUGH ON JUNE 19, 1943, BY SPECIAL RECALL ELEC- TION; PROVIDING FOR THE FILING BY EACH CANDIDATE WITH THE CITY CLERK OF A REQUEST THAT HIS NAME BE PLACED ON THE OFFICIAL BALLOT AND PROVIDING FOR THE FORM OF SAID REQUEST; PROVIDING THE PLACES ,AT WHICH SAID ELE✓TION SHALL BE HELD AND DESIGNATING THE PLACES WHERE THE VOTERS SHALL VOTE; APPOINTING THE OFFICERS FOR SAID ELECTION; PROVIDING THAT SAID ELECTION SHALL BE HELD UNDER THE PROVISIONS OF THE STATE LAWS GOVERNING ELECTIONS; PROVIDING FOR NO- TICE OF SAID ELECTION AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: Section 1. That in accordance with Section 22 of the Charter of the City of Beaumont and other provisions of said Charter and the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on the 14th day of August, A. D. 1943, a special municipal election for the purpose of electing the following officers; A City Councilmani for the City of Beaumont from the First Ward,which shall be designated on the offi- cial ballot as First Ward, Place No. 1, to fill for the unexpired term thereof the vacancy in said City Council created by the removal of W. C. Balston as Councilman from said First Ward by recent recall elec- tion;-. A City Councilman for the City of Beaumont from the First Ward, which shall be'designated on the offi- cial ballot as First Ward, Place No. -2, to fill for the unexpired term thereof the vacancy in said City Council created by the removal of Woodrow Doiron as Councilman from said First Ward by recent recall elec- tion; A City Councilman for the City of Beaumont from the Second Ward, which shall be designated on the of- ficial ballot as Second Ward, to fill for the unex- pired term thereof the vacancy in said City Council created by the removal of B. R. Kirby as Councilman from said Second Ward by recent recall election. i �C 31-6 A City Councilman for the City of Beaumont from the Third Ward, ' which shall be designated on the of- ficial ballot as Third Ward, Place No. 1, to fill for the unexpired term thereof the vacancy in said City Council created by the removal of George Gary as Councilman from the said Third Ward by recent recall election; A City Councilman for the City of Beaumont from the Third Ward, which shall be designated on the of- ficial ballot as Third Ward, Place No. 2, to fill for the unexpired term thereof the vacancy in said City Council created by the removal of Gordon Kelly as Councilman from said Third Ward by recent recall elec- tion; A City Councilman for the City of Beaumont from the Third Ward, which shall be designated on the of- ficial ballot as Third Ward, Place No. 3, to fill for the unexpired term thereof the vacancy in said City Council created by the removal of W. N. Scarborough as Councilman from said Third Ward by recent recall election; all of said vacancies having been created by the removal of said officers from -their respective offices as a result of the special recall election held in the City of Beaumont, Texas, on the 19th day of June, A. D. 1943. Section 2. Each candidate for one of the aforesaid offices shall file on or before the .14th day of July, A. D. 1943, with the City Clerk of the City of Beaumont a request in writing that his name be placed on the official ballot and shall designate therein the office he seeks. The following form shall be furnished such can- didate by the City Clerk and shall be sufficient as said request when properly completed:: Date City Clerk Beaumont, Texas T, _'a duly qualified resident elector of the City of- Beaumont, Texas, resid- ing at , in said City of Beau- mont, Jefferson County, Texas, do hereby request that my name be placed on the official ballot to be used in the special municipal election to be held in the City of Beaumont on the 14th day of August, A. D. 1943, as a candidate for City Councilman of the City of Beaumont from the Ward, (designated on official ballot as Ward, Place No. ) to fill for the unex- pirec-term thereof the vacancy in said City Council created by the removal of as Councilman from said Ward by ther ecall elec- tion held in the City o Beaumont on the 19th day of June, A. That said election shall be held in,the City of Beau- mont in the following places, to -wit: In the First ?lIard' at French School Building, Junker School Building, Averill School Building and Central Fire Station. In the Second Ward at the City Hall. In the Third Ward at the Sabine Pass Fire Sta- tion, David Crockett Junior High School Building, South Park Elementgry School Building and Hebert School Building. That all voters residing in County Voting Precinct No. One in the City shall vote at French School Building; that all voters resid- ing in County Voting Precinct No. Two in the City shall vote at Junker School Building; that all voters residing in County Voting Precinct No. Four in the City and that part of County Voting Pre- cinct No. Forty -Seven lying within the City limits of the City of Beaumont shall vote at Averill School Building; that all voters residing in County Voting Precincts Nos. Three, Six and Seven in the City shall Vote at the Central Fire Station; that all voters residing in County Voting Precincts Nos. Five, Eight and Nine in the City shall vote at the City Hall; that all voters residing in County Voting Precincts Nos. Ten, Thirteen and Fourteen in the City shall vote at Sabine Pass Fire Station; that all voters re- siding in County Voting Precincts Nos. Eleven and Twelve in the City shall vote at David Crockett Junior High School Building; that all voters residing in County Voting Precincts Nos. Fifteen,and Sixteen in the City shall vote at South Park Elementary School Building; and that all voters residing in County Voting Precinct No. 17 in the.City shall vote at Hebert School Building. Section 4. The following named persons are appointed presiding judges for their respective voting boxes in said Wards with the authority to select their own clerks: At the French School Building; Mrs. Lona Pennick; At the Junker School Building, -Mrs. J. E. Ray; At the Averill School Building, Mrs. Vera K. Fox; At the Central Fire Station; W. S. Siler; At the David Crockett Junior High School Building, F. L. Fisher; -3- i_C7ALd31-6 At the City Hall, Ray V. Watson; At the Sabine Pass Fire Station, Mrs. Ben Pipkin; At the South Park Elementary School Building, Mrs. J. C. Burkhart; At the Hebert School Building, A. L. Price. Section 5. That said election shall be held under and the qualifi- cations of those voting thereat shall be controlled by the provisions of the State laws governing elections. Section 6. That a copy of this Ordinance signed by the Mayor of the City of Beaumont and attested by the City Clerk thereof shall serve as a proper and sufficient notice of said election and the Mayor is hereby directed to cause a copy of this Ordinance signed by himself and attested by the City Clerk to be posted at each of the places herein designated for holding said election at least thirty (30) days prior to the time of holding said election in the manner pro- vided by law. Section 7. The fact that an ordinance has not yet been passed pro- viding for and ordering a special municipal election for the pur- pose of filling the aforesaid vacancies and that such an ordinance is necessary creates an imperative public emergency necessitating the suspension of the rule requiring ordinances to be read on three several days before their passage; wherefore, said rule is hereby suspended and this Ordinance shall take effect from and after its passage.
