AN ORDINANCE GRANTING TO THE BEAUMONT WHARF AND TERMINAL COMPANY, ITS SUCCESSORS AND ASSIGNS, THE FRANCHISE RIGHT TO MAINTAIF AND OPERATE A SIDE OR SWITCH TRACK OF STANDARD GUAGE OVER AND ACROSS AUSTIN AND NECHES STREETS TO CONNECT ITS TRACK WITH A SWITCH TRACK ON THE PROPERTY `OF THE COALE LU1VIBT1 COMPANY AND TO OPER- ATE ITS TRAINS AND CARS THEREON FOR TEN (10) YEARS; SAID SIDE OR SWITCH TRACK TO CONNECT WITH THE MAIN TRACK OF THE SOUTH _ -BRANCH OF- THE SA -ID BEA -M, IONT WHARF-AND-TERM-1NAI C TdANY, NEAR WHERE IT INTERSECTS THE NORTH SIDE OF AUSTIT: STREET, AND TO RUN IN AN EASTERLY DIRECTION ALONG AUSTIN STREET TO THE NORTH- WEST.CORNER OF THE COALE LUMBER COMPANY, WHERE IT SHALL ENTER SAID PROPERTY AS SHOWN BY RED LINE ON BLUE PRINT HERETO ATTACH- ED, :MARKED «EXHIBIT A« AND MADE A PART OF THIS ORDINANCE; ALSO PROVIDING_THAT THE RIGHTS AND PRIVILEGES HEREIN GRANTED SHALL BE ACCEPTED IN WRITING BY THE BEAUMONT WHARF AND TERMINAL COMPANY WITHIN THIRTY (30) DAYS AFTER THE PASSAGE AND APPROVAL OF THIS ORDINANCE; ALSO PROVIDING THAT THE BEADIAONT WHARF AND TERMINAL CG19PANY SHALL PAY TO THE CITY OF BEAUMONT ANNUALLY ON OR BEFORE TEE FIRST DAY OF JUNE OF EACH HEAR THE SUM OF FIFTY DOLLARS ( $50.00) AS REASONABLE COMPENSATION FOR. TEHE PRIVILEGE AND FRAN- CHISE HEREIN GRANTED AND PROVIDING FURTHER THAT SAID FRANCHISE SHALL BE SUBJECT TO THE TERMS AND CONDITIONS OF THE SAID CHARTER OF THE CITY OF BEAUMONT AND SHALL EXIST FORA PERIOD OF TEN (10) YEARS FROM AND AFTER THE DAY OF JAIv-UARY, 1943. BE IT ORDAINED BY THE CITY COY -MISSION OF THE CITY OF BEAUMONT: Section 1. That the Beaumont Wharf and Terminal Company, its and their successors and assigns, are hereby granted the right and franchise to maintain and operate at their own expense over and along Austin and Neches Streets in the City of Beaumont a side or switch track of standard guage, said side .or switch track to spring out .of the main track of the Beaumont Wharf and Terminal Company near where it intersects the north line of Austin Street and torun in an easterly direction to the -northwest corner of the Coale Lumber Com- pany' s property-,-wh.er-e-it--shall enter-,sa°id--property-as°--shoWn­by red----.---- line ed--- -- line on blue print hereto attached, marked Exhibit "A" and made a -Harr of thie nnrli-no nna unloading and switching facilities to commercial and industrial enterprises now located or hereafter to be located in the vacin- ity of said track. Section 3. No cars of any kind shall be allowed to stand on the por- tion of said switch track which is in thepublic streets of the_ City of Beaumont. Section 4. The grantee hereunder shall keep up and maintain a crossing over said track satisfactory to the City Engineer of the City of Beaumont, and upon the failure of -said grantee at any time to keep said crossing and said switch track in a condition satisfac- tory to the City Engineer, the City of Bea unOnt shall have the right to remove said track from its streets and collect the costs thereof from the grantee herein. Section 5. The foregoing rights and privileges are granted upon the express condition that said grantee, its successors and assigns, shall, within thirty (30) days after•the final passage of this ordinance, file with the City Clerk its written acceptance of this ordinance. Section 6. This ordinance is pas\sed subject to the Charter and ordin- ances`of the City of Beaumont and all future charters and .ordin- ances that may be passed thereunder. This ordinance shall go into effect from and after its passage, filing of the acceptance, and shall continue for a period of Ten Years (10), unless annulled sooner as provided in said ordinance. The BEAUMONT j19 -LW AND TER UNAL CCUPANY hereby signifies and files in writing its acceptance of an ordinance passed by your honorable body on the 9th day of February, 1943,. and enrolled in the Minutes of Ordinances of the City of Beaumont in Volume 7, page 1534, granting said Company, its successors mid assigns, the franchise right to maintain and operate a side or switch track of;'standard gauge over and across Austin and Neches Streets to connect its track with a switch track on the property of the Coale Lumber Company and to operate its trains and cars thereon for ten years; said side or switch track to connect with the main track of the South branch of the said BEAUMONT UEARF AND TERI.ZINAL COLTANY, near where it intersects the North side of Austin Street, -and to run in an easterly direction along Austin Street to the Northwest corner of the Coale Lumber Company, where it shall enter said property as shown by red line on blue print attached to said ordinance and made a part thereof; and said BEAUMONT WARF AND TERMINAL COMPANY acknowledges itself bound by the terms, conditions and provisions of said ordinance.
