That the Gulf, Beaumont & Kansas City Railway Company is hereby granted the right and franchise to maintain and operate at their own expense over and across Railroad Avenue in the City of Beaumont, a side or switch track of standard guage and to operate its trains and cars thereon for a period of Ten Years (10)., Said side or switch track is a continuation of a track now existing in the rear of block Twenty-two (22) of the Van Wormer Addition and which is fourteen (14) feet from the main line of the Gulf, Beaumont & Kansas City Railway Company to the Crockett Street depot, and which runs in a westerly direction across.Railroad Avenue, where it enters the north portion of block fifty-five (55) of the Van Wormer Addition, as shown by red line on blue print hereto attached, marked Ex- AN ORDINANCE GRANTING TO THE GULF, BEAUMONT & KANSAS CITY RAILWAY COI'fiPANY, ITS SUCCESSORS AND ASSIGNS, THE FRANCHISE RIGHT TO MAINTAIN AND OPERATE A SIDE OR SWITCH TRACK OF STANDARD GUAGE OVER AND ACROSS RAILROAD AVENUE AND TO OPERATE ITS TRAINS AND CARS THEREON FOR TEN (10) YEARS; SAID SIDE OR SWITCH TRACT TO LEAVE THE 1rVEST LME OF BLOCK 22 OF VAN WORMER ADDITION, WHICH IS ALSO THE EAST LINE OF RAILROAD AVENUE, AND TO RUN IN _A VITSTERLY DIRECTION ACROSS RAILROAD AVENUE TO THE WEST LINE OF RAILROAD AVENUE RHERE IT ENTERS THE NORTHEAST PORTION OF BLOCK FIFTY-FIVE, (55) OF VAN WOR- MER ADDITION, AS SHOWN BY RED LINE ON BLUE PRINT HERETO ATTACHED, MARKED EXHIBIT "Arr AND MIADE A PART OF THIS ORDIN- ANCE; PROVIDING FURTHER THAT SAID GULF, BEATMONT & KANSAS CITY RAIIWIAY COMPANY, OR ITS SUCCESSORS AND ASSIGNS, SHALL PAY TO THE CITY OF BEAUt':+IONT ANNUALLY ON THE FIRST DAY OF JUNE OF EACH YEAR THE SUM OF FIFTY DOLLARS (50.00) AS REASONABLE C011,,1PENSATION FOR THE PRIVILEGE AND FRANCHISE THEREBY GRANTED; AND PROVIDING FURTHER THAT SAID FRANCHISE SHALL BE SUBJECT TO THE TERMS AND CONDITIONS OF THE CITY CHARTER OF THE CITY OF BEAU�i i ON T. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAU ONT: Section 1. Section 3. No cars of any kind shall be allowed to stand on the por- tion of said switch track which is in the public streets of the City of Beaumont. Section 4. The grantee hereunder shall keep up and maintain a cross - ing over said track satisfactory to the City Engineer of the City of Beaumont, and upon the failure of said grantee at any time to keep said crossing and said switch track in a condition satisfactory to the City Engineer, the City of Beaumont shall have the right to remove said track from its streets and to col- lect the costs thereof from the grantee herein. Section 5. This ordinance is passed subject to the Charter and ordin- ances of the City of Beaumont, and all future charters and or- dinances that may be passed thereunder. Section.6. The foregoing rights and privileges are granted'upon the express condition that said grantee -,.its successors and assigns, CD shall, within thirty (30) days after the final passage of this ordinance, file with the City Secretary its written acceptance of this ordinance. Section 7. f I e Section 8. This ordinance shall go into effect from and after its passage, filing of the acceptance and shall continue for a period of Ten Years (10), -unless annulled sooner as provided in said ordinance. The GULF, BEAUMONT & KANSAS CITY RAU;QVAY CO1h?ANY hereby signifies and files in writing its acceptance of an ordinance passed by your honorable body on the 9th day of February, 1943, and enrolled in the Minutes of Ordinances of the City of Beaumont in Volume 79 page 1532, granting said Company, its successors and assigns, the franchise right to maintain and operate a side or switch track of standard gauge over and across Railroad Avenue and to operate its trains and cars thereon for ten years, said side or switch track to leave the rest line of Block 22 of Van Wormer Addition, which is also the East line of Railroad Avenue, and to run in a westerly di- rection across Railroad Avenue to the Meat line of Railroad Avenue where it enters the Northeast portion of Block 55 of Van Wormer Addition, as shown by red line on blue print attached to said ordinance and made a part thereof; and said GULF, BEAUMONT & KANSAS CITY RAILWAY COMPANY acknowledges itself bound by the terms, conditions and provisions of said ordinance.
