Texas and New Orleans Railroad Company and its successors and assi&ns, are hereby Eranted the right and franchise to construct, maintain and operate at their oven expense a standard gauge railroad track in, upon and across South j Street in the City of Beaumont, at a point beginning on he south line of South Street, approximately fifty feet (50' ) easterly, from center line of a now existin` spur trach( serving Beaumont Rice ;:ills and International Derrick and :equipment Company; thence Northerly, upon and across South Street, to a point on north line of South Street, .which is approxiiiiately thirty-three feet (331) easterly, from the center line of said existin6, track, as more "accurately shown by the blue print hereto attached marked "Exhibit A." and made a part of this ordinance, the line of said railway being indicated by the red lines drawn on said blue print. Section 2. The track to be constructed on said right of !,ljay which is to be maintained and operated under- the terms and conditions of this ordinance shall be used only as an industrial track, that is, for the purpose of affording; loading, unloading, and switohing facilities to commercial and industrial enterprises now located or hereafter to be located in the vicinity of said track. Section 3. The foregoing rights and privileges are granted upon the expressed condition that the said grantee shall, within thirty (30) days after the passage and approval of this ordi- nance; file with the City Clerk of the City of Beaumont their written acceptance of this ordinance. Section 4. This ordinance and the rights and privileges therein grant- ed are subject to all of the -terms and provisions of the Charter of the City of Beaumont, and said privileges and franchise hereby granted shall continue in'fbrce for a period of ten (10) years from and after October 1st, 1942. Section 5. As reasonable compensation for the rights and privileges granted by this ordinance, grantee agrees and obligates it- self and its successors and assigns, -to pay to the City of Beaumont on or before the first day of July of each year after the taking effect of this ordinance, the sum of Fifty and No/100 ($50.00) Dollars. Your Petitioner, the Texas and New Orleans Railroad Company, respectfully requests the right, privilege and franchise to construct, maintain and operate an industrial railroad spur track, in, upon and across ,South Street; as shorn by red line on map hereto attached. Said track being more particularly described as follows: Beginning at a point on the south line of South Street, approximately fift;� feet (50') easterly, from center line of a now existing spur track serving Beaumont mice -ov ills and International Derrick and :,�cluipment Company; Thence 1,ortherly, upon and across South utreet, to a point on north line of South Street, Trihicr is ap-proximately thirty-three feet (331) easterly, from the center line of said existing track. Should this petition be granted, it is requested that an Ordinance be passed and approved, granting to your -Petitioner, the right and privilege above -stated, and after said track has been con- structed, the right, privilege and franchise of operating engines, trains and cars thereover.
