ENTITLED AN ORDINANCE AUTHORIZING EMERGENCY -
SUSPENSION OF CERTAIN RESTRICTIONS IMPOSED BY AN
ORDINANCE ADOPTED BY THE CITY COMMISSION OF THE
CITY OF BEAUY1ONT, - TEXAS ON JUNE 17, 1936, KNOVM
AS THE "1936 PORT ORDINANCE" INSOFAR AS SAID
PORT ORDINANCE APPLIES TO THE PORT PROPERTY LEASED
BY THE CITY OF BEAUMONT TO PENNSYLVANIA SHIPYARDS,
INC., BY LEASE AGREEIJENT DATED JULY 29, 1942, SAID
PROPERTY COMPRISING WAREHOUSES NOS: FIVE (5), FIVE
AND ONE -..HALF (52) , SIX ( 6) , SIX AND ONE-HALF ( 62) ,
AND SEVEN (7) AND PROPERTY ADJACENT THERETO DESCRIB-
ED IN SAID LEASE CONTRACT DURING THE PERIOD COVERED
BY SAID LEASE CONTRACT, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BEAUMONT:
Section 1.
Under date of July'29, 1942, the City of Beaumont, Texas,
entered into a lease agreement with Pennsylvania Shipyards, Inc.,
whereby the City leased to Pennsylvania.Shipyards, Inc., for a
primary term of One year commencing August 1, 1942, a total of
124,920 square feet of warehouse space comprising warehouses
Nos. 5, 52, 6, 62 and 7, together with the pier on the river
side of the buildings and the-railroa -said pier and
two of the depressed tracks immediately at the rear of said ware-
houses being the first and.second tracks nearest the warehouses,
together with the right of ingress and egress thereto; the lessee
was given the right at its option at the expiration of the one
year period to renew and extend the lease for a period not to ex-
ceed three years.
Section 2.
The premises described were leased to Pennsylvania Ship-
yards, Inc., to assist it during the national emergency in carry-
ing out its contracts with the United States Government for the
construction of ships to be used in the war effort, and the lease
provided that the nature of the work to be engaged in will nec-
essarily require the waiver of certain restrictions now in effect

on such property through the terms of the present ordinances
of the City of Beaumont regulating said Port property and in
particular
the Port
ordinance adopted by the
City
Commission
on June 17,
1936.
And the Port Commission of
the
City of
Beaumont and Pennsylvania Shipyards, Inc., have requested
than certain restrictions of said Port ordinance be suspend-
ed as regards the property covered by said lease agreement
for the term of the lease.
Section 3.
Therefore, for such period of time as the lease between
the City of Beaumont, Texas and Pennsylvania Shipyards, Inc.,
continues and not thereafter, the following portions. of the
Port Ordinance,adopted June 17, 1936, be waived as they apply
to the -warehouses and property described herein and as covered
by said lease agreement dated July 29, 1942:

Section'll, subdivision J,
Section 11, subdivision K-15
Section 11, subdivision K-2,

Section 11, subdivision L,
Section 11, subdivision N.
Section 4.
This ordinance shall not repeal any of the Port ordinances
of the City of Beaumont and shall not amend any of said ordin-
&noes now in effect except as to the particulars herein noted
and as to the property herein described.

Section 5.
The fact that a national emergency does now exist and
that the shipbuilding industry is an important part of the
national war program, and that under the terms of our exist-
ing ordinances Pennsylvania Shipyards, Inc., are restricted
in the use of the property leased by them from the City of
Beaumont for shipbuilding purposes, creates an imperative
public -emergency necessitating the suspension of the rule re-
quiring ordinances to be read on three several days before
their final passage. Wherefore, said rule is hereby suspend-
ed and this ordinance shall become effective from and after
its passage and lawful publication.
