HomeMy WebLinkAboutORD 56-NAN ORDINANCE ENTITLED AN ORDINANCE ORDERING THE GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 7TH DAY OF APRIL, 1942, AS PROVIDED BY THE CITY CHARTER OF THE CITY OF BEAUMONT, FOR THE PURPOSE OF ELECTING A MAYOR AND NINE COUNCILMEN, AND FOR THE PURPOSE OF SUB- MITTING TO THE QUALIFIED VOTERS A PROPOSED AMEND- MENT TO THE EXISTING CITY CHARTER; DESIGNATING THE TIME AND PLACE OF HOLDING SAID ELECTION, AND APPOINTING JUDGES TO PRESIDE OVER SAID ELECTION; PROVIDING'THE MANNER OF HOLDING THE SAID ELECTION AND THE GIVING OF NOTICE THEREOF, AND DECLARING AN EMERGENCY. WHEREAS, under the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating thereto, a regular general municipal election is required to be held in the City of Beaumont on the first Tuesday in April, 1942, same being the 7th day of April,A. D. 1942, for the pur- pose of electing a Mayor; three (3) Councilmen for the. First Ward; three -(3) Councilmen for the Second Ward, and three (3) Councilmen for the Third Ward; and WHEREAS, on the 3rd day of February, 1942, a petition was filed with the .City Commission of the City of Beaumont, praying and requesting that the City Commission submit to the qualified voters of the City the proposed amendment to the existing Char- ter of the City of Beaumont, hereinafter set out; and WHEREAS, the said petition so presented to the City Com- mission was duly examined, checked and canvassed for the pur- pose of ascertaining whether the said petition was in proper order and whether or not the same contained the required num- ber of signatures, and after.a full and complete investigation and examination of said petition the Commission doth find that the said petition bears the signatures of at least ten per cent (10%) of the qualified voters of said City; and WHEREAS, the City Commission has found, as hereinbefore stated, that the said petition was in due and proper form, and had been signed by the required number of qualified voters to compel the submission of .the proposed amendment to the vote of the people, nevertheless the City Commission, in enacting this ordinance and in submitting the proposed amendment, is acting of its own desire and will in the premises, as well as on the petition of the said qualified voters, and should the sufficiency of said petition ever be called in question, the will of the peo- ple as expressed in said election will not be thwarted, nullif- ied or rendered void because of insufficiencies or irregularit- ies, if any, in said petition., -and to this end the City Commis- sion goes on record herein as acting on its own motion, as well as on the said petition, in enacting this ordinance; and WHEREAS, the Commission finds that the City Charter has not been altered or amended within the past two years, and that the City Commission has caused notice of its intention to enact this ordinance submitting the proposed charter amendment to the quali- fied voters to be published for more than twenty days, said pub- lication having been made for a period of ten days in the Beau- mont Journal, the first publication appearing more than twenty days before the enactment of this ordinance; and WHEREAS, after due consideration, the Commission has determined, and hereby finds, that this is an emergency measure, necessary for the immediate preservation of the public peace, property, health, and safety of the City of Beaumont, and should be passed finally on the date of its introduction, and that it should be effective immediately upon and after its pass- age. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUM0NT: Section 1. That in accordance with the provisions of the City Char- ter of the City of Beaumont and the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on the first Tuesday in April, 1942, the same being the 7th day of April, A. D. 1942, a regular municipal election for said City for the purpose of electing a Mayor; three (3) Councilmen from the First Ward; three (3) Councilmen from the Second ward; three (3) Councilmen from the Third Ward, and also for the pur- pose of submitting to the qualified voters of the City of Beau- mont an amendment to the existing City Charter of the City of Beaumont, as set out in Section 5 hereof. Section 2. That said election shall be held in the City of Beaumont at the following places, to -wit: First Ward: Junker School Building Central Fire Station Averill School Building Second Ward: Beaumont High School Building City Hall Third Ward: Sabine Pass Fire Station David Crockett Junior High School Building South Park Elementary School Building All voters residing in County voting precincts Numbers 1 and 2 in the City shall vote at Junker School Building; that all voters residing in County Voting precinct Number 4 in the City and that part of County voting precinct Number 47 lying within the City limits of the City of Beaumont shall vote at Averill School Building; that all voters residing in County voting precincts Numbers 3,6 and 7 in the City shall vote at Central Fire Station; that all voters residing in County vot- ing precinct Number 5 in the City shall vote at Beaumont High School Building; that all voters residing in County voting precincts Numbers 8 and 9 in the City shall vote at the City Hall; That all voters residing in County voting precincts Num- bers 10, 13 and 14 in the City shall vote at Sabine Pass Fire Station; that all voters residing in County voting precincts Numbers 11 and 12 in the City shall vote at David Crockett Junior High School Building; and that all voters residing in voting precincts Numbers 15, 16 and 17 in the City shall vote at South Park Elementary School Building. Section 3. The following persons are hereby appointed judges of their respective voting boxes, with authority to select and appoint their own clerks: At Junker School Building: Mrs. J. E. Ray At Central Fire Station: At Averill School Building: At Beaumont High School Building: At City Hall: At Sabine Pass Fire Station: At David Crockett Junior High School Building: At South Park Elementary School Building: Section 4. W. S. Siler Walter..:Seibert L. E. Ezell Ray Watson Mrs. Ben Pipkin E. J. Loew W. T. Wherry .That said election shall be held under, and the qualifi- cations of those voting thereat shall be controlled by, the provisions of the State laws governing elections. Section 5. The question as to whether or not the first sentence of Subsection 1 of Section 55 of the existing City Charter shall be amended to read as follows: "The Mayor shall receive a salary of $300.00 per month" will be submitted to the voters in one proposition, and there shall be printed on the ballot used in said election the pro- posed amendment above quoted, and following the above quoted amendment there shall be printed on the ballot the words "Yes" and "NO", all of which shall appear on the ballot in the fol- lowing form: "Shall the first sentence of Subsection 1 of Section 55 of the existing City Charter of the City of.Beaumont be amended to read as follows: IThe Mayor shall receive a salary of $300,00 per month.t Yes No. if All voters desiring to vote for the proposed amendment to the existing Charter shall run a line through or across the word "No" appearing on the ballot following the proposed amendment, and -all voters desiring to vote against the proposed charter a- mendment shall ran a line through or across the word "Yes" appear- ing on the ballot following the proposed amendment. .. _ Section 6. A copy of this ordinance containing the text of the pro- posed amendment, signed by the Mayor of the City of Beaumont and attested by the City Clerk thereof, shall serve as a pro- per and sufficient notice of said election, and the Mayor is hereby directed to cause one each of said notices to be posted at each of the places designated for holding said election, at least thirty (30) days prior to the holding of said election, and the person posting said notices shall make a return on a copy thereof showing the time and place of said posting, which return shall be filed in the office of the City Clerk and shall be conclusive evidence of the posting of said notices, and a copy of this ordinance shall be published once a week for a per- iod of thirty (30) days before the day of holding the election, in a newspaper of general circulation which has been continuous- ly and re larly published in the City of Beaumont for a period of one ( l year prior to this date, and the City Clerk is here- by directed.to mail a copy of the proposed amendment to each qualified voter in the City of Beaumont as appears from the Tax Collector's roll for the year ending January 31, 1942. Section 7. That an ordinance has not yet been passed providing for and ordering a general municipal election for the year 1942, and that such ordinance is necessary; and further, that the submission of the proposed charter amendment is, under the law, required to be submitted to the voters at the regular munici- pal election which, under the charter, is required to be held on the first Tuesday.in April, 1942, and, by reason of the a- bove facts, there is created an emergency and imperative public necessity requiring that the rule that ordinances shall be read on three several days before their passage be suspended, and the said rule is accordingly hereby suspended, and this ordinance shall take effect immediately from and after its passage. Mayor of the City of Bea tr._ ATTEST: City Cl . _% THE STATE OF TEXAS j COUNTY OF JEFFERSON TO THE HONORABLE MAYOR, CITY COMMISSION, AND CITY CLERK OF THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS: We, the undersigned Chairman and Secretary of the City Democratic Executive Committee of the Democratic Party for the City of Beaumont, Jefferson County, Texas, do hereby certify that at the Primary Election duly called and held, as provided by law, on the 24th day of February, A.D. 1942, with four voting boxes in the First Ward, two voting boxes in the Second Ward, and three voting boxes in the Third Ward, for the purpose of selecting the Nominees of the Democratic Party in said City to fill the following offices, to -wit: (a) Mayor, (b) Three Councilmen for the First Ward, (c) Three Councilmen for the Second Ward, (d) Three Councilmen for the Third Ward, as provided by the Charter of the City of Beaumont, the following persons were duly selected as shown by the "RETURNS OF THE PRIMARY ELECTION" for the said positions named above and.were duly and legally declared the Nominees of the Democratic Party of the said City of Beaumont by the Executive Committee "ACCORDING TO THE RETURNS" made by the presiding judges of the said Primary Election and are entitled to have their names duly printed on the "OFFICIAL BALLOT" in and for the General Election to be held in the City of Beaumont on the 7th day of April, A.D. 1942, as the Nominees of the said Democratic Party for the said Offices, to -wit: For Mayor . . . . . . . .
