WAREHOUSES LOCATED ON PORT PROPERTY OF THE CITY OF BEAUMONT TO THE EAST TEXAS COMPRESS & WAREHOUSE CO., A CORPORATION, AND AUTHORIZING A FIVE-YEAR LEASE ON THE LAND WHERE SAID WAREHOUSES ARE LOCATED, TO SAID COM- PANY FOR A PERIOD OF FIVE YEARS, WITH AN OPTION TO RENEW SAID LEASE FOR AN ADDITIONAL FIVE YEARS. WHEREAS, the City of Beaumont is the owner of a certain tract of land in Jefferson County, Texas, devoted to port purposes, said tract being described as follows, to - wit • Beginning at a monument in the center line of Carroll and Buford Streets; thence south 89 degrees 41 minutes east along the.center line of Buford Street twenty-nine and six -tenths (29-6) feet; thence south 0 degrees 19 minutes west parallel with and twenty-nine and six -tenths (29.6) feet distant from the center line of Carroll Street twenty (20) feet to the beginning corner of this description; thence continuing south 0 degrees 19 minutes west thirteen hundred fifty- nine and three -tenths (1359.3) feet to corner; thence south 89 degrees 45 minutes east eight hundred thirty-five and eight -tenths (835.8) feet to corner; thence north 0 degrees 22 minutes east twelve hundred eighty-six and three -tenths (1286.3) feet to corner; thence north 42 degrees 31 min- utes west ninety-eight and six -tenths (98.6) feet to corner, said corner being twenty (20) feet south of the center line of Buford Street produced; thence north 89 degrees 41 minutes west parallel with and twenty (20) feet distant from the said center line of Buford Street produced seven hundred sixty-nine and nine -tenths (769.9) feet to place of beginning. J�z� AND WHEREAS, sid land and the twenty-eight cotton warehouses located thereon is now under lease to the East Texas Compress & Warehouse Co., a Texas corporation, on a rental basis depending upon how many bales of Cotton are stored in said warehouses; and, WHEREAS, the said East Texas Compress & Warehouse Co. is desirous of purchasing said warehouses for the sum of Twenty -Seven Thousand, Seven Hundred Twenty (27,720.00) Dollars cash, said transaction and purchase not to include the land on which said warehouses are located; and, WHEREAS, in addition thereto the said East Texas Compress & Warehouse Co. is also desirous of obtaining a lease on the above described land for a term of five (5) years, effective October lst, 1940, at a monthly rental basis of One Hundred Fifty (150.00) Dollars per month, with an option to extend said lease for an additional five-year period; and, t WHEREAS, the City Commission has considered the proposition and is of the opinion that it would be bene- ficial to the City to sell said warehouses and lease said property as above indicated, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT : That the Mayor be, and he hereby is authorized to execute a conveyance in behalf of the City of Beaumont cover- ing the twenty-eight (28) warehouses located on the above de- scribed land to the East Texas Compress & Warehouse Co. for and in consideration of the sum of Twenty -Seven Thousand, Seven Hundred Twenty ($27,720.00) Dollars in cash, said convey- ance not to include the title to the land upon which said ware- houses are located, said instrument of conveyance to contain no warranty of title nor warranty of the Cityf s right to con- vey said warehouses. IT IS FURTHER ORDAINED hereby that the Mayor be, and he hereby is authorized to execute a lease in behalf of the City of Beaumont on the property described in the pream- ble hereto to the East Texas Compress & Warehouse Co. for a term of five (5) years beginning October 1st, 1940, at a monthly rental basis of One Hundred Fifty ($150.00) Dollars, payable cash in advance, with an option to renew said lease for an additional five (5) years upon the expiration thereof, said lease to be conditioned upon the sale of the warehouses heretofore described, and the cancellation of the old lease under which the East Texas Compress & Warehouse Co. is now occupying said property.
