HomeMy WebLinkAboutORD 6-N')-6_7- 01�1�2 AN ORDINANCE WHEREBY THE CITY OF BEAUMONT, TEXAS, GRANTS THE SOUTHWESTERN BELL TELEPHONE COMPANY, A CORPORATION, ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO BUILD OVER THE 10 FOOT DEDICATED STRIP OF LAND EXTENDING THROUGH BLOCK 17 OF THE CITY OF BEAUMONT AND TO JOIN THE SECOND STORIES OF THE BUILDINGS NOW ON OR HEREAFTER ERECTED ON THE PROPERTY THAT THE TELEPHONE COMPANY OWNS ON EACH SIDE OF THE DEDICATED STRIP AND ALSO GRANTING THE RIGHT TO PLACE AND MAINTAIN CONDUITS, WIRES; CABLES, PIPES'AND EQUIPMENT UNDER SAID STRIP, AND ALSO OVER SAID STRIP BETWEEN THE SECOND FLOORS OF ITS BUILDINGS NOW ON OR HEREAFTER ERECTED. WHEREAS, by an instrument, dated January 16, 19023 recorded in Volume 55, page 558, Deed Records of Jefferson County, Texas, Mark Wiess and wife, Louanza Wiess, appropriated and dedicated a strip of land 10 x 300 feet through Block 17 in the City of Beaumont, Texas, according to the plat or map thereof; and WHEREAS, the dedicated strip extends through said block from Pearl to Main Streets and by extracts of minutes of the City Council of Beaumont, Texas, recorded in Volume 208, page 256, Deed Records of Jefferson County, Texas, the City of Beaumont granted to S. G. Burnett the right to build over the said dedicated strip to connect the building on the 10 foot lot adjoining the dedicated strip on the South and fronting 10 feet on Main Street and the building on the lot also fronting on Main Street and adjoining the dedicated strip on the North; and WHEREAS, since said time the second stories of said building have been joined and have been built over the dedicated strip for approximately twenty years; and WHEREAS, the Southwestern Bell Telephone Company has purchased the buildings and property on each side of the strip aforesaid and as joined over said strip, as more par- ticularly shown by the deed from the Texas National Bank of Beaumont to Southwestern Bell Telephone Company, dated June 1, 1937, filed for record in the Deed Records of Jefferson County, Texas, on June 4, 1937, to 10 x 60 feet fronting 10 feet on Main Street adjoining the dedicated strip on the South and also as shown by the deed from Commercial Corporation of Houston to Southwestern Bell Telephone Company, dated June 21, 1937: filed June 21, 1937, in the Deed Records, of Jefferson County, Texas, to 75 x 150 feet, fronting 75 feet on Main Street adjoining the dedicated strip on the North; and WHEREAS) it Bell Telephone Company i City of Beaumont and the building on the 75 x 150 make other improvements building now on Lot 109 is deemed necessary by the Southwestern n furnishing telephone service to the citizens thereof to erect a new foot tract above mentioned and to and to connect the building with the In Block 17 owned by it; and a AN ORDINANCE WHEREBY THE CITY OF BEAUMONT, TEXAS, GRANTS THE SOUTHWESTERN BELL TELEPHONE COMPANY, A CORPORATION, ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO BUILD OVER THE 10 FOOT DEDICATED STRIP OF LAND EXTENDING THROUGH BLOCK 17 OF THE CITY OF BEAUMONT AND TO JOIN THE SECOND STORIES OF THE BUILDINGS NOW ON OR HEREAFTER ERECTED ON THE PROPERTY THAT THE TELEPHONE COMPANY OWNS ON EACH SIDE OF THE DEDICATED STRIP AND ALSO GRANTING THE RIGHT TO PLACE AND MAINTAIN CONDUITS, WIRES; CABLES, PIPES'AND EQUIPMENT UNDER SAID STRIP, AND ALSO OVER SAID STRIP BETWEEN THE SECOND FLOORS OF ITS BUILDINGS NOW ON OR HEREAFTER ERECTED. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT, TEXAS: That the Southwestern Bell Telephone Company, its successors and assigns, are hereby authorized and granted the right to build over the dedicated 10 foot strip of land above mentioned by joining and connecting the second stories of the buildings now on or hereafter erected on the 75 x 150 foot tract above mentioned and on the 10 x 60 foot tract above men- tioned and on Lot 109 in Block 17, which the Telephone Company also owns; that there shall be a clearance over said dedicated strip of 11 feet above the surface thereof and the connection between the second floors of said buildings and the building over said strip shall be permitted for not more than a distance of 60 feet from Main Street; there is granted the right to place and extend over said dedicated strip and between the second stories of said buildings all wires, cables, conduits, pipes and other apparatus deemed necessary in the operation of the telephone business and the operation and maintenance of the buildings and the telephone equipment therein and there is further granted the right and authority to locate, maintain and operate all necessary conduits, cables, wires, steam and water pipes and other equipment under said dedicated -strip as may be necessary between the buildings on each side thereof and owned by the Southwester Bell Tele hone Company.
