EntitliWan ordinance providing.for a Department of, Garbage, creating the office of superintendent of the Garbage Department, providing rules and regulations governing said de partment., fees to be-charged'in said department_ and prescribing penalties for the violation of certain sections thereof and repealing chapters :III and XV -of the Revised Code of Ordinan- ces as codified by McDowell and Davidson and adopted by the City Council February 7, 1911.: Be it ordained by the City Council of the City of - Beaumont: Section 1: There is hereby created a department of the City of Beaumont to be known'As the Garbage Department of said City. Section 2. There is also hereby created the of- fice of Superintendent of said Garbage -Department, who shall be the head officer of -said department and which.office shall be filled by.appointment.of the mayor, which appointment shall be confirmed by the City Council and any .person so appointed to said office shall hold same until removed.or discharged by the City Couneil'of the City of Beaumont for any cause what- soever. Section 3.' The Superintendent of the Garbage Department of the City of Beaumont shall before entering.upon the duties of -said office execute and file with the City Coun- cil a bond with two or more good and.sufficient sureties or --some--'surety -company, =said- boncl- to 'be approved -by the -City-- - - - Council, in the sum of one thousand ($1,000.00) dollars condi-- tioned for the faithful discharge of all- the' duties of the of- fice and the payment promptly of all sums of money -that may come into his hands belo,nging.to the City of Beaumont. Section 4. The Superintendent of the Garbage Department shall be paid the sum of five ($5.00) dollars per year,.and all fees collected by him as pro*i&ed in this ordi- nance. Section- 5.. All employees of the Garbage Depart- ment shall be employed by the Superintehdent-of the -Garbage Department. Section Ci. The Superintendent of the Garbage Department shall keep.and maintain an office in the City Ball. Section 7...: The Superintendent of the Garbage Department shall at his own expense purchase all -teams,, -wagons and other material necessary to fulfill the office of Superin- tendent of the Garbage Department'as required by -this Ordinance and keep and maintain same in first class condition.and repair, at all times. Section 8. The Superintendent of,the Garbage Department shall keep a daily record showing all worRE e f by his department, amount of monies collected by i n amount of its expenses_.and shall at the end.of, each month make a report to the City :Council of. same. Section 9.- It shall be the duty of the Garbage Department to remove and carry away -for the inhabitants of the City of Beaumont all trash, slops and night soil,'as per schedule of fees -hereafter setforth: Section 104 The .word "Slops" as used herein shall. be to -ken to -mean all.refuse -matter.-and articles whether tegetable or animal thrown out of or 'refected. -from the -kitchen or house of the' -inhabitants of this City.- -.,The word " Trash" as -used herein_ shall be taken to mean.all sweepings, waste paper, -hay, straw., tin cans, boots-, shoes,' -tin -or sheet iron, pieces of leather.- pieces eather;pieces of old clothing., -.sacks and rubbish of any kins_: Section 11. That all slops shall be'removed from hotels, regular boarding houses and restuarants,,at least once in every forty. -eight -hours., ani from -other- premis,es..as often as may be necessary to -insure the. -.cleanliness and-.proper.sani- tary condition_s.of the -premises. All trash.-shal-1 be removed from business houses . in,, the business portions of: -the City at least once in every tWen-ty-Cour .hours, and from all other prem- ises as often as maybe necessary to insure the cleanliness and the sanitary condition of the'.premises. Section 12. .All slops and trash shall be-depo.sited in suitable vessels of .iron or. -wood -and kept in a.'.convenient ' place,..easy of access,.upon the premises;:but slops and trash shall be kept in separate receptacles, 'provided -that -nothing herein -shall be deemed to , repeal -'or -change- in any -manner any ordinance of this City requiring the -keeping and maintaining - of galvanized iron -or tin trash cans in certain'portions.of this City, and that -all of said articles or ordinances shall be and remain in full -force and effect. Section 13. It shall be -unlawful for anyone -except the employees -of the. Garbage Department of the City of Beaumont or the owner of slops and trash to remove same from any premises in the'City of Beaumont and noone shall remove night soil from any premises in the City except employees of the. Garbage Depart- ment.. Any person violating the provisions of this section shall conviction- in the Corporation Court- be_ fined-, in -any-sum -not less than five ($5-.00) dollars 'nor more . than. two -hundred--("$Z60:0d Section 14. The fees for- the removal of trash by the,Garbage Department shall be as follows; to -wit: For the first barrel; 15� --For an additional barrel or any -part _ thereof 10¢_ Provided that where there is less than 1/2-;a barrel in addition to a -full barrel -the charge shall only be 5 for said part.of.barrel. Provided that -any person, firm or corporation may enter, into a contract -with the Superintendent.of the Garbage Department for the. removal..of-slops and trash or either from the premises owned or occupied by them at stated times -and on -such -terms - n.such terms- as the parties may agree upon, provided -that said contract shall not provide for fees greater than:as stipulated above. Section 15. The fees for the. removal of slops -by the Garbage Department- shall be -at thrate -of-, cents -(W) per barrel. Section 16. Wherever the term.barrel-is'used:in this ordinance --.it means a barr&l-of thirty-two (32) gallon capacity. Section -1'7., A11 lees to be payable in advance. Section 18. It -shall also be the duty of the -Superin- tendent of the Garbage Department.to_carefully inspect,all premises in the City and call -attention of -all occupants., tenants.or owners as to the condition of same when.in his judgement said premises need --cleaning and -for this purpose the said Superintendent is here- -by given free access,to all -premises within --the corporate limits of -the city, while in discharge -of his -duty during the daytime and should any occupant, tenant or owner of premises, within'. the -cor=- porate_ limits. refuse to permit the same -he shall ,be .deemed guilty of a misdemeanor and fined as provided in Section 21, Section 19. It shall be the duty of the Superinten- dent of the Garbage Department to remove free of cost all trash slops etc on any day or days designated by the mayor or City Council and Lnown as clean-up days. It shall also be the duty of the Superintendent of the Garbage Department to perform any act required'by him under this ordinance free of cost to any party in the City when requested to do so by the mayor of the city or the City Council. Section 20: The fees for the removal of night soil shall be as follows: For each private residence the sum of forty cents for each cleaning, the same to be cleansed .at least once each ;i:onth. For each hotel or boarcl.ing house the sum of One Lollar for each cleaning, the same to be cleansed at least twice each month. Provided that said fees shall be paid in advance and any person j -,Tho fails .or refuses to pay said fee shall upon con- viction in Corporation Court be fined in any swTi not less than five ($5.00) dollars nor more than two -hundred ($200.00). Section 21. any person voilating any provision of this ordinance, where no penalty is provided shall upon convic- tion in the Corporation Court be fined in any sum not less than five nor morethan two -hundred dollars. Section 22. If the Superintendent of Garbage shall fail to remove and carry off any slops, trash or night soil within 48 hours after having been notified and re�estecl to _ remove the same he shall be deemed guilty of a misdemeanor and upon conviction in the corporation court be fined any stmi not less than three (ti3.00) dollars nor -More .than two -hundred Section 23, Chapters XIII and XV of the Revised Code of Ordinances of the City of Deawront as codified by i,ic Lowell and Davidson and approved by the City Council on the 7th day of February, 10111 are hereby repealed. Section 24. It shall be unlawful for the Superin- tendent of the Garbage Department or anyone in his -employ to remove or carry atiti*ay the contents of any privy, vault or waster closet, or any receptacle of hiunan excrerent at any time except during the hours enbraced between 3 P.I4_. and 4 A.Yl. Section 25.
