BE IT ORDAINED BY THE CITY COTTECIL Or TT-- CITY OF BEAUMONT:- Section One That the title and Sections one, two, three, five, six, seven, eight, nine, ten and eleven of An Ordinance, entitled: "An Ordinance, entitled an Ordinance, creating a Board of Cater Forks Commissioners for the City of Beaumont; providing for their appointment and terms of office; prescribing qualifications of the members; defining the rights, powers and duties of such board, and declar- ing an emergency," adopted by the City Council, Apr I1 21st, 1914, be. and the same are amended to react as hereinafter set.out; that section twelve, of aaid. Sac -l- There is hereby created a Board of Mater forks Commissioners for the City of Beaumont, to be known as the ,.°rater orks Commission, to consist of three members with exclusive jurisdiction to control, operate, manage, maintain and impxove the later ;orks System of the City -� of Beaumont. Two members shall constitute a quorum for transaction of hnsiness, b7)t a less number may adjourn from tilao, to time, such adjourned i eet1�gs, if a quorum is present, shall have the same ��ower as any regular meeting wr)uld have had, had it been held. Sec -2- The members of the Board of 1.1ater ;'forks Commissioners shall be appointed by, the Iia;Tor and confirmed by the City C 11cil. Any ,-,erson appointed and confirmed by the City -.+ N Council as a member of said Board of ,later Works Com:_issioners, shall within fifteen days after his appointment and notification thereof, file with the City Secretary his written acceptance of such appointment, aid_ if the sa.rie is not dong within said fifteen days, the appointment shall be Yield null and void. and the I.Iayor shall make another nomination, which nomination shall be confirmed. by the City Council. No Dexson shall be appointed a member of said Board of Water ryorks Commissioners who is not a resident citizen, and a qualified property tax payer and voter of the City of Beaumont. Sec -3. The 14ayor of the City of Beaumont, shall not later than the first regular meeting of the City Council, l following the meeting at which this Ordinance is adopted, appoint the members of said Board. of Watex' Works Commissioners. The riembers of said Board of hater t7orks Commissioners shall hold office for two years and until their uceessors shall qualify; provided that from the members first appointed, two members shall hold office until the First Tuesday in May. 1915, and one member shall hold office until the First 1 Tuesaay in Kay, 1916, the said Board to determine b17 lot at their first regular meeting after their appointrient the term for ,7hich each shall serve, and their action thereon shall be certified by the City Council. As the terms of each member e_tpixes, the I.Zayor shall fill the same in the manner provided in Sec -2 of this Ordinance. Vacancies occuring in said -Board shall be filled by the ilayor, subject to confirmation of the City Council, for the une;-pired term. See._4. The Board of ,later Vioxks Commissioners shall select from among their members,one who shall be designated as 1 President of said Boaxd, and one who shall be designated as Vice Pxesident of said Board. The president of said Board shall preside at all meetings and shall have a vote on all questions before said. Board. In the absence of the -'resi dent, the Vice President shall preside. and shall have the same authority as the President. The Board shall addpt their own by-laws and rules govern- ing the transaction of its business, subject to limitations imposed by this Ox: mance- Sec- 5. The Board of ';later ,;'oxks Commissioners shall hold at least one regular meeting each ouartex,in office of the Water ;forks Commissioncat such time as.they may decide upon, and shall hold as many special meetings as in their opinion is nece sary. All such regular meetings shah_ be o,?en to the public for the -,:urpose of hearing any and all business which the public may have with the said mater Works Commission. Said Board ma.y be required from time to time to meet witkl the City Council, when so directed. The Board of nater Works Commissioners shall appoint their own secretary, with such powers and duties as are usually incident to such office, and with such powers and duties as the Commission may from tine to time by its by-la�•:s prescribe. The Foard of Z,Ilater Works Commissioners shall have the power and a»thority to employ all necessary help including the Superintendent of the Plater Works System, and all employees, and shall have the power to prescribe rules and regulations governing all em1ployees. The Boa.±d of Water Works Commissioners shall have the power and autrority to prescribe the rates for service to be charged for supplying water to any person, firm or corporation, such rat=s to be ap_rroved by the City Council of the City of Beaur ont. Sec -9. Third.:- For the payment to the credit of the General Fund of the City of Beaumont an amount egnu,l to the sum collected from the ad- valorem tax roll of each year, to create the necessary sinking fund, and pay th- interest on the City of BeauLont Water Works Boni s No -2. Sec -11. Whereas, the City of R-2aumont has pumchased from the Beaumont ~dater Wor;rs Company its properties including the Water Vlz)r}ts System, and. Illhexeas, it is necessary that the City of Beaur_iont shall immediately make arrangements to take c<<re of the Water jyorks System creates an emergency and a public necessity, so that the rule requiring ordinances to be read at three separate meetings should be suspended and it is hereby sgspended and this Ordinance shall o into effect and force from and aftQr its passage and lawful publication." a Section Two That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed. Section Three The fact that the present ordinance -relative to the . creation, power and duties of the Board. of Water Yforks Commissioners, is unauthorized by the Charter of the City of Beaumont; and not in accordance therewith, andis in- adequate creates, an emergency &nd imperative public necessity, that the rule.regui.ring ordinances to be read at three regular meetings to be suspended.
