Entitled an ordinance amending Article 405, Chapter 31 of the Revised Code of Ordinances of the City of Beaumont, revised by McDowell & Davidson and adopted by the City Council of the City of Beaumont, the 7th day of February, A. D. 1911, and declaring an emergency. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:. SECTION 1. That Article 405, Chapter 31 of the Revised Code of Ordinances of the City of Beaumont, revised by McDowell & Davidson and adopted by the City Council of the City of Beaumont on the 7th day of February, A. D. 1911 be amended so that it shall hereafter read as follows, to -wit:_ .Article 405. Any person, firm or corporation wishing to construct in any street or alley of the City of Beaumont a private sewer line shall first secure from the City Council of the City of Beaumont permission to own and control said sewer line; provided, that the City Council shall have the right and authority to revoke said permit at any time for any cause the said City Council,Might deem sufficient; and, after said permit has been revoked said sewer shall become the property of the City of Beaumont. .If the City Council shall give a permit to construct said line said owner shall follow the ordinances of the City of Beaumont relative to securing a permit and in the construction thereof. Any person, firm or corporation securing a permit from the City Council, as provided in this article, shall have the right to prevent any one from connecting with said sewer line; and any person, firm --;or corporation connecting with said sewer line without permission of said owner shall be guilty of a -misdemeanor and shall be punished as provided in Article 416 of this chapter, and provided further, that each day said. person, firm or corporation shall permit said connection to remain shall be a separate and distinct offense; ands provided further, that the owner of said sewer line shall at all times keep same free from obstruction and if at any time said sewer line should become clogged or stopped the owner shall immediately fix same and each day he fails or refuses shall be a separate offense, and shall be punished as provided in Article 416 of this chapter. All sewers now laid and existing in the streets or alleys of the City of Beaumont, and all which may hereafter be laid or exist therein, as well as all sewers which tap, connect a ' •. with or run into the public sewers of this city, when they are on the streets and alleys, shall be and the same are made the property of the City of Beaumont, and placed under the control and regulation of the ordinances of said city. Provided that this shall not apply to any sewer laid in the streets and alleys when a permit has been secured as provided in the first part of this article unless said permit shall be revoked by the City Council. It is made the duty of the Sewer and Plumbing Inspector to keep a record of all sewer lines laid in the streets and alleys of the City of Beaumont, and when by any person, firm or corporation under a permit from the City Council a permanent record shall be made relative thereto showing the person, firm or corporation to whom said permit is issued, time issued, street or streets in which same is laid, location thereof and othere details. SECTION 2. All ordinances or parts of ordinances ia conflict with this ordinance shall be and the same are her -repealed. SECTION 3. Owing to the injustice now done to those laying private sewer lines and to prevent any and every person from connecting therewith without cost and believing that the passage of this ordinance will stimulate the extending, of the sewer system, creates an emergency and a public necessity so that the rule requiring ordinances to be read at three separate meetings be and the same is hereby repealed and this ordinance shall go into effect and be in full force from and after its passage and lawful publication.
