HomeMy WebLinkAboutORD 69-17ORDINANCE NO.62 ENTITLED AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF BEAUMONT, TEXAS; ESTABLISHING PRIMA FACIE SPEED LIMITS UPON CERTAIN STREETS, HIGHWAYS OR PORTIONS OF STREETS OR HIGHWAYS WHEN SIGNS ARE ERECTED GIVING NOTICE THEREOF; BY AMENDING SECTION 37-58.3 REG- ULATING THE SPEED OF VEHICLES IN THE AREA OF THE FRONTAGE ROADS OF U. S. HIGHWAY 69, AND INTERSTATE HIGHWAY 10, AND THE ROADWAYS IN THE AREA OF THE INTERSECTION OF U. S. HIGH- WAY 693 96 AND 287 AND INTERSTATE HIGHWAY 10, AND DESCRIBED ON THE SPEED ZONE MAPS ADOPTED BY REFERENCE HEREIN AND MADE A PART OF THIS ORDINANCE FOR ALL INTENTS-AN_PUR- POSES; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That section 37-58.3 of the Code of Ordinances of Beaumont, Texas, is hereby amended to read as'follows: Sec. 37-58.3. Same—Changed in Certain Zones. It is hereby determined upon the basis of an engineering and traffic investigation, that the speed permitted by state law upon the streets or portions thereof described in the Speed Zone Maps incorporated herein by ref- erence and made a part of this ordinance for all intents and purposes, a copy of which is of public record in.the City Clerk's Office of The City of Beaumont, Jefferson County, Texas, is greater in some cases and less in some cases than is reasonable or safe under the conditions found to exist upon such streets or portions thereof, and it is hereby declared that the prima facie speed limit upon those streets or portions thereof des- cribed below in the incorporated Speed Zone Maps shall be as therein stated, when signs are erected giving notice thereof. S C H E D U L E In accordance with this section, and when signs are erected giving notice thereof, the prima facie speed limit shall be as set forth in the incorporated maps, made part of this ordinance, and indicated by colored lines on said maps, and at all times, upon those streets or portions thereof specified herein: (a) Map No. 68T-1 (Date of Survey, December 19, 1967) In an area bounded by North Street on the South, West Frontage Road of U. S. Highway 90 Business on the West, the main traveled lanes of Interstate Highway 10 on the North, and Pine Street on the East: SPEED IN MILES PER HOUR Minimum Speed Maximum Speed In Miles Per Hour In Miles Per Hour Zone Color Red 40 mph Zone Color Green 35 mph (b) Map No. 68T-101 (Date of Survey, July 26, 1968) The paved roadways in the area of the intersection of U. Maximum Speed In Miles Per Hour 45 mph 40 mph That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 3. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. 4. That all ordinances and parts of ordinances in conflict herewith are hereby repealed. PASSED by the City Council this Aday of March, 1969. - Mayor -
