ENTITLED AN ORDINANCE AMENDING CHAPTER 37, SECTION 37-58 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS; ESTABLISHING PRIMA FACIE SPEED LIMITS UPON CERTAIN STREETS, HIGHWAYS, OR PORTIONS OF STREETS AND HIGHWAYS WHEN SIGNS ARE ERECTED GIVING NOTICE THEREOF; BY CHANGING PORTIONS OF INTERSTATE HIGHWAY 10 TO THE "SCHEDULE" OF SPEED LIMIT REGULATIONS OF SECTION 37-58; PROVIDING A PENALTY; PRO- VIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CON- FLICT HEREWITH. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That section 37-58 of the Code of Ordinances of Beau- mont, Texas, is hereby amended to read as follows: Sec. 37-58. Same—Changed in certain zones. It is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by state law upon the streets or portions thereof described in the schedule below is greater in some cases and less in some cases than is reasonable or safe under the con- ditions found to exist upon such streets or portions thereof, and it is hereby declared that the prima facie speed limit upon those streets or portions thereof described in the schedule below shall be as therein stated, when signs are erected giving notice thereof. S C H E D U L E In accordance with this section, and when signs are erected giving notice thereof, the prima facie speed limit shall be as set forth in this schedule, at all times, upon those streets or portions thereof specified herein: Speed In Direction Miles Per Hour Street Of Travel Maximum Minimum Interstate Highway (a) From the east city 10 limits line of the North_ City of Beaumont to a point 800 feet north & 55 40 of the center line of U. (c) From the north right -of- North NI Tnat any person who violates any provision of this ordinance shall) upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 4IN That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various portions and provisions of.this ordinance are declared to be severable. 4. That all ordinances and parts of ordinances in conflict herewith are hereby repealed. PASSED by the City Council this 18th day of March, 1969. - Mayor -
