ENTITLED AN ORDINANCE CORRECTING ORDINANCE NO. 69-13 SO AS TO REDESCRIBE PORTIONS OF A TEN (101) FOOT WIDE GENERAL UTILITY EASEMENT OUT OF THE CARTWRIGHT AND ROBERTS SUBDIVISION A AND THE COLUMBUS CARTWRIGHT SUBDIVISION NO. 1 IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS MORE PARTIC- ULARLY.DESCRIBED HEREIN, WHICH PORTIONS OF SAID EASEMENT WERE VACATED AND ABANDONED BY SAID ORDINANCE -NO. 69-13. Whereas, Ordinance No. 69-13 vacated and abandoned two portions of a ten (101) foot wide general utility easement out of the Cartwright and Roberts Subdivision A and the Columbus Cartwright Subdivision No. 1 in the City of Beaumont, Jefferson County, Texas; and, Whereas, said ordinance contained a misdescription, of the portions of said easement intended to be vacated and abandoned and this misdescription should be corrected so as to reflect the true intent and true description of the por- tions of said easement desired to be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That portions of the general utility easement, as hereinafter described, in the City of Beaumont, Jefferson County, Texas, be and the same are hereby vacated and abandoned, said por- tions of said easement to be abandoned being described as follows, to wit: Portion No. 1. BEING a portion of a 101 wide utility easement heretofore conveyed to the City of Beaumont, Jefferson County, Texas, as recorded in Volume 1166, Page 106, Deed Records, Jefferson County, Texas, the portion to be abandoned is located in the northern portion of Lot 3, Block A of the Replat of Block 36 of the Cartwright and Roberts Subdivision A in the David Brown Survey and being more fully described as follows: BEGINNING at a point in the north line of the said existing easement, said point being located in the north line of said Lot 3 and in the south line of Lot 16 of the Columbus Cartwright Subdivision Number 1 and further located, west, a distance of 64.40' from the northeast corner of said Lot 3; THENCE SOUTH into the existing easement, a dis- tance of 2.00' to corner; THENCE WEST, 2.00' south of and parallel to the north line of the said existing easement and the north line of said Lot 3, a distance of 79.00' to corner; THENCE NORTH, a distance of 2.00' to corner in the north line of said existing easement in the north line of said Lot 3 and the south line of the aforementioned Lot 16 of the Columbus Cart- wright Subdivision A; THENCE EAST along the common lot line, the common subdivision line and along the south line of a 10.00' wide utility easement hereto- fore conveyed to the City of Beaumont as re- corded in Volume 1166, Pages 193 and 195, Deed Records of said county, a distance of 79.00' to the place of beginning. PORTION NO. 2. BEING a portion of a 10' wide utility easement heretofore conveyed to the City of Beaumont, Jefferson County, Texas, as recorded in Volume 1166, Pages 193 and 195, Deed Records of said county, the portion to be abandoned is located in the southern portion of Lots 15 and 16 of the Columbus Cartwright Subdivision Number 1 and being more fully described as follows: BEGINNING at a point in the west line of said Lot 15 and the east .line of said Lot.16 of the Columbus Cartwright Subdivision Number 1 in the north line of the aforementioned existing 10' wide easement, said beginning point being located NORTH, a distance of 10.00' from the southwest corner of said Lot 15 and the southeast corner of said Lot 16; THENCE EAST along the north line of the said existing 10' wide utility easement, 10.00' north of and parallel to the south line of said Lot 15, a distance of 49.65' to the east line of the Schlesinger's Geriatric Center 7.95 acre tract; THENCE SOUTH along the east line of the 7.95 acretract, a distance of 7.00' to corner which is 3.00' north of the south line of said Lot 15_ THENCE WEST, 3.00' north of and parallel to the south line of Lot 15 and Lot 16, and 7.00' south of and parallel to the north line of the said existing easement, at a distance of 49.65' cross THE WEST LINE OF Lot 15 and the east line of Lot 16 and continuing along said course an additional distance of 94.40', making a total distance of 144.05' for this course, to corner; THENCE SOUTH 3.00' to the south line of Lot 16 and the south line of the said existing 10.00' wide easement in the south line of the Columbus Cartwright Subdivision Number 1 and the north line of Lot 3, Block A of the Replat of Block 36 ofthe Cartwright and Roberts Subdivision A and the north line of an existing 10.00' wide utility easement heretofore conveyed to the City of Beaumont, Texas as recorded in Volume 1166, Page 106, Deed Records, Jefferson County, Texas, for corner; THENCE WEST along the common lot line, the common subdivision line and the common easement line, a distance of 79.00' to corner; THENCE NORTH across the existing easement as recorded in Volume 1166, Pages 193 and 195, a distance of 10.00' to corner in the north line of said existing easement; THENCE EAST, along the north line of said existing easement, 10.00' north of and parallel to the south line of Lot 16, a distance of 173.40'to the place of beginning.
