BE IT ORDAINET BY THE CITY COUNCIL OF THE CITY OF BEAUMONTo- ART I CLF, 454 Section I: That all merchants shall have the right to occupy one-half of the sidewalks in receiving and, for*arding' goods, wares and merchandise, provided said space is not, thus occupied more than five minutes at a time. Provided, further, that all wholesale merchants shall be allowed , to occupy and use in connection with their business, not exceeding three feet of space next to their said building. Pearl and Crockett Streets are hereby excepted from this last provision. ART I CLE c)455 Section Io That it shall be unlawful for any merchant 'doing business in the City of Beaumont to occupy and use any part of the sidewalks for the purpose of exhibiting, displaying and advertising goods, wares and merchandise, except permission be' granted by the City Council for that purpose, according to the following conditions, to-uito 0 Entitled an ordinance to amend Article 454 and 455 of Chapter 44 of the Revised Ordinances of the City of Beaumont, regulating the use of sidewalks b.* wholesale and retail merchants for the purpose of exhibiting, displaying and advertising thein goods wares and Merchandise, and providing a penalty for the violation thereof. ART I CLE (-j 455 Section Is That it shall be unlawful for any merchant r. doing business in the City of Beaumont to occupy and use any part of the sidewalks for the purpose of exhibiting, displaying and advertising goods, wares and merchandise, except permission be" granted by the City Council for that purpose, according to the following conditions, to -;pita That no goods, iraxes and merchandise shall be placed upon sidewalks for exhibiting, displaying and advertising,' e except same be enclosed in show cases in the manner hereinafter o set forth, to -wit: 0 0 0 , C� Ti, q 0- P - 2- . -2- (1) That for the purpose of setting and adjusting plate glass show cases, thereon, in which goods, wares and merchandise are offered for sale may be exhibited.; displayed and advertised, any person, firm or corporation doing business in the City of Beaumont may occupy and use the inner side of the sidewalks, not to exceed 16" wide along, next to and against the wall of the store room, and at or near the entrance to the same in which said business is conducted. (2) That the said persona firm or corporation, who Mqy decide to use such portion of the sidewalk, mentioned in clause 1, shall make written application to the City Council,. requesting such privilege, and in said written application shall bind himself, to hold the City harmless from any liability for damages that might accrue or result from or by reason of .setting such shorn; case or show" cases on the sidewalk, (3) That said merchants shall present to the City Council with said written application, plans and specifications of the plate glass show case or cases, that may be desired to be used for the purpose of enclosing the goods, wares and merchandise offered for sale, to be exhibited, displayed and advertised on the sidewalko Section 28 That the use of the sidewalk for exhibiting, displaying and advertising goods, wares and merchandise offered for aale, without same being placed in said plate glass show case or show cases,under a permit, duly granted by the City Council, shall be declared a misdemeanor, and upon conviction in the Corporation Court of the City of Beaumont, shall be fined in any stun not to exceed $100,00, and every day said violation of merchandise are offered for sale may be exhibited:; displayed and advertised, any person, firm or corporation doing business in the City of Beaumont may occupy and use the inner side of the sidewalks, not to exceed 16" wide along, next to and against the gall of the store room, and at or rear the entrance to the same in which said business is conducted. (2) That the said person, firm or corporation, who mqy decide to use such portion of the sidewalk, mentioned in clause 1, shall make written application_ to the City Council, requesting such privilege, and in said written application shall bind himself, to hold the City harmless from any liability for damages that might accrue or result from or by reason of setting such show case or show cases on the sidewalk. (3) That said merchants shall present to the City Council with said written application, plans and specifications of the plate glass show case or cases, that may be desired to be used for the purpose of enclosing the goods, wares and merchandise offered for sale, to be exhibited, displayed and advertised on the sidewalk. Section 2% That the use of the sidewalk for exhibiting, displaying and advertising goods, wares and merchandise offered for aale, without same being placed in said plate glass show case or show cases,under a permit, duly granted by the City Council, shall be declared a misdemeanor, and upon conviction in the Corporation Court of the City of Beaumont, shall be fined in any sum not to exceed $100.00, and every day said violation of the ordinance occurs, shall be considered a separate and distinct offense. ��A J U two �U, 3- Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed, Section 4'. This ordinance shall take effect and be in full force from and after its passage, approval by the Mayor and lawful publication.
