HomeMy WebLinkAboutORD 69-47LO/id , f `? __ c/ i 17-1--rq6 ,9 ORDINANCE NO. 6,'J-427 .� J -427 ENTITLED AN ORDINANCE AMENDING CHAPTER 23 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY ADDING A SECTION TO BE NUMBERED 23-44 PRO- HIBITING THE CONSTRUCTION, OPERATION AND MAIN- TENANCE OF ANY CABLE TELEVISION SYSTEM OR COMMUNITY ANTENNA SYSTEM OR ANY OTHER RELATED SYSTEM IN, UPON, ALONG, ACROSS, ABOVE, OVER AND UNDER THE STREETS, ALLEYS, EASEMENTS AND PUBLIC PLACES OF THE CITY OF BEAUMONT, JEF- FERSON COUNTY, TEXAS FOR THE PURPOSE OF OPERATING A CABLE TELEVISION SYSTEM OR COMMU- NITY ANTENNA SYSTEM OR ANY OTHER TYPE OF RELATED SYSTEM FOR THE INTERCEPTION, TRANSMISSION AND DISTRIBUTION OF AUDIO AND VIDEO SIGNALS INCLUDING TELEVISION WITHOUT HAVING FIRST OBTAINED A FRANCHISE FROM THE CITY OF BEAUMONT; PROVIDING FOR A PENALTY; PROVIDING FOR SEVERABIL- ITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR INJUNCTIVE RELIEF. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: I. That the Code of Ordinances of Beaumont, Texas is hereby amended by adding a section to be numbered 23-44, which said section reads as follows: Section 23-44. Prohibiting Operation Without Franchise (a) No person, partnership, corporation or association shall construct, operate, or maintain in, upon, along, across, above, over and under the streets, alleys, easements and public places located within The City of Beaumont a cable television system or community antenna system or any other related system for the interception, transmission and distribution of audio and video signals including television without first obtaining a franchise from the City Council of The City of Beaumont. (b) In case any cable television system or community antenna system is operated or attempts to operate in, upon, along, across, over and under any of the streets, alleys, ease- to institute on behalf of the City and in the name of the City any proper action or proceeding to correct or abate such violations as outlined above. II. That any person who violates any provision of this ordinance shall upon conviction be punished as provided in Sec- tion 1-8 of the Code of Ordinances of Beaumont, Texas. That if any sections, sub -sections, sentence, clause, or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable. IV. That all ordinances and parts of ordinances in conflict herewith are hereby repealed. 1969. PASSED by the City Council this day of -j 'i , i 0 Mayor -
