STREET EASTWARD TO THE NECHES RIVER; VACATING AND ABANDONING THAT PORTION OF TEVIS STREET FROM THE EAST LINE OF CYPRESS STREET EASTWARD TO THE NECHES RIVER; AND VA- CATING AND ABANDONING THAT PORTION OF HICKORY STREET FROM THE EAST LINE OF CYPRESS STREET EASTWARD TO THE NECHES RIVER, AS MORE PARTIC- ULARLY DESCRIBED HEREIN; PROVIDING THAT SUCH ABANDONMENTS ARE SUBJECT TO THE RIGHTS OF EXISTING UTILITIES IN SAID STREETS AND SUBJECT TO AN EASEMENT FOR A. RUNNING TRACK CONVEYED TO THE SOUTHERN PACIFIC COMPANY AND THE ATCHISON TOPEKA AND SANTA FE RAILWAY COMPANY DATED JUNE/71 1969. WHEREAS, on the 5th day of February, 1969, The City of Beaumont entered into a contract with Southern Pacific Company, The Kansas City Southern Railway Company, Missouri Pacific Railroad Company, The Atchison Topeka and Santa Fe Railway Company, and The Port of Beaumont Navigation District of Jef- ferson County, Texas, said agreement being referred to as The Port Exchange Yard Agreement; and, WHEREAS, pursuant to said agreement and in order that said agreement may be fulfilled, the City Council deems it necessary and in the best interest of the City that those portions of Mulberry Street, Tevis Street and Hickory Street from the east line of Cypress Street eastward to the Neches River be vacated and abandoned subject to the rights of existing utilities and subject to an easement for a running track to Southern Pacific Company and The Atchison Topeka and Santa Fe Railway Company dated Junell', 1969; NOW, THEREFORE, BE IT ORDAINED BY THE CITY -OF BEAUMONT, TEXAS: That those portions of Mulberry Street, Tevis Street and Hickory c+ -root f - nm tbp Pest line of Cypress Street eastward to the subject to the rights of existing utilities in said tracts and subject to an easement for a running track from The City of Beaumont to the Southern Pacific Company and The Atchison Topeka and Santa Fe Railway Company dated Junes't, 1969, and that title to said portions of said vacated and abandoned streets shall revert to and become the property of the person or corporation entitled thereto as provided by law. Exhibit attached hereto and incorporated by reference shows the portions of the three above named streets vacated and abandoned by this instrument.
