ENTITLED AN ORDINANCE AUTHORIZING THE PROPER
OFFICIALS OF THE CITY OF BEAUMONT TO EXECUTE
AND DELIVER FOR AND ON BEHALF OF THE CITY OF.
BEAUMONT AN EASEMENT FOR RUNNING TRACK PUR-
POSES TO THE SOUTHERN PACIFIC COMPANY AND THE
ATCHISON TOPEKA AND SANTA FE RAILWAY COMPANY
ACROSS FIVE TRACTS OF LAND IN THE ORIGINAL
TOWNSITE OF BEAUMONT, JEFFERSON COUNTY, TEXAS,
MORE PARTICULARLY DESCRIBED HEREIN.
WHEREAS, on the 5th day of February, 1969, The City of
Beaumont entered into a contract with Southern Pacific Company,
The Kansas City Southern Railway Company, The Missouri Pacific
Railroad Company, The Atchison Topeka and Santa Fe Railway
Company and The Port of Beaumont Navigation District of Jef-
ferson County, Texas, said agreement being referred to as the
Port Exchange Yard Agreement; and,
WHEREAS, pursuant to said agreement and in order that
said agreement may be fulfilled, the City Council deems it
necessary and in the best interest of the City that an easement
for running track purposes across the hereinafter described
tracts of land be conveyed to the Southern Pacific Company
and The Atchison Topeka and Santa Fe Railway Company;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
That the Mayor be, and he is hereby, authorized to execute and
deliver for and on behalf of The City of Beaumont an easement
for a running track to the Southern Pacific Company and The
Atchison Topeka and Santa Fe Railway Company across and over
the following described tracts of land, to wit:
Tract "A"
Being a portion of Mulberry Street as shown on
the plat of the Beaumont Townsite, Beaumont, Jef-
ferson County, Texas, and recorded in Volume 448,
Page 249 of the deed records of said County and
being more particularly described as follows:
Beginning at an iron rod marking the inter-
section of the east line of Cypress Street with the
being the most southwesterly corner of Steam Mill
Square of the said Beaumont Townsite;
Thence North 88 degrees 58 minutes 50 seconds
East along the north line of said Mulberry Street
a distance of thirty-four and thirty-nine hundredths
(34.39) feet to a point for corner;
Thence South 00 degree 20 minutes 10 seconds
East a distance of sixty-one and eleven hundredths
(61.11) feet to a point for corner in. the south line
of said Mulberry Street;
Thence South 88 degrees 58 minutes 50 seconds
West along the south line of said Mulberry Street
a distance of thirty-three and sixty-six hundredths
(33.66) feet to a point for corner in the east line
of said Cypress Street, said point also being the
northwest corner of Block 24 Beaumont Townsite;
Thence North 01 degree 01 minute 10 seconds
West sixty-one and eleven hundredths (61.11)feet
to the place of beginning. This conveyance being
subject to easement rights on existing utilities.
Tract "B"
Being a portion of Lots 599, 600, 601, 602, and
603, Block 24 as shown on the plat of the Beaumont
Townsite, Beaumont, Jefferson County, Texas and
recorded in Volume 448, Page 249 of the deed records
of s'l'id County and being more particularly described
as follows:
Beginning at an iron rod marking the intersection
of the east line of Cypress Street with the south
line of Mulberry Street, said point also being the
northwest corner of Lot 603, Block 24 of the said
Beaumont Townsite;
Thence North 88 degrees 58 minutes 50 seconds
East along the south line of said Mulberry Street
or the north line of said Lot 603 thirty-three
and sixty-six hundredths (33.66) feet to a point
for corner;'
Thence South 00 degree 20 minutes 10 seconds
East fifty-six and thirty-eight hundredths (56.38)
feet to a point for corner, said point being the
point of curve of a curve to the left;
Thence deflecting to the left along the arc of
an eight hundred eleven and fifty-two hundredths
(811.52) foot radius curve a distance of ninety
and ten hundredths (90.10) feet to the point of
tangency of said curve (chord of said curve bears
South 03 degrees 31 minutes 02 seconds East ninety
and five hundredths (90.05) feet);
Thence South 06 degrees 44 minutes 43 seconds
East one hundred fifty-four and forty-four hun-

the plat of the Beaumont Townsite, Beaumont, Jef-
ferson County, Texas and recorded in Volume 448
Page 249 of the deed records of said County and
being more particularly described as follows:
Beginning at the southwest corner of Lot 599,
Block 24 of said Beaumont Townsite, said point
also being the intersection of the north line of
Tevis Street with the east line of Cypress Street;
Thence North 88 degrees 58 minutes 50 seconds
East along the north line of said Tevis Street or
the south line of said Lot 599 nineteen and sixty-
six hundredths (19.66) feet to the place of be-
ginning of this description;
Thence continuing North 88 degrees 58 minutes
50 seconds East along the north line of said Tevis
Street or the south line of said Lot 599 thirty-two
and sixty-six hundredths (32.66) feet to a point
for corner;
Thence South 06 degrees 44 minutes 43 seconds
East sixty-one and forty-two hundredths (61.42)
feet to corner in the south line of said Tevis
Street, said point also being in the north line
of Lot 593, Block 23 of said Beaumont Townsite;
Thence South 88 degrees 58 minutes 50 seconds
West along the south line of said Tevis Street
or the north line of said Lot 593 thirty-two and
sixty-six hundredths (32.66) feet to a point for

Being a portion of Lots 589. 590. 591. 592. 993
Beginning at the southwest corner of Lot 589,
Block 23 of said Beaumont Townsite, said point
also being the intersection of the north line of
Hickory Street with the east line of Cypress Street;
Thence North 88 degrees 58 minutes 50 seconds
East along the south line of said Lot 589 or the
north line of said Hickory Street eighty-nine and
four hundredths (89.04) feet to the place of
beginning of this description;
Thence continuing North 88 degrees 58 minutes
50 seconds East along the south line of said Lot
589 or the north line of said Hickory Street
thirty-six and eighty-six hundredths (36.86) feet
to a point for corner, said point being on a
curve running in a northwesterly direction and
having a radius of four hundred fifty and eighty-
seven hundredths (450.87) feet;
Thence deflecting in a northwesterly direction
along the arc of a four hundred fifty and eighty-
seven hundredths (450.87) foot radius curve a
distance of one hundred eighty-five and one hun-
dredth (185.01) feet to the point of tangency of
said curve (chord of said curve bears North 18
degrees 26 minutes 12 seconds West one hundred

Being a portion of Hickory Street as shown on
the plat of the Beaumont Townsite, Beaumont, Jef-
ferson County, Texas and recorded in Volume 448,
Page 249 of the deed records of said County and
being more particularly described as follows:
Beginning.at the southwest corner of Lot 589,
Block 23 of said Beaumont Townsite, said point
also being the intersection of the north line of
Hickory Street with the east line of Cypress Street;
Thence North 88 degrees 58 minutes 50 seconds
East along the south line of said Lot 589 or the
north line of said Hickory Street eighty-nine and
four hundredths (89.04) feet to the place of be-
ginning of this description;
Thence continuing North 88 degrees 58 minutes
50 seconds East along the south line of said Lot
589 or the north line of said Hickory Street
thirty-six and eighty-six hundredths (36.86) feet
to a point for corner on a curve running in a
southeasterly direction and having a radius of
four hundred fifty and eighty-seven hundredths
(450.87) feet;
Thence deflecting in a southeasterly direction
along the are of a four hundred fifty and eighty-
seven hundredths (450.87) foot radius curve a
distance of thirty and forty-three hundredths
(30.43) feet to the point of tangency of said
curve (chord of said curve bears South 32 degrees
11 minutes 39 seconds East thirty and forty-two
hundredths (30.42) feet);
Thence South 34 degrees 07 minutes 39 seconds
East forty-one and eighty-eight hundredths (41.88)
feet to a point for corner, said point being in
the south line of said Hickory Street or the north
line of Block 7 of the said Beaumont Townsite;

Thence deflecting to the right along the arc of
