ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF LOT 1, BLOCK 6, G. CUCHIA ADDITION, TRACT 4 OUT OF TRACT 2, BLOCK 25, IOWA COLONY SUBDIVISION, AND THE SOUTH ONE-HALF OF THE ABANDONED ALLEY LYING BETWEEN LOTS 1 AND 12, BLOCK 6, G. CUCHIA-ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED 'IR -l" TO "R-211; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned "R-1" Single -Family Dwelling District to "R-2" Two -Family and Multiple Dwelling District, to wit: Being a tract of land lying in the City of Beaumont, Jefferson County, Texas, containing 0.309 acres, more or less; said property being Lot One (1), Block Six (6), G. Cuchia Addition and Tract Four (4) out of Tract Two (2), Block Twenty-five (25), Iowa Colony Sub- division (according to the City of Beaumont 1968 Tax Rolls); and the south one-half (S 1/2). of the abandoned alley lying between Lots one and Twelve (1 and 12), Block Six (6), G. Cuchia Addition; said above described property fronting 100 feet along -the north side of Florida Avenue and 150 feet along the west side of Elba Street; also including one-half of the abutting street right-of-way. and the official'zonng map of The City of Beaumont is -hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described here- inabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the pro- perty described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
