HomeMy WebLinkAboutORD 69-66• /61J_ y 6/ �l ORDINANCE NO.T_ ENTITLED AN ORDINANCE AMENDING CHAPTER 37, SEC- TION 37-73 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, MAKING IT UNLAWFUL TO FOLLOW FIRE APPARATUS TRAVELING IN RESPONSE TO FIRE ALARM CLOSER THAN 500 FEET; PROHIBITING ANY PERSON FROM OPERATING, STOPPING OR PARKING A VEHICLE WITHIN 300 FEET OF FIRE FIGHTING OPERATIONS OR WHERE FIRE FIGHTING APPARATUS HAS BEEN PLACED; PROVIDING EXCEPTIONS FOR OFFICIALS AND OTHER.PERSONS DIRECTED TO PROCEED;PROVIDR%.A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY OF 'BEAUMONT,' TEXAS: I. That Sect -ion 37-73 of the Code of Ordinances of Beaumont, Texas, is hereby amended to read as follows: Section 37-73. Following Fire Apparatus The driver of any vehicle other than one on official business shall not follow any fire apparatus traveling in re- sponse to a fire alarm closer than 500 -feet or operate, stop or park a vehicle within 300 feet where fire fighting operations are being conducted or where fire fighting apparatus has been placed. The provisions of this section shall not apply, however, to any person who is on official business for the police depart- ment or the fire department, or any person who is directed by a policeman or fire fighter to proceed within the above mentioned 300 foot radius. 2. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 0 That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a par- ticular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. 4. . That all ordinances and parts of ordinances in conflict herewith are hereby repealed. PASSED by the City Council this the day of September, 1969. - Mayor -
