HomeMy WebLinkAboutORD 70-46ORDINANCE NO. `10 — 46 ENTITLED AN ORDINANCE AMENDING CHAPTER 42.OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF FOUR TRACTS OF LAND OUT OF THE-FREDERLCK BIGNER SURVEY,,,CON- TAINING 49.693 ACRES, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN PRESENTLY ZONED "R-1" TO "C-1"; PROVIDING FOR SEVER- ABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning dis- tricts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification -of the following described tract of land, presently zoned "R-1" Single -Family Dwelling District to "C-1" Neighborhood Commercial District, to wit: BEING four tracts of land out of the Frederick Bigner Survey containing 49.693 acres, and being more particularly described as one tract as follows: BEGINNING at an iron pipe in the West line of Crow Road, a 40 foot wide right-of-way, said iron stake locating the southeast corner of the Chaison 3.394 acre tract of land and the North- east corner of a 10 acre tract of -land conveyed by Raymond Crow and wife, Mary Hope Crow, to Mrs. Ida Garner by deed dated 13th day of August, 1928 and being recorded in Volume 307, Page 213 of the Deed Records of Jefferson County, Texas; said iron pipe also locating the Northeast and the beginning corner of the tract of land herein des- cribed; said beginning corner lying 517.30 feet south of the south right-of-way line of U. S. Hwys. 69, 96 & 287; THENCE South 88 degrees 57 minutes 45 seconds West 447.67 feet to an iron rod locating the Northwest corner of said 10 acre tract and the Northeast corner of a 3.06 acre tract of land; THENCE South 88 degrees 27 minutes 15 seconds West 236.21 feet to an iron pipe for corner; THENCE South 2 degrees 06 minutes 15 seconds East with an East line of the Chaison 45.317 acre tract of land 577.94 feet to a steel rod for corner; THENCE South 57 degrees 0 minutes West 219.9 feet to an iron stake; and continuing South 60 degrees 16 minutes 53 seconds West 243.95 feet to a concrete monument for corner; THENCE North 0 degrees 51 minutes 45 seconds West 335.92 feet to a concrete monument for corner; THENCE South 59 degrees 47 minutes 15 seconds West 602.20 feet to a concrete monument for corner; THENCE South 89 degrees 08 minutes 15 seconds West 447.50 feet to an iron -stake for corner; THENCE South 0 degrees 51 minutes 30 seconds East 1186.27 feet to an iron stake for corner, said corner being 292.60 feet North of the South right-of-way line of the Hillebrandt Bayou, same corner being located 292.60 feet North of the Northwest corner of the Dawndale Addition to the City of Beaumont, Jefferson County, Texas; THENCE North 68 degrees 53 minutes 37 seconds 1354.68 feet East to a point for corner; THENCE East 327.44 feet to a point for corner, said point being 117.68 feet North of the North- east corner of the Dawndale Addition; THENCE North 0 degrees 55 minutes 30 seconds West 531.85 feet to an iron stake for corner; THENCE North 88 degrees 57 minutes 45 seconds East 455.0 feet to an iron stake in the West right-of-way line of Crow Road, being a point for corner; - 2'- a THENCE North 1 degree 23 minutes 33 seconds West with the West line of Crow Road 965.31 feet to the place of beginning, containing 49.693 acres of land, and including half the width of all abutting street rights-of-way. and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted .August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described here- inabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the pro- perty described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas. 1970.
