HomeMy WebLinkAboutORD 70-32ORDINANCE NO. 700 — ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSI- FICATION OF TRACT NO. 130, PLAT D-22, F. BIGNER SURVEY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS -DESCRIBED HEREIN, PRESENTLY ZONED "R-111 -"R-211 TO 11C-111; AND BY CHANGING THE CLASSIFICATION OF TRACT NO. 52, PLAT D-22, F. BIGNER SURVEY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS AS DESCRIBED HEREIN PRESENT- LY ZONED 11R-111, "R-211 AND "C-111 TO "C-111;PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. 410 That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by chang- ing the zoning classification of the following described tract of land, presently zoned "R-111 Single -Family Dwelling District and "R-211 Two -Family and Multiple Dwelling District to 11C-111 Neighborhood Commercial District, to -wit: A tract of land in the Frederick Bigner Survey described on the tax rolls in the office of the Tax Assessor -Collector of The City of Beaumont as Tract No. 130, Plat -D-22, Frederick Bigner Survey and more particularly described as follows: FOR locative point begin at an iron stake in the southwest corner of the F. Bigner Survey, same being the northeast corner of the H. Williams Survey, and also being in the west line of the A. Williams Survey; THENCE north a distance of 445.8 feet to a point for corner, said point being the BEGINNING and northeast corner of the tract to be described; THENCE in a westerly direction a distance of 390.0 feet to a point for corner; 0- 70 -2a -70 THENCE in a southerly direction a distance of 99.07 feet to a point for corner; THENCE in an easterly direction a distance of 331.52 feet to a point for corner; THENCE north 290 54' east 116.5 feet to the PLACE OF BEGINNING of the herein described tract of land, containing in area 0.80 acres of land, and including half the width of the abutting street right-of-way; and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by chang- ing the zoning classification of the following described tract of land, presently zoned "R-1" Single -Family Dwelling District, "R-2" Two -Family and Multiple Dwelling District and "C-1" Neighborhood Commercial District to "C-1" Neighborhood Commercial District, to -wit: A tract of land in the Frederick Bigner Survey described on the tax rolls in the office of the Tax Assessor -Collector of The City of Beaumont as Tract No. 52, Plat D-22, Frederick Bigner Survey and more particularly described as follows: BEING a 2.359 acre tract of land out of the F. Bigner Survey in Jefferson County, Texas, and being out of and a part of the Thomas J. Brown 26.4 acre tract, said Brown Tract described in a deed dated January 29, 1901, recorddd in Volume 38, page 166 of the Deed Records of Jefferson County, Texas, said 2.359 acre tract being more particularly described as follows: BEGINNING at an iron stake which is located in the east line of the F'. Bigner Survey, which point is the southeast corner of the T. J. Brown 26.4 acre tract and the south- east corner of the tract herein described; THENCE north along the east line of the F. Bigner Survey 208.8 feet to a two inch iron pipe for corner; THENCE south 880 33' west 522.0 feet to an iron rod stake to a point for corner; THENCE south 00 02' east 208.8 feet to iron rod stake for corner; THENCE south 880 50' east 521.77 feet to the PLACE OF BEGINNING and containing 2.359 acres of land, more or less, being the land conveyed by W. C. Evans to William.Auburn Jett by deed dated January 9, 1930, re- corded in Volume 335, page 555 of the Deed Records of Jefferson County, Texas. RPrfinn 1_ That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont., Texas, adopted August 19, 1958,effective October 19, 1958, as amended. SPrt-i nn A _ That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described here- inabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the pro- perty described herein. .qari-i nn S That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
