TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFI- CATION OF A TRACT OF LAND OUT OF AND A PART OF THE GARTH 354.387 ACRE TRACT IN THE D. EASLEY LEAGUE, ABSTRACT 20, IN THE CITY OF BEAUMONT-, JEFFERSON COUNTY, TEXAS,-AS..DES- CRIBED HEREIN, PRESENTLY ZONED "R-lA" TO "C -l"; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in.particular the boundaries of the zoning districts as indicated upon the Zoning Map of The -City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by chang- ing the zoning classification of the following described tract of land, presently zoned,"R-lA", Single Family Residdn.tial'D.i:str:ict to "C-1" Neighborhood Commercial District, to wit: BEING a tract of land out of and a part of the Garth 354.387 acre tract in the D. Easley League, Abstract 20, in the City of Beaumont, Jefferson County, Texas, and being more particularly described as follows: BEGINNING at the northwest corner of Western Hills Unit 1 Addition to the City of Beaumont, Texas as recorded in Volume 11, Page 41 of the Map Records of Jefferson County, Texas; THENCE North 890 40' 40" west along and with the south line of Tolivar Road 276 feet to the PLACE OF BEGINNING of the tract herein described; THENCE continuing with the said south line of Tolivar Road north 890 40' 40" west, -8.28. feet to. a-- point for -corner; THENCE south 000 27' 30" west, 775 feet to a point for corner; THENCE south 890 40' 40" east, 828 feet to a point for corner; THENCE north 000 27' 30" east, 775 feet to the d? ! PLACE OF BEGINNING and containing 14.731 acres of land and including one-half the width of the abutting street right-of-way. and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applic- able regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property des- cribed hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas. 004 PASSED by the City Council on this 94 day of 1970. - Mayor -
