HomeMy WebLinkAboutORD 70-14� - Fes:-- t� -4 ORDINANCE NO. `7a ` 1 ENTITLED'AN ORDINANCE AMENDING CHAPTER 42 OF THE.CODE OF ORDINANCES OF BEAUMONT, TEXAS; AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 2.7 ACRE TRACT OF LAND IN THE W. B. DYCHES LEAGUE, ABSTRACT NO. 17, SAID TRACT BEING OUT OF A TRACT KNOWN AS THE HILLIE CASWELL TRACT IN THE W. B. DYCHES LEAGUE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS;` AS DESCRIBED HEREIN, PRESENTLY ZONED "R-1" TO "C-1"; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: SPrt.inr l_ That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular -the boundaries of the zoning districts as indicated upon the Zoning Map of The.City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned "R-1" Single -Family Dwelling District to "C-1" Neighborhood Commercial District, to wit: BEING a 2.7 acre tract of land in the W. B. Dyches League, Abstract No. 17, said tract being out of a tract known as the Hillie Caswell Tract in the W. B. Dyches League, in'the City of Beaumont, Jefferson County, Texas, and being more particularly described* as follows: FOR locative corner begin at an old iron pipe found from which a 12 -inch Pine marked X bears North 650 East 5.6 feet and a double post Oak marked with a diamond bears South 690 East 19 feet; said iron pipe locating the southwest corner of the J. C. Barry property (prior to the Southern Pacific Railroad right-of-way abandonment) and the northwest corner of the Hillie Caswell -Tract of Land (prior to the Southern Pacific Railroad right-of-way abandonment) and being in the east right-of-way line of the now abandoned Southern Pacific Railroad right-of-way; THENCE South.890 07' west .50.44 feet to a galvanized iron pipe placed in the center line of the abandoned Southern Pacific 100 feet Railroad right-of-way for a point; thence continuing South 890 07' west 49.56 feet to the east right-of-way line of the Old Voth Road 60'right-of-way for a point for corner, being the Northwest corner of the herein described tract and the PLACE OF BEGINNING; THENCE south 80 49' east 251.13', more or less, along the east right-of-way line of the Old Voth Road to a point for corner, said point being the southwest corner of. -the herein described tract; THENCE North 870 40' East 458.32' to a point for corner in the westerly right-of-way line of the Eastex Freeway (U. S. Hwy's, 69, 96 and 287); . THENCE North 110 24' West along the westerly line of said Eastex Freeway 244.32' to a point for corner; THENCE South 890 07' west 448.18 to the PLACE OF BEGINNING, said description including all of the 100' right-of-way of the abandoned Southern Pacific Railroad right-of-way, and also including one-half the width of the abutting street and highway rights-of-way. and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. -q"e,+i nn P That in all other respects the use of the property here- inabove described shall be subject to all of the applicable regula- tions contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affect- ing any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
