" / ® ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A TRACT OF LAND ON THE WEST SIDE OF DOWLEN ROAD, 1014.06 FEET SOUTH OF THE SOUTHERLY RIGHT-OF-WAY LINE OF FOLSOM DRIVE IN THE H. WILLIAMS SURVEY, ABSTRACT NO. 569 BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN PRESENTLY ZONED "R -].A" TO 11R-211; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Sdcti.on 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned "R-lA" Single Family Residential District to "R-2" Two Family and Multiple Dwelling District, to wit: Being a 5.74 acre tract of land fronting 500 feet along the west side of the Dowlen Road 60 foot right-of-way and having a depth of 500 feet, said tract being owned by the Pan American Petroleum Corporation and in the process of being donated to the West End YMCA, Beaumont, Texas, and being a part of that certain 713.67 acre tract of land described as Second Tract in the deed dated February 13, 1933 from Treadaway Land Company to Yount -Lee Oil Company recorded in Volune 374, page 113 of the Deed Records of Jefferson County, Texas, said 5.74 acre tract being more particularly described as follows: COMMENCING at the most westerly northwest corner of the aforesaid 713.67 acre tract on the north line of the Hezekiah Williams League; said corner also being the northwest corner of Survey No. 7 awarded to the heirs of Ann M. Allen by decree dated November 3, 1869, recorded in Volume "D", page 439 of the District Court Minutes; THENCE North 890 17' East with the most westerly north line of said 713.67 acre tract, the north line of said Williams League and with the north line of said Survey No.. 7 for a distance of 3101.00 feet to a point in said line; THENCE at a right angle South 00 43' East a distance of 1014.06 feet to the northwest corner and'PLACE OF BEGINNING of the 5.74 acre tract herein described; 0- 70 _io a is -7�0 *-.-.?� THENCE North 880 401 5511 East a distance of 500.00 feet to a point in the west line of Dowlen Road, having a width of 60 feet, for northeast corner of the 5.74 acre tract herein described; THENCE South 10 191 0511 East, parallel to and 30 feet, at a right angle, from the center line of said Dowlen Road, for a distance of 500.00 feet to a point for the southeast corner of the 5.74 acre tract herein described; THENCE South 880 401 55" West a distance of 500.00 feet to a point for the southwest corner hereof; THENCE North 11 191 0511 West a distance of 500.00 feet to the PLACE OF BEGINNING and containing 5.74.acres of land',.including one-half or 30 feet of the abutting Dowlen Road right-of-way. and the official zoning map of The City of Beaumont is hereby amended to reflect such.changes. Section. 2. That in all other respects the.use of the property hereinabove described shall be subject to all of the applicable regulations contained - in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19; 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section'4. That any person or corporation violating any of the terms and provisions of this ordinance shall be -subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
