ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER 37 OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY ADDING
A SECTION TO BE NUMBERED 37-71.1, MAKING IT UN-
LAWFUL TO IMPROPERLY START OR ACCELERATE A MOTOR
VEHICLE FROM A.STOPPED POSITION OR WHILE MOVING
SO AS TO CAUSE THE DRIVING WHEELS TO SPIN AND
CREATE A LOUD, SCREECHING NOISE; PROHIBITING A
START OR ACCELERATION WHICH CAUSES THE REAR END
OF A VEHICLE TO SWAY FROM SIDE TO SIDE; PROVIDING
A PENALTY; PROVIDING FOR SEVERABILITY; AND RE -
PEA -LING ALL ORDINANCES AND PARTS OF ORDINANCES
IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
1.
That the Code of Ordinances of Beaumont, Texas, is
hereby amended by adding a section to be numbered 37-71.1,
which said section reads as follows:
"Section 37-71.1. Improper Starts
It shall be unlawful for any person to start and
accelerate a motor vehicle on a public street or
highway from a stopped position or accelerate a
motor vehicle while moving in such a manner as to
cause the driving wheels to spin and ther.eby create
a loud, screeching noise, whether mot .oris"ts and/
or pedestrians are actually present or not, or to
cause the rear portion of the motor vehicle to
sway or swing from side to side."

Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section
1-8 of the Code of Ordinances of'Beaumont, Texas.
3.
If any section, subsection, sentence, clause or phrase
of this ordinance or the application of same to a particular
set of circumstances should for any reason be held to be
invalid, such invalidity shall'in nowise affect the re-
maining portions of this ordinance, and to such end, the -
various portions and provisions of this ordinance are declared
to be severable.

All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
PASSED by the City Council this the 13th day of
January, 1970.
