ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF. THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 1.55 ACRE TRACT OF LAND IN THE THOMAS SPEAR LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DES- CRIBED HEREIN PRESENTLY ZONED "R-1" to"C=2"; PROVIDING FOR SEVERABILITY: AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Car-fi nn 1 That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned 11R-1" Single Family Dwelling District to "C-2" Central Commercial District, to wit: Being a 1.55 acre tract of land located in the Thomas Spear League, Beaumont, Jefferson County, Texas, said tract lying along the northerly side of Concord Road, and being more particularly described by metes and bounds as follows: BEGINNING at the intersection of the north right-of-way line of Concord Road (Old Voth Road) with the western boundary line of the abandoned T & N 0 (Southern Pacific) Railroad right-of-way; THENCE along the right-of-way line of Concord Road to the following courses and distances: South 680 12' west 50 feet; South 840 19' west 50 feet; North 800 46' west 50 feet; North 610 50' west 50 feet; North 420 14' west 85 feet; North 33° 34' west 181.5 feet; THENCE leaving Concord Road north 50° 53' east 119.4 feet and continuing on the same bearings past the western boundary line of the abandoned T $ N 0 (Southern Pacific) Railroad right-of-way a further distance of 50 feet, more or less, to the center line of said abandoned T $ N 0 (Southern Pacific) Railroad right-of-way; THENCE south 400 29' east along the center line of said abandoned T-& N 0 (Southern Pacific) Railroad right-of-way 391.5 feet, more or less, to where such center line intersects the north right-of-way line of Concord Road; THENCE south 60° 40' west along the northerly right-of-way line of Concord Road 50 feet, more or less, to the PLACE OF BEGINNING and also including half the width of the abutting street right-of-way. and the official zoning map of the City of Beaumont is hereby- amended ereby amended to reflect such changes. Cartinn 7 That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas adopted August 19, 1958, effective October 19, 1958, as amended.. Cartinn '� That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described here- inabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of, this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas. 1970.
