HomeMy WebLinkAboutORD 71-9ORDINANCE CALLING BOND ELECTION; PROVIDING DETAILS RELATING TO SAID ELECTION; AND CON- TAINING OTHER PROVISIONS RELATING TO SAID ELECTION WHEREAS, the City Council of the City of Beaumont, Texas, has determined' -and hereby affirmatively determines, that an election should be held in said City.on the proposi- tions of issuing City bonds payable from ad valorem taxes and bonds payable from revenues for the purposes hereinafter set forth; and WHEREAS, the City Council wishes to proceed with the ordering of such election; Therefore BE IT ORDAINED BY THE CITY OF BEAUMONT: 1. That a special election shall be held in the City of Beaumont, Texas, on the 4th day of May, 1971, at which election there shall be submitted in accordance with law the following propositions, to -wit: PROPOSITION N0: ONE SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO -ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS.OF SAID CITY IN THE AMOUNT OF $1,900,000, MATURING SERIALLY WITHIN 25 -YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, AS SHALL BE BE - TERMINED WITHIN THE DISCRETION OF SAID.CITY COUNCIL, BUT NOT EXCEEDING 7% PER ANNUM, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID CITY, TO -WIT: A CENTRAL LIBRARY BUILDING, AND TO LEVY TAXES UPON.ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY SUFFICIENT -TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND'TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? The probable period of-usefulness.of the improvements for which the bond funds are 'to -be expended is more than 25 years. PROPOSITION NO. TWO SHALL THE'CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $2,900,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR.RATES, AS SHALL BE DE- TERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, BUT.NOT EXCEEDING 7% 'PER ANNUM, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVE- MENTS IN AND FOR SAID CITY, TO�-WIT: A POLICE AND CORPORATION COURT BUILDING, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID1CITY ANNUALLY SUFFICIENT TO PAY THE .INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL.OF SAID BONDS AS IT MATURES? The probable period of usefulness of the improvements for which the bond funds are to be,expended is more than 25 years. PROPOSITION NO. THREE SHALL THE CITY COUNCIL OF THE, CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $200,0003 MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTER- EST AT ANY RATE OR RATES, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, BUT NOT EXCEEDING 7% PER ANNUM, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND. FOR SAID CITY, TO -WIT: A FIRE.TRAINING BUILDING, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID'CITY ANNUALLY SUFFICIENT TO PAY THE' INTEREST ON SAID BONDS AS IT ACCRUES AND. TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS, IT MATURES? The probable period of. usefulness of the improvements for which the.bond funds are to be. -expended is more than 2.5 years. PROPOSITION NO. FOUR SHALL THE CITY COUNCIL .OF THE CITY OF BEAUMONT, TEXAS, BE -AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $5,590,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, AS SHALL BE DETERMINED WITHIN THE DISCRETION 'OF SAID CITY COUNCIL,.BUT NOT EXCEEDING 7% PER ANNUM, FOR THE.PURPOSE ,OF CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID CITY, TO -WIT: THE CONSTRUCTION AND IMPROVEMENT OF THE ROADS, BRIDGES, AND STREETS OF SUCH CITY, IN- CLUDING, BUT NOT BY WAY OF LIMITATION, RELATED DRAINAGE FACILITIES, RELATED TRAFFIC CONTROL DEVICES, AND THE ACQUISITION OF RIGHTS-OF-WAY, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY SUFFICIENT TO PAY THE INTEREST ON SAID'BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE, PRINCIPAL OF SAID BONDS AS, IT MATURES? The probable period of usefulness of the improvements for which the bond funds are to be expended`is more than_25 years. PROPOSITION NO. FIVE SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $360,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, AS SHALL BE DE- TERMINED WITHIN THE'DIS.CRETION OF SAID CITY COUNCIL, BUT NOT EXCEEDING 7% PER ANNUM, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVE- MENTS.IN AND FOR SAID CITY, TO -WIT: IMPROVING AND EXTENDING A TRAFFIC CONTROL SYSTEM FOR SAID CITY, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL,OF SAID BONDS AS IT MATURES? EIGHT SHALL THE..CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE REVENUE BONDS OF SAID CITY IN THE AMOUNT OF $5,000;000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR,DATE OR DATES, AND BEARING INTEREST AT ANY RATE -OR RATES, AS SHALL BE DE- TERMINED WITHIN.THE DISCRETION OF SAID CITY COUNCIL, BUT NOT EXCEEDING 7% PER ANNUM, FOR THE PURPOSE OF IMPROVING, ENLARGING, EXTENDING AND REPAIRING THE CITY'S WATERWORKS SYSTEM; SAID BONDS TO BE ISSUED IN ACCORDANCE WITH AND SECURED IN THE MANNER PROVIDED IN ARTICLES 1111 TO 1118, BOTH INCLUSIVE, VERNON'S TEXAS CIVIL STATUTES, AS AMENDED; ,AND TO SECURE THE PAYMENT OF UHE INTEREST ON SAID BONDS AS IT ACCRUES AND THE PRINCIPAL OF .SAID BONDS AS IT MATURES.BY PLEDGING THE NET REVENUES FROM THE OPERATION°OF SAID WATERWORKS SYSTEM, AND, AT THE OPTION OF THE CITY COUNCIL, BY, ALSO PLEDGING THE NET REVENUES FROM THE OPERATION OF THE CITY'S SANITARY SEWER.SYSTEM; EACH BOND TO BE CONDITIONED THAT THE' HOLDER'THEREOF SHALL NEVER HAVE.THE RIGHT TO DEMAND PAYMENT OF SAID OBLIGATION OUT. OF ANY FUNDS RAISED OR TO BE RAISED BY TAXATION; SAID BONDS TO BE ON A PARITY, AS TO SUCH WATERWORKS SYSTEM REVENUES,.WITH THE CITY'S OUTSTANDING BONDS PAYABLE FROM THE NET REVENUES.DE.RIVED FROM THE OPERATION OF SAID..WATERWORKS SYSTEM?. That the hours during which the polls will be open for voting in'said election shall be from seven o'clock a.m, to seven o'clock p.m. 3. That voting shall .be at the following respectively designated polling places in each of the following numbered Jefferson County Voting Precincts in the City of Beaumont heretofore established.and described by natural or artificial boundaries or survey lines by order adopted'by the Commissioners' Court of Jefferson.County and duly set out in its minutes. Absentee voting shall be conducted by a clerk for absentee voting, namely, James T. Garrard, City Clerk, and the place at which the absentee voting shall be conducted is desig- nated as the City Hall, Beaumont,.Tex�Ls, which is also the absentee voting clerk's mailing address to which ballot appli- cations and ballots voted by mail may be sent. Said clerk shall keep said office open for at least eight (8) hours, that is, from 8:00 o'clock a.m. to 5:00 o'clock p.m., on each day for absentee voting which is not a Saturday, a Sunday or. an official State holiday. 5. That, as to the bonds payable from ad valorem taxa- tion,'said election shall be held,and conducted in effect as two separate but simultaneous elections, to -wit:, one election in which only the duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation shall be qualified to vote on the ad valorem tax bond propositions, and another election at -which all other duly qualified resident electors of the City shall be qualified to vote on the ad valorem tax bond propositions. The votes cast at each of said separate but simultaneous elections shall be recorded, returned and can- vassed separately; and.that, as to the bonds payable from revenues, all duly qualified resident electors of the City shall be qualified to vote on the revenue bona proposition. 6. That notice of said election shall be given by posting a notice containing a substantial copy of this ordinance at the City Hall, Beaumont, Texas, and'by posting a substantial copy of this ordinance in each of the election precincts of said.City not less than fourteen (14) days prior to the date on which said election is to.be held, and same shall likewise be published on the same day in each of two (2) successive weeks in The Beaumont Journal, a newspaper published in the English language and of general circulation in said City, such newspaper being the official newspaper of said City, the first of said publications to be made not later than fourteen (14) days prior to the date.set for said election. • 0 PASSED,AND APPROVED this 6th day of April, 1971.
