'71- 3 O ENTITLED AN ORDINANCE AUTHORIZING GULF STATES UTILITIES COMPANY TO PLACE INTO EFFECT REVISED RATE SCHEDULE TO WIT: SCHEDULE DDL, DUSK TO DAWN LIGHTING SERVICE; AND TO CANCEL SCHEDULE DDL DATED MAY 11 1968, WHICH IS SUPERSEDED BY REVISED SCHEDULE DDL EFFECTIVE AS TO SERVICE RENDERED BY SUCH COMPANY ON AND AFTER MAY 14 1971. WHEREAS, Gulf States Utilities Company on f � , 1971 has requested authority to place into effect revised Schedule DDL. Such revised schedule has been filed with the City Clerk of the City of Beaumont, and approved by the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS Section 1. That Gulf States Utilities Company is hereby authorized to place into effect as to service rendered by it -on and after May 1, 1971 to its customers located in Beaumont, Texas, revised Schedule DDL. Section 2. That nothing in this ordinance contained shall be construed in any manner now or hereafter limiting or modifying the right and power of the City Council under the law to regulate the rates charged by Gulf States Utilities Company for its services within the City of Beaumont. II. TYPE OF SERVICE Unmetered mercury vapor lighting service from dusk to dawn every night, approximately 4,000 hours per year, served from Company's existing overhead wood pole distribution system under conditions as specified in Section IV. Ornamental poles and/or underground service is not covered under this schedule. III. NET MONT_NZY RATE ASA TYPE 175 watt - 7,000 Lumen H39-22xB @ $3.25 each per month 400 watt - 20,000 Lumen H33-1CD,-GL/w @ $5.25 each per month The net monthly rate specificed above will be adjusted for any new or in- creased taxes on revenue, load and/or energy or which otherwise can be directly allocated to the service hereunder, levied on or after October 1, 1966. IV. GENERAL PROVISIONS For the rate set forth in Section III above, Company will install; own and maintain at its own cost and expense, facilities which will consist of a mercury vapor luminaire, photoelectric switch control, and support bracket mounted on an existing wood pole or other support approved by Company and, when required, one span of secondary extension per light. When additional overhead facilities, not provided for in the above charges, are installed by Company, Customer will pay in advance of installation, the cost of such additional facilities which may be required to supply service from the nearest or most suitable existing pole of Company to the point designated by the Customer for the installation of said lamp. Company, at its option, may permit Customer to pay for such additional facilities in equal monthly installments extending over a period notto exceed twelve months. Pole locations shall be satisfactory to Company. If the additional overhead facilities consist of only normally installed wood poles, customer may elect to pay a net monthly charge of $1.00 per additional pole plus the charge under Section III above. 5/71 ORDINANCE NO. 7% AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, A DELAWARE CORPORATION, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE ITS INDUSTRY LEAD TRACK NO. 85 IN, ALONG, UPON OVER AND ACROSS BLANCHETTE AND MAIN STREETS IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO: PROVIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE --OF LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACKS SERVING COMMERCIAL AND INDUSTRIAL ENTER- PRISES; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PROVIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE DIREC- TION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND ORDINANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO USE THE TRACK FRAN- CHISED HEREUNDER; PROVIDING FOR TERMINATION OF THIS FRANCHISE ON JUNE 24, 1972, AND THE RESTORATION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR INDEMNIFICA- TION OF THE CITY OF BEAUMONT. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That The Atchison, Topeka and Santa Fe Railway Company is hereby granted the right, franchise and privilege to maintain and operate, at its own expense, its industry lead Track No. 85 in, along, upon, over and across the aforementioned streets, the center line of the said Track No. 85"being described as follows: Beginning at a point in the southeasterly property line of Blanchette Street, distant 107.5 feet, more or less, southwesterly from its point of intersection with the north- easterly line of Main Street; thence in a northeasterly di- rection a distance of 110 feet, more or 1ess, to a point in said northeasterly line of Main Street, distant 24 feet, more or less, northwesterly from said point of intersection with the southeasterly line of Blanchette Street. The location of said Track No. 85 is as shown by red line on print CEO Amarillo No. C-24-24905 dated July 9, 1970, hereto attached, marked `.'Exhibit A", and made a part of this ordinance. Section 2. The track to be maintained and operated under this ordinance shall be used only for the purpose of loading, unloading and/or switching to industrial tracks turning out of said Track No. 85 serving commercial and 7-/3 - -71 l �3
