ENTITLED AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF BEAUMONT, TEXAS, BY REPEALING
SECTIONS 16, 17, 18, 205 28 AND 29 OF
ARTICLE II, CHAPTER 15 AND ENACTING IN LIEU
THEREOF NEW SECTIONS 16, 175, 183 20, 28 AND
29 OF ARTICLEIII, CHAPTER 15, EFFECTIVE
JULY 1, 1971, PROVIDING FOR THE REMOVAL OF
GARBAGE AND TRASH BY THE DEPARTMENT OF
SANITATION, AND FIXING RATES TO BE CHARGED
FOR SUCH SERVICES; PROVIDING FOR ADDITIONAL
CHARGE FOR ACCUMULATED GARBAGE AND TRASH;
REGULATING CONTAINER SYSTEM SERVICES AND
ESTABLISHING RATES THEREFOR; PROVIDING TAXES
AND FEES FOR PERMIT TO TRANSPORT GARBAGE,
TRASH, WASTE, REFUSE, OR NIGHT SOIL ON THE
STREETS, ALLEYS OR PUBLIC THOROUGHFARES OF
THE CITY; PROVIDING FOR CONDITIONS OF ISSUANCE
OF SAID PERMIT; PROVIDING PENALTY; PROVIDING
FOR SEVERABILITY; AND REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:

Effective July 1, 1971, that Artic.l.e..I.I.o£.._.Chapter 15
of the Code of Ordinances of Beaumont, Texas, be amended by
repealing Sections 16, 17, 18, 20, 28 and 29 thereof, and
substituting in lieu thereof the following new sections 16, 17,
183, 20, 28 and 29, to wit:
"Section 15-16.
"Article II.
"Collection and Disposal
Collection and removal by the sanitation depart-
ment - Charges tor residential premises.
(1.) The Sanitation Department shall systematically
collect and remove garbage and trash from premises
used for residential purposes. All residences in
the city are required to pay a garbage service fee
except:
(a) Residences who haul their own garbage and
have a current inspection permit as described
in Section 15-25.

(b) Residences who use an on property
disposal method that is approved by
the City, County and State.
(c) Residences that are vacant and the
water meter is disconnected.
(2) No rate adjustment will be made for temporary
non-use of service unless the water meter is
disconnected. Non payment of the garbage
collection fee shall be sufficient grounds
for discontinuance of City water service. The
rate for collection outside the city limits
shall be the rates set forth in this section
plus 25% of the rates set forth in this section.
No type of service will be offered residences
that are residences described in Paragraph 1
above or for vacant lots. Fair and reasonable
charges for such residential service shall be,
and are shown in terms of dollars and cents
for a calendar month as.follows:
"Section 15-17.
(a) Single family residence $2.25
(b) Duplex apartment, building $2.25/unit
(c) Garage apartment unit $2.25/unit
(d) Two family units on one meter $4.50
(e) Group housing (three or more houses,
mobile homes, or governmental housing
units, on the same water meter, or
condominium or multiple family apart-
ment buildings with three or more
units:)
(e-1) Where all containers are
placed in the same location
the charge for each house,
mobile home, unit or apartment
shall be $2.00
(e-2) Where all containers are not
centrally located the charge
for each house, mobile home,
unit or apartment shall be
$2.25
Same - Charged for public, business and
commercial premises.
(1.) All .public, business and commercial institutions
in the city are required to pay a garbage service
fee except:
(a) Institutions who haul their own garbage and
have a current inspection permit as
described in Section 15-25.

(b) Institutions that have a private hauler
with a current inspection permit as
described in Section 15-25.
(c) Institutions who use an on property
disposal method that is approved by the
City, County and State.
(d) Institutions that are vacant and the water
meter is disconnected. In the event that
a business is located within a part of a
residence an appropriate charge will be
set for both activities.
(2.) The rates set out in the following schedule are
monthly charges for sanitation service:
(a) Group A. Auto supply stores; bakeries;
beer taverns; bottling plants, cafeterias,
candy stores, cigar stores; clinics,
creameries; drive-in cafes; drugstores
and pharmacies; drygoods and department
stores; grocery stores; hospitals, hotels,
ice cream parlors; meat and fish markets;
motels; newsstands; novelty stores;
poultry houses; printing firms; restaurants;
rooming houses; slaughter and meat packing
houses; sporting goods stores; variety
stores.; veterinary hospitals; colleges;
multi -story office buildings; drive-in
grocery stores; manufacturers of all types;
and any like or similar business not
specifically listed in this group, or
Group B, C, and D:

"Section 15-18. Charges when accumulation exceeds eight
yards per day.
Where the garbage and trash which accumulates on the
premises of an establishment, listed in the schedule above,
generally exceeds eight yards per day, the monthly rate
charged such establishment shall be the applicable rate
listed in the schedule plus $35.00 for each additional
truck .load per day required to remove the garbage and
trash from such establishment. Special collections can
be requested at the rate of $35.00 per bob -tail load when
the sanitation department has the available equipment.
"Section -15-20.
Sanitation container system.
(a) Public, business and commercial institutions will
receive sanitation container system service for
the removal of trash and garbage under the rates
and rules hereinafter set forth, as routes for
such service are established by the city. All
institutions on hand service will be required to
change to container service when they are of
sufficient size, have a -proper location, and
containers are available by the sanitation
department. If the institution is not agreeable
they.have the option of: (1) having a private
hauler with a valid permit; (2) taking out a
hauling permit and hauling their own garbage.
Under the sanitation container system service,
the City of Beaumont will furnish a container
or containers to be used in the collection and
removal of trash and garbage. In lieu of charges
provided in other schedules of this chapter, the
following monthly charge per container, based upon
container size, and number of collections per week,
are the charges for such service:

(b) Any institution which pays the rate set forth above
for eight (8) cubic yard container and has been
furnished with same may, upon request, be furnished
with additional eight (8) cubic yard containers at
the rate of seventy-three dollars ($73.00) per
month or an additional six (6) cubic yard container
at the rate of sixty-three ($63.00) dollars per
month, but containers must be side by side and
serve the same business. The rate for additional
containers will not apply to containers close
together but serving different public business
or commercial institutions.
(c) When the container smallest in size will adequately
and completely serve several adjacent business
institutions, then they may be required to use the
same container and pay a pro rata part of the charge,
determined according to the approximate quantity
of space used. The minimum charge for each customer
when a container is shared is five dollars ($5.00),
but in no case shall total charge be less than same
container serving one customer. The container
service will be the complete service for all trash
and garbage on the premises.
(d) Lids and end doors of all containers shall be kept
closed at all times except when the container is
being filled.
(e) It shall be unlawful for any person to disturb a
sanitation container furnished by the City of Beaumont
or the contents thereof. However, this subsection
shall not apply to the owner or occupant of the
premises for which such container has been furnished,
nor to their employees, nor to the duly authorized
employees of the City of Beaumont.
(f) It shall be unlawful to make a fire or burn any
material in a sanitation container furnished by the
City of Beaumont or to paint or mark upon same or
to place any poster,,placard or sign upon same.
(g) The sanitation container service will not be furnished
unless the owner makes provisions for the placing of
the container on private property and assume all
responsibility for damage to pavement or other surface
and keeps such surface in good repair so that the
container may be serviced by trucks.
(h) It shall be unlawful for any person or business to
place anything in a sanitation container other than
the owner or occupant of the premises for which such
container has been furnished and is currently paying
a service charge.

(i) It shall be unlawful to park in front of a
sanitation container.
"Section 15-28.
Same --Duration, taxes and fees.
All permits shall be issued for annual periods only, expiring
on the thirty-first (31st) day of December of each year, providing
that permits may be issued for fractional parts of any year during
which application is filed. The inspection and dumping permit fee
for each conveyance to be used by the applicant shall be:
(a) Small vehicles (1-4 Cubic Yard Capacity) such
as 1/2 ton pick-up trucks—$35.00 per year
(b) Medium vehicles (4-8 Cubic Yard Capacity) such
as 1/2 ton pick-ups with built up sides, dump
trucks, flat bed, van body or stake body—$50.00
per year
(c) Large vehicles (8-16 Cubic Yard Capacity) such
as 16 yard dump truck, flat bed with built-in
sides, stake body with built-in sides, or van
body --$75.00 per year
(d). Medium -large vehicles (over 16 Cubic Yard
Capacity) such as semi -trailer truck, trailer
truck with large van or 16 yard commercial
packer truck -m-$100.00 per year
(e) Extra large 16 yard dump truck used to haul dem-
olition material or 20 yard commercial packer
truck—$150.00 per year
If applicant has more than one truck, but only one truck will be
used in a twenty-four hour period for dumping at the city garbage
dump, then only one permit is necessary.
"Section 15-29. Same—Condition for issuance of permit.
Upon filing of the application described in Section 15-26,
the superintendent of the sanitation department shall grant such
permit if the following conditions have been complied with:
(a) Provision has been made to lawfully dispose of the
garbage, trash, waste, refuse, or night soil out-
side of the city limits of Beaumont or within the
city garbage dump. Any disposal other than in the
city disposal site must be in a site licensed by
the State;
(b) The provisions of this chapter have been complied
with;
(c) The proposed removal and disposition of such
garbage, trash, waste, refuse, or night soil
will not violate any of such provisions, or
create a public nuisance; and
(d) The vehicle for conveyance has been inspected
and approved by the sanitation department."

2.
That any person who violates any provision of this Ordinance
shall, upon_ conviction, be punished as provided in Section 1-8 of
the Code of Ordinances of Beaumont, Texas.
3.
That if any section, subsection, sentence, clause or phrase
of this Ordinance or the application of same to a particular set
of persons or circumstances should for any reason,be held to be
invalid, such invalidity shall in no wise affect the remaining
portions of this Ordinance, and to such end the various portions
and provisions of this Ordinance are declared to be severable.
4.
That all Ordinances and parts of Ordinances in conflict
herewith are hereby repealed.
